Terms and Conditions 1. DEFINITIONS In these Terms and Conditions: “Conditions” means these Terms and Conditions “Hire Period” means the period for which you have agreed to hire the Vehicle “Owner” means the owner of the Vehicle that you are hiring “us or we” means Yorkshire Motorhomes “Vehicle” means the vehicle that you have agreed to hire “you or your” means you, the hirer “Conditions” means these Terms and Conditions 2. YOUR CONTRACT When confirming your booking, you will need to confirm your acceptance of these Terms which will govern your rental of the Motorhome. Please read these Terms carefully as they are legally binding. If there is anything you do not understand or do not agree with, please contact us directly at Yorkshire Motorhomes. If you decide to cancel your booking or do not arrive to collect the Motorhome on the agreed date or time, charges may be liable as explained in these Terms and conditions. We offer vehicles for hire strictly in accordance with these Conditions. Please read this agreement carefully. By placing an order with us and by taking the Vehicle you will be deemed to have read, understood and agreed to these terms and conditions. No additions, alteration or substitution of these terms and conditions shall bind us unless they are expressly accepted in writing by a person authorised to sign on the companies behalf. 3. BOOKING CONFIRMATION AND PAYMENT Charges for the hire period are based on our hire price at the time of booking. A deposit payment of 20% of the total amount of the hire period is required to confirm the booking. This is a deposit which is non-refundable. A binding contract for the hire will come into existence when we issue your booking acceptance. We are under no obligation to accept any booking. The balance of the Hire Charge is payable 10 weeks prior to the start date of the Hire Period, or at the time of booking if you book less than 10 weeks from the start date of the Hire Period. Where you choose to pay by credit card we will make a charge of 1.5% in respect of each payment by credit card. There is no charge for debit cards. Any amendments to a booking, once confirmed, will incur a £20 administration fee. Any documentation requested by Yorkshire Motorhomes must be received at least four weeks prior to the pick-up date or, if the date of booking is less than four weeks prior to the pick-up date, within 4 days of the booking date. If the date of booking is less than 4 days before the pick-up date, you must contact Yorkshire Motorhomes with regard to delivery of documents. In the event that Yorkshire motorhomes does not receive any payment requested at least 4 days prior to the pick-up date, Yorkshire Motorhomes reserves the right to cancel the rental agreement and retain all payments made. It is therefore the hirer’s responsibility to ensure that all fees related to the Motorhome hire (some of which may be subject to a separate agreement) are paid in full in advance. 4. DAMAGE BOND You will be required to lodge with us the sum of minimum £800 prior to the commencement of the hire period this can be in the form of credit card payment, bank transfer or cash this will be refunded within 14 working days of the vehicle return undamaged. Costs will be taken to pay or part-pay for any loss or damage suffered as a result of your breach of these Conditions or to cover the insurance excess on the insurance policy should it be necessary to claim on the insurance policy. You agree that any such costs will be released to us. The above is in respect of each separate incident of accidental damage. Overhead damage is deemed as any damage to any part of the vehicle which occurs above 6 feet (1.83 metres) and or any third party property. Where damage is caused by overhead objects above this height, this amount shall rise to £1500. The bond shall be held by Yorkshire Motorhomes for a 14 day period following the return of the vehicle. The 14 days does not include any time taken by the issuing bank to return the fee into the hirers account. 5. THE HIRE INSURANCE The cost of the Insurance is included within the rental payment and upon pick up of the motorhome we will supply you with your motorhome rental agreement as confirmation of your insurance cover. You shall be liable for the first £500 or £1500 of each and any claim(s) made under the insurance policy which will be deducted from the rental damage bond deposit and if this is insufficient it will be paid by you within 7 days of written demand. The Vehicle is insured for the period of the hire ONLY and a copy of the insurance policy is available from Yorkshire Motorhomes on request. By signing the form you are accepting the conditions of the hire insurance policy. Fully comprehensive insurance is included within the hire charge but please note a late return of the vehicle is a traffic offence under the road traffic act and will also incur an extra charge. We strongly advise you to purchase additional personal holiday insurance as a separate policy. 6. AVAILABILITY Occasionally due to unforeseen circumstances motorhomes are not available as booked or agreed. If your booking has to be cancelled because the vehicle that you booked is no longer available we will endeavour to offer you the choice of an alternative vehicle, if an alternative vehicle is not available we will refund you all monies already paid but we will not be liable for any other costs or expenses incurred by you or any of your representatives. 7. RENTAL PERIOD Unless otherwise agreed the Vehicle will be available on the day of collection from the agreed location at the agreed time and must be delivered back to the agreed location at the agreed time on the last day of the Hire Period. If you do not bring the Vehicle back on time you will be liable to be charged for every day or part day you have the Vehicle after you should have returned it at the daily rate of the Hire Charge plus 50%. Should the late return of the Vehicle make us liable for extra costs (e.g. compensation of the next hirer) we reserve the right to recover these costs from you. There are no refunds for Vehicles returned early. 8. OUR RIGHTS OF CANCELLATION Yorkshire Motorhomes reserve the right to cancel the hire agreement if at the commencement of the hire period the driver’s licences are invalid or you have not provided the required documentation less than 6 weeks before the commencement of the Hire Period or if you fail to provide any details that we request that you provide. In these circumstances you will forfeit the deposit and we reserve the right to retain or require payment of an appropriate proportion of the balance as compensation for loss of revenue. Yorkshire Motorhomes have the right to cancel the hire and refuse to hand over the vehicle to any person who in the reasonable opinion of Yorkshire Motorhomes is not suitable to take charge of the motorhome. In such cases, the hire charge already paid will be refunded in full save for where it is reasonable for us to cancel the hire in which case you will forfeit the deposit and we reserve the right to retain or require payment of a proportion of the balance as compensation for our potential loss of revenue. You are strongly advised to insure against unavoidable cancellation. In these circumstances the total hire charge will be forfeited. We will also be entitled to end this agreement if being an individual you become subject to a bankruptcy order or being a company you go into liquidation, if you are in breach of any of these conditions, and we end the agreement this will not affect our right to receive any money we are owed under these terms and conditions. 9. YOUR CANCELLATION OF HIRE You must notify us in writing by first class post to our registered office if you wish to cancel the hire agreement but please call us immediately to inform us as this will improve the chances of us hiring the Vehicle. If notice of cancellation is received in writing to our registered office more than 6 weeks prior to the commencement of the hire period then the deposit will be forfeited. Should you cancel within 6 weeks of commencement of the Hire Period all of the Hire Charge will remain due and payable. 10. DRIVERS. Drivers must be over 25 and under 74 years of age at the time of and during the hire period and must have held a domestic driving licence for at least 3 years. In certain circumstances we can reduce the lower age limit to 23 years of age. The licence must be un-endorsed except for speeding and parking offences although we may allow a hire to if the licence is otherwise endorsed, this must be approved by Yorkshire Motorhomes and its insurers before hire commences. The licence must be produced at the time of collecting the Vehicle. Visitors from other countries outside the UK must hold a current international driving permit or licence. You must complete the insurance form to provide us with all necessary details of the driver or drivers in advance so that we can arrange the insurance for the vehicle during the hire period. We will require from you two forms of proof of identity along with photographic identification either a passport or photo driving licence must be produced by you at the start of the hire period. Acceptable forms of id are; your most recent Utility bills, bank statements or credit card statements (please note that mobile phone bills are not acceptable). Should you fail to produce the correct information or documentation the booking may be cancelled in accordance with our terms and conditions and there will be an additional charge to the standard hire charge should the licence be foreign or endorsed. This additional charge will be advised to you at the time of booking. YOU AND YOUR RESPONSIBILITIES 11. USING THE VEHICLE The Motorhome must be driven only by you and any driver named on the hire insurance policy and hire agreement, or by anyone else we authorise in writing in advance. You and any other authorised driver will not use the motorhome for hire or reward and not use the motorhome for illegal purposes and not use the motorhome for racing, pace making, testing of the vehicle’s reliability and speed or teaching someone to drive or use it as a commercial vehicle or use it for a purpose for which you need an operator’s licence if you do have one. You must also not use the motorhome while under the influence of alcohol or drugs, not drive the motorhome outside England, Scotland and Wales, unless we have given you prior written permission. The motorhome must never be overloaded and you must not carry more passengers than the stated seating capacity of the vehicle. The hirer and/or any named driver will be responsible for any fines and costs including court costs for parking, traffic or any other offences, congestion charges including any costs which arise if the vehicle is clamped and will pay the appropriate authority any fines and costs if and when the authority demands this payment. All drivers must be aware of the height of the motorhome and are responsible for ALL damage if driven under an obstruction that is too low for the vehicle to clear. Examples are low bridges, trees, height barriers into car parks etc. In this event neither the basic vehicle insurance nor the CDW (if applicable) will apply and the hirer will be responsible for the repair of all damages. Overhead damage is deemed as any damage to any part of the vehicle which occurs above 6 feet (1.83 metres) and or any third party property. 12. CARE OF THE VEHICLE You must not rent, sell, or dispose of the motorhome or any of its parts and you must not give anyone any legal rights over the motorhome. You must not tamper with the mechanics of the motorhome and you must not let anyone work on the motorhome in any context without the permission of Yorkshire Motorhomes in writing first, If Yorkshire motorhomes does give you permission you will only receive a refund if you have a genuine dated receipt for the agreed work undertaken. You must let Yorkshire Motorhomes know as soon as you become aware of a fault in the vehicle and you must ensure that the motorhome is kept in good condition and repair during the entire duration of the hire. You MUST AT ALL TIMES look after the keys to the motorhome and you must always lock the motorhome and KEEP the keys in your possession AT ALL TIMES when you are not using it. The keys must never be left unattended in the motorhome at any time as per the terms of the insurance policy and you must use any and all security devices if fitted. You must also always protect the Vehicle against bad weather which can cause damage. You must make sure that you use the correct fuel and all costs or expenses charged or associated with a wrong fuel incident will be liable in full by the hirer. You must bring the motorhome back to the place and at the time agreed in advance and you must check that you have not left any personal belongings in the motorhome and you will remain responsible for the motorhome until this time. 13. WHAT TO DO IF YOU HAVE AN ACCIDENT OR A BREAKDOWN If you have an accident you must contact Yorkshire Motorhomes immediately possible and not admit responsibility to anyone at any time and you should obtain the full names and addresses of everyone involved including any witnesses, you should also obtain full details of the vehicle/s involved including photographs showing the scene from several different angles. If the police are in attendance you must obtain a crime reference number and tell the police if anyone is injured or if there is a disagreement over who is responsible. You must make sure the motorhome is secure if left at the scene unattended and Yorkshire motorhomes will require an accident report within five days of the incident occurring. No responsibility can be accepted by Yorkshire motorhomes for any loss, damage or expense which occurs as a result of any accident. In the unlikely event of a breakdown you should contact the breakdown service that covers the motorhome quoting the registration number of the motorhome and inform Yorkshire Motorhomes immediately, you are only authorised to request repairs up to the value of £50, repairs costing in excess of £50 must be authorised by Yorkshire motorhomes PRIOR to the work being undertaken. 14. TYRES & WINDSCREENS You are responsible for any punctures or other damage to tyres during the hire and where possible it should be repaired or replaced as appropriate and paid for, by you at the time of repair or replacement. You should contact Yorkshire Motorhomes to seek instructions before carrying out any repair of damage to windscreens or windows. . 15. PETS & SMOKING Smoking is strictly prohibited in any of our motorhomes by law and animals are allowed in our motorhomes but have to be approved by us at the time of booking. Any damage however caused or signs of smoking and/or pets in the motorhome will result in a cleaning charge liable by the hirer if this rule is flouted. 16. GAS One full bottle of gas is provided, any usage will be charged at the current rate, should you require an additional bottle or need to replace an empty bottle during the course of your hire, this is your responsibility at your cost. 17. BED LINEN AND TOWELS We do not provide bed linen, pillows or towels as standard with the motorhome hire but if you would like to hire these items or are travelling from abroad please enquire about the availability, a small charge will be made for this. LIABILITY AND LIMITATION 18. YOUR LIABILITY Where any damage is caused to the motorhome during the hire term we will utilise the insurance policy to claim for any and all loss or damage sustained. You will be liable for the excess if we claim under the insurance policy and this will not reduce your liability under any circumstance. We will not claim under the insurance policy where damage to the motorhome is caused by a breach of any of these conditions and you agree that you will be liable for any damage sustained to the Vehicle during the hire where such loss or damage is not claimed under the insurance policy, you also agree that you will be liable for any loss or damage suffered by Yorkshire Motorhomes resulting from you breaching these Conditions. We reserve the right to claim and without limiting the generality of the above this includes the following charges: Our reasonable admin charges for resolving damage to the motorhome and any charges for loss or damage to the motorhome even if it is accidental or not your fault and/or this being subject to the cover provided by the hire insurance. Any Charge for damage to the windscreen or windows, punctures, or any other damage to tyres. The cost of making good any damage caused to the motorhome by improper use and the cost of making good any damage to the interior of the motorhome including all fixtures fittings and appliances. A fee of £50 for an un-emptied toilet cassette at the end of the hire will be charged and a minimum £100 valeting fee will be charged if the motorhome is not returned in the condition it was collected in. If you return the vehicle with less fuel than when you collected it, you will be charged a re-fuelling charge if you have not replaced more fuel than was provided at the start of the hire this charge is based on the cost of the fuel plus £20. Any published or agreed rates for delivering and collecting the Vehicle anywhere in the Uk and EU. Any and all charges including a loss-of-income charge if we cannot rent out the Vehicle arising from Customs and Excise or Immigration Authorities seizing or impounding the motorhome Any reasonable costs and administration charges which arise when we at Yorkshire Motorhomes have to administer your failure to pay charges that you are responsible for under any of the terms and conditions. We reserve the right to claim from the damage bond referred to in Condition 4 to cover any amount for which you are liable under any of these terms and conditions. Should the damage bond be insufficient to cover all of your liability you agree to pay the additional amounts for which you are liable within 28 days of our demand being made. Interest which will be added daily at the rate of 4% a year above the base lending rate of Bank of England every day you do not pay any due amount from day one as due or not paid on time. VAT will be added as appropriate at the current rate and any taxes due on any other charges as appropriate. You are responsible for any and all charges even if you have appointed someone else to be responsible for them. 19. EVENTS BEYOND OUR CONTROL Sometimes events beyond our control mean we occasionally have to alter or cancel bookings. When reference is made to such events in these terms and conditions, this means any event or circumstance which Yorkshire Motorhomes could not even with all due care, foresee or avoid. Yorkshire motorhomes cannot accept responsibility or pay any form of compensation, cost or expense where your contract with Yorkshire Motorhomes is prevented or affected or you otherwise suffer any loss or damage as a result of events beyond our control. This includes any delays to and/or restrictions to the hire to which you may be subject. However, if your booking has to be cancelled as a result, Yorkshire Motorhomes will offer you the choice of an alternative vehicle if one is available or refund you as described in our terms and conditions. Our liability will be limited only to the return of any monies paid by you to us in respect of the hire. 20. VEHICLE PARKING AND YOUR PERSONAL BELONGINGS Any vehicle that you park at the premises of Yorkshire Motorhomes or any other designated parking area is parked absolutely at your own risk and Yorkshire Motorhomes will not be held responsible for any claims in respect of any loss or damage to your vehicle or personal belongings or personal effects of you or any other person or persons from your hire motorhome or your parked vehicle left at our premises. 21. PAYMENT The hire payment can be made using card, direct bank transfer or personal cheque. Any charges to process the payment will be liable by the hirer at the standard rate applicable at that time. The Damage Bond cannot be paid by personal cheque but we can accept payment for this via the other payment methods listed above. 22. GENERAL LIMITATION Yorkshire Motorhomes will not be liable to you for any loss of profit or for any special consequential or indirect damage or loss suffered. Nothing in these terms and conditions shall be construed to operate so as to exclude or limit any liability for death or personal injury caused by our negligence or of our servants, employees or agents or to exclude or limit any liability in respect of fraud or fraudulent misrepresentation. 23. YOUR INFORMATION If you breach any of these conditions we can give the information you provide us to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and or any other relevant organisation. We reserve the right to also disclose any or all of your information if we are required to do so by law. 24. NOTICES Any notice or notices required to be given under these terms and conditions should be sent by prepaid first class post or e-mail to either Yorkshire Motorhomes registered office or any other relevant party’s last known address. 25. COMPLAINTS If you have reason to lodge a complaint this should be received in writing at our registered office within 7 days of the Vehicle being returned from hire. 26. SEVERABILITY If any provision of these terms and conditions is held to be void, illegal or unenforceable under any enactment or rule of law such term or provision shall to that extent be deemed to not form part of these terms and conditions but all other provisions of these terms and conditions shall remain in full force and effect at that time. 32. GOVERNING LAW This agreement is governed by the laws of England and Wales.
