Terms and Conditions of Booking and Hire Definitions ‘The vehicle’ refers to the VW camper van hired out to you as part of this agreement. ‘You’ refers to the hirer or hirers who have signed this agreement. ‘The hirer(s)’ refers to all the hirers who have signed this agreement and are named on the ‘Motor rental agreement’. ‘Agreement’ refers to the booking form, Motor rental agreement and the terms and conditions. Rental Contract Once signed, this agreement becomes legally binding and serves as a contract between the hirer(s) and Fistral Bays VW Camper Hire, Croft Farm, Halt Road, Goonhavern, Cornwall TR4 9QE. Drivers All Drivers must hold a full current UK drivers licence (for a manual transmission) and have held this for more than three years. Drivers must disclose all accidents, claims, endorsements, convictions and disqualifications to Fistral Bays VW Camper Hire prior to signing this agreement as failure to do so will invalidate the insurance. Drivers must not have more than 2 current minor endorsements (six points) on their driving licence at the time of hire. Drivers must be aged between 25 and 70 years of age and of sound health. By sound health, we mean the drivers must not have any medical or physical conditions that will in any way impair their ability to drive. Our insurance company will only insure a maximum of three drivers providing they conform to the above requirements. Insurance for the main driver is included in the cost of hire, additional drivers are charged at £5 per day. We cannot insure students or undergraduates. Only drivers who have been approved by Fistral Bays VW Camper Hire and are stated on the Motor Rental Agreement are permitted to drive the vehicle and are covered by the insurance. No other persons are permitted to drive or move the vehicle regardless of the situation. If any persons not named on the agreement drives the vehicle in any way, the hirer will lose their entire security deposit and will be breaking the law. All named drivers must have produced their photo driving licence and 2 additional proof of address (such as a utility bill less than 3 months old, not a mobile phone bill) before the day of hire and upon collection of the vehicle. Failure to do so will mean you cannot drive the vehicle and the cost of the rental will be forfeit. Fistral Bays VW Camper Hire will retain copies of these documents for security purposes. Your driving licence MUST display your current address. Up to 21 days before the day of hire, you must obtain your unique licence ‘check code’ from the DVLA website: https://www.gov.uk/view-driving-licence and pass this to Fistral Bays VW Camper Hire. Insurance – loss and damage All the information supplied at the time of booking MUST be accurate and correct. If there are any changes between the time of booking and the time of hire, you must inform us immediately as failure to do so may invalidate the insurance. If you fail to inform us of changes in your information supplied on the booking form before the day of hire, then the hirer will be liable for the administration costs to reinsure the vehicle with the correct details. All of our vehicles are insured with fully comprehensive cover subject to conditions. Drivers must be between 25 and 70 years of age and have held a full UK driving licence for at least three years. Drivers must be of sound health. By this we mean no driver must have a disability (either mental or physical) that will affect their ability to drive. Undergraduates and students unfortunately will not be covered by our insurers. Fistral Bays VW Camper Hire’s insurance will only cover the loss/damage of the vehicle, its fixtures and fittings. It does not provide cover for any personal items the hirer(s) bring with them. It is recommended that prior to hiring a vehicle from us, the hirer(s) take out personal holiday insurance to cover any eventuality. In the event that there are changes to the hirer(s) driving history or eligibility to drive between the time of booking and the day of hire and the hirer is no longer eligible to drive using our insurance no refunds will be given. In the event of damage to the vehicle the hirer(s) agree to pay a £500 excess on the insurance policy, which will be taken from the hirer’s security deposit. In the event of a claim irrespective of liability, Fistral Bays VW Camper Hire will retain the £500 security deposit until completion of the claim and this will be refunded accordingly. Mileage Fistral Bays VW Camper Hire allows an unlimited mileage within Cornwall only. Vehicles are NOT permitted to leave Cornwall. Due to the age of the vehicles, it is advisable to break long journeys into shorter intervals so not to put too much strain on the vehicle’s engine and mechanics. Booking and availability Bookings will only be valid upon receipt of your completed / signed booking form, deposit and written confirmation from Fistral Bays VW Camper Hire. The final outstanding balance must be paid in full 6 weeks prior to the commencement of the hire period. Failure to do so will automatically cancel your booking and forfeit your deposit. Bookings less than 6 weeks before the hire period must be paid in full at the time of booking. Payments made by credit card or by PayPal will incur a 2% handling fee. At the time of booking you will be given your choice of van subject to availability. In the event of your chosen van not being available due to accident or mechanical breakdown, Fistral Bays VW Camper Hire reserves the right to change your chosen van without notice. However, we will always endeavour to inform you of this prior to the commencement of the hire period. In the unlikely event that your chosen or replacement vehicle becomes unavailable prior to the hire period Fistral Bays VW Camper Hire will refund the full monies paid. Security deposit On the day of hire, a returnable £500 security deposit will be required from the hirer. This is taken to ensure the vehicle is returned to Fistral Bays VW Camper Hire in the same condition as it went out. The deposit will be refunded subject to a satisfactory inspection by a member of Fistral Bays VW Camper Hire. The vehicle inspection may take place after the departure of the hirer(s) whilst we prepare for the next customer. For breaks of 7 days or under, the security deposit must be paid using a pre- authorised credit/debit card payment. In the event of a pre-authorised transaction, the hirer gives consent for their bank to secure £500 to be used by Fistral Bays VW Camper Hire in the event of any charges or damages incurred during hire. Fistral Bays VW Camper Hire will not call upon the money unless required. If no claim is made, the pre-authorised security deposit will expire within 8-10 days. Fistral Bays VW Camper Hire is unable to cancel the pre-authorisation code before this period. For breaks over 7 days we will require the £500 security deposit to be paid in full, prior to the commencement of the holiday. In this instance, the security deposit will be refunded to the hirer on completion of its inspection via a cheque in the post or bank transfer within 3-5 days after departure. Should the vehicle or it’s contents return damaged or with items missing, Fistral Bays VW Camper Hire will in all cases draw the full £500 deposit for necessary repairs or replacements. You will be informed if this is the case. Fistral Bays VW Camper Hire reserves the right to have all repair work/ replacements carried out by professional mechanics and other professional agencies of their choice. On completion of the repairs/ replacements Fistral Bays VW Camper Hire will send you invoices of all work carried out and refund you the remaining money from the deposit. In the event that the security deposit is taken and the hirer has used a pre-authorised swipe then a £10 card handling fee with be passed onto the hirer. Please note that in all cases of charges incurred, irrespective of the amount, the full £500 security deposit will be taken and remaining monies refunded. This is a requirement of our card handling service. On the day of hire, the hirer(s) are required to leave a £20 cash fuel guarantee deposit. This is will be refunded up on the return of the vehicle providing that the vehicle returns with the same level of fuel as indicated on the motor rental agreement. Cancellation Fistral Bays VW Camper Hire reserves the right to cancel any booking at any time. In the event of a cancellation by us, the hirer(s) shall receive a full refund unless the cancellation is as a result of a breach of these terms and conditions by the hirer(s). Any refunds given will be for the hire of the vehicle and additional hired items only. No refunds will be given for loss of campsite fees or travelling expenses. We recommend that customers take out holiday insurance to cover unforeseen cancellation. Should the hirer(s) wish to cancel a booking, they must do so in writing. For cancellations more than 6 weeks prior to commencement of hire only the booking deposit will be forfeited. For cancellations less than 6 weeks prior to hire, the full balance will be forfeited. Cancellations due to illness or extreme circumstances will be at Fistral Bays VW Camper Hire’s discretion. Collection and return of the vehicle For weekly hires or hires comprising of more than one night, vehicles can be collected from our collection premises at the time allocated by Fistral Bays VW Camper Hire and issued at the time of booking (from 2:30pm onwards). Overnight hires can be collected at 10am. The vehicles must be returned by 10am (or the time agreed by Fistral Bays VW Camper Hire) on the return date as stated on your Motor Rental Agreement. There will be no reduction in price for late pick up or early returns. All vehicles will be sent out with a full tank of unleaded petrol and must be returned to the same level it left our premises. In the unlikely event we need to delay your collection time, Fistral Bays VW Camper Hire will inform you as soon as possible, using details provided by you on your booking form. No refunds will be given for delayed departures. On the day of return, the hirer(s) remains responsible for the vehicle until the keys are handed back to a member of Fistral Bays VW Camper hire. The hirer must NOT abandon the vehicle or leave the keys with any third party, without the consent of Fistral Bays VW Camper Hire. The hirer acknowledges having received the vehicle and additional hired items in a clean condition and in sound working order in accordance with the departure checklist and inventory. Late returns If you return the vehicle after the pre-arranged time, stated on your Motor Rental Agreement, your insurance will be invalidated by Fistral Bays VW Camper Hire and their insurance provider. This may result in a total loss claim against YOU should an incident occur. If for any reason you are going to return late, you MUST contact us immediately. All late returns (beyond the time stated on your motor rental agreement) will be charged at £50 per hour. This will be deducted from your security deposit. Rental restrictions All Fistral Bays VW Camper Hire’s vehicles must remain within Cornwall during your hire period, unless you have prior written consent from Fistral Bays VW Camper Hire. Failure to do so will be a breach of the terms and conditions and your security deposit may not be refunded. Fistral Bays reserve the right to fit and monitor the vehicles, using GPS trackers, without disclosing this to the hirer. Should the tracker information, inform us that you have breached these restrictions, you the hirer will automatically forfeit the security deposit and Fistral Bays will provide you with a copy of the infringements. Title to the vehicle The vehicle remains the sole property of Fistral Bays VW Camper Hire and must not be sub let to any third party. Vehicle care & fuel All our Vehicles are supplied to you in good working order. On commencement of hire the vehicles fluid levels and tyre pressures are checked and adjusted accordingly. As part of this agreement it is your responsibility to check and maintain the levels in the vehicle for the duration of your hire as directed by Fistral Bays staff. As all of our vehicles are 40 years old they must be treated as such. The vehicles’ top speed is 55mph. Please note this is a maximum speed not a target speed. You must not over rev the engine for long periods of time or put the engine through any undue stress as this will damage it. You must take all reasonable steps to properly maintain the camper through regular checks on engine oil and gauges. If you cause damage to the engine or the vehicle’s mechanics by ignoring the warnings lights you will be liable for any transport costs, repairs required or even the cost of a replacement engine. The vehicles must only be driven on sealed/ tarmac roads and must never be driven off road, on the beach or through water. It is the hirer(s) responsibility to check the height of the vehicle prior to entering any height restricted areas such as car parks, tunnels and under passes. Any damage caused to the vehicle or third party property will be the responsibility of the hirer. The vehicles bodywork must not be altered in any way; this includes attaching items such as banners, posters, signs or any artwork, hirer(s) own bike racks and roof racks. This list is not exhaustive. The vehicles run on unleaded fuel and must only be filled up using unleaded fuel. Any damaged caused to the vehicle as a result of misfueling by the hirer will be charged to the hirer. On the day of collection the hirer(s) will be required to leave a £20 fuel guarantee deposit. This will be refunded upon return following an inspection by a member of Fistral Bays, providing the vehicle is returned with the same amount of fuel as stated on the motor rental agreement. Should the vehicle be under fueled, the £20 deposit will be retained to cover costs incurred for replacing the missing fuel. No refunds will be given for returning the camper with more fuel than stated on the motor rental agreement. Bikes A bike rack can be hired at additional cost, these are suited to the van. Owners own may not be used. Please do not put bikes inside the van. Road restrictions- do’s and don’ts Only use the vehicle on suitable roads, do not use the vehicle on sand, gravel or grass unless on a designated campsite. NEVER park the vehicle on a beach. The vehicle must be parked on a hard level surface at all times with the handbrake fully engaged and must not be put into contact with salt water. If the vehicle needs to be recovered as a result of the hirer(s) negligence when driving/parking, the hirer(s) will be liable. The vehicle must not be used for any illegal purpose, for hire or reward, or used for racing, rally or other contest. The vehicles are 40 years old and should be treated as such. They must be driven in a responsible manner and must never exceed the maximum permitted speed of the vehicle (refer to the vehicles handbook). Do not leave the ignition on without starting the engine as this will damage the vehicles ignition system. The hirer(s) will be liable for all mechanical damages if it is found to be as a direct result of their negligence/driving/misuse of the vehicle. The vehicle must not be used to tow any other vehicle or trailer. Do not drive the vehicle with the roof up. Breakdown In the event of a breakdown or any problems please report these immediately to us on 01872 572 822 or 0779 688 7537. All our vans have AA cover and should they be unable to repair the vehicle and get you going by the roadside the AA will relay you back to our premises. A replacement van may be offered but this will be subject to availability. In the event that no replacement vehicle is available Fistral Bays VW Camper Hire will offer you a refund of the hire charge for any days the hirer(s) lose the total use of the vehicle. Fistral Bays VW Camper Hire cannot accept liability for any costs arising from accident, breakdown or any other cause, e.g., replacement van costs, travel, accommodation, telephone calls, etc. If the breakdown has been caused through the actions of the hirer(s) they will be liable for all costs incurred and Fistral Bays VW Camper Hire will not refund for any unused days of hire. In the event of breakdown the hirer(s) must remain at a safe distance from the vehicle until the AA recovery vehicle arrives. The hirer(s) may not abandon the vehicle at the roadside. The hirer(s) must hand over the keys to the authorised AA Recovery Vehicle Driver. If the hirer(s) abandon the vehicle, Fistral Bays VW Camper Hire will deduct any transport and labour costs incurred in returning the van to our premises and any costs arising from loss or damage to the van whilst it is unattended from the security deposit. In the event of minor non mechanical problems, where the vehicle is still working and able to be driven such as fridge, sink, cooker, bed or internal lights the hirer(s) should inform Fistral Bays VW Camper Hire and return back to us to attempt to correct the problem. No compensation will be given for minor non mechanical problems if left unreported at the time the problem arises or if the situation has been rectified by us. Health and safety The driver (s) and passengers must strictly adhere to the health and safety guidelines as specified and explained to you at the time of hire. These are also displayed in the van guide within the vehicle. Use of a BBQ The hirer(s) are responsible for using BBQs in an appropriate and careful manner. Please do not use BBQ’s in the immediate vicinity of the vehicle or awning. Elevating Roof It is the hirer(s) responsibility to ensure that the roof is secured in adverse weather conditions. Any damage caused as a result of not taking action may result in the loss of your security deposit. Persons sleeping in the roof space do so at their own risk. Fistral Bays VW Camper Hire will not accept any liability for any accidents resulting from putting up the roof incorrectly or from entering and exiting the beds in the roof. Awnings & Tents Prior to hire, Fistral Bays VW Camper Hire will check your awning/ tent to ensure it is in full working order. Hirer(s) are responsible for ensuring the awning/ tent returns in the same condition as it was rented to you. All defects or problems with the awning/ tent must be reported to Fistral Bays VW Camper Hire immediately. Failure to report any defects at the time of discovery will act as confirmation to its satisfactory condition. In adverse weather conditions the hirer is responsible to take all steps to avoid damage to the awning. In the event of damage to the awning/ tent, Fistral Bays cannot accept any responsibility for hirer(s) property or any disruption caused. No refunds will be given as a result of awning/ tent damage which was out of our control. Awnings and tents must be pitched in accordance to the manufacturer’s instructions. In the event that an awning or tent needs replacing, hirers must return to us to collect replacement equipment subject to availability. No replacements will be provided if any damage to the awning/ tent is caused by the hirer(s). In the event of damage to the awning/ tent the hirer will be responsible for the cost of repair or replacement which will be deducted from the security deposit. Passengers No more people than the maximum number of seats can be transported. It is the hirer’s responsibility to ensure that all passengers are suitably restrained using the seatbelts provided whilst the vehicle is in motion. By law children under the height of 135cm or under 12 years of age must be sat on a booster seat. It is the hirer’s responsibility to provide and fit their own booster/ baby seat. For further information please refer to www.childcarseats.org.uk Smoking By law smoking is prohibited in our vehicles and awnings. Please respect this. Smoking within the vehicle and/or awning is in direct breach of our terms and conditions. The hirer will be responsible for any damage or additional cleaning as a result of this. Alcohol and Drugs It is against the law to drive under the influence of alcohol or drugs. The hirer(s) will be responsible for any travel costs or impound costs incurred as a result of alcohol or drug related incidents. The hirer is reminded that only those parsons named on the Motor Rental Agreement are allowed to drive the vehicle and no other person must attempt to drive. Pets Fistral Bays VW Camper Hire welcomes dogs in it’s designated dog vehicles. The maximum of 2 dogs are permitted into the vehicles with prior authorisation at an additional cost of £25 per hire. We specify that hirers must bring their own protective coverings for the upholstery as they will be liable for the costs of any damaged caused as a result of their pets. Drinking Water We recommend that you do not drink the water in the van unless it is boiled first. We advise that you drink bottled water whilst in your camper. Gas You should have enough gas to last for the duration of your holiday but should you run out, take the empty bottle to a Camping Gaz agent so the bottle can be refilled. On return/end of the hire, Fistral Bays VW Camper Hire will reimburse the cost of one re-fill subject to production of a valid receipt. Please note Fistral Bays VW Camper Hire will not pay for an incorrect size or make of gas cylinder and the hirer will be charged £50 for replacing the incorrect size or make of the gas cylinder. This will be deducted from your security deposit. The hirer(s) are responsible for ensuring the gas is turned off at the bottle prior to sleeping and whilst driving. Accident reporting If the vehicle is involved in an accident you must not leave the scene until you have spoken to the other party’s involved and exchanged details and contacted Fistral Bays VW Camper Hire. You must never accept liability. The details you must give and receive are: Your name, the vehicle registration number, our company details (name, address, phone number). You must inform Fistral Bays VW Camper Hire immediately and if necessary call the police. As soon as possible you MUST complete an accident report form which should be retained and given to Fistral Bays VW Camper Hire at the earliest opportunity. Fines and penalties The hirer(s) will be liable for any toll charges, parking tickets, speeding fines or moving traffic violations which are incurred during the duration of your hire, Subsequently if Fistral Bays VW Camper Hire receives notification that a fine or penalty was incurred during your period of hire we reserve the right to pass the fine/penalty on to you and if necessary, inform the relevant authorities of your name, address and driving licence number. Tyres/changing wheels & Windscreens Fistral Bays VW Camper Hire provides all camper vans with a serviceable spare wheel and tyre. However, in the event that a wheel requires changing the AA recovery service MUST be called to complete this work. Fistral Bays VW Camper Hire will accept no liability for any work carried out by the hirer which results in accident/damage to the vehicle and/or third party property. If a tyre requires changing, then authorisation must be sought from Fistral Bays VW Camper Hire prior to any work being undertaken. The hirer is fully liable for the excess or costs associated with the replacement or repair of the windscreen irrespective of fault. Charges- cleaning If upon return of the vehicle(s) they require a special clean due to spillages/stains, the hirer(s) will be liable and the cost of a vehicle valet debited from the security deposit. In addition to this, the hirer(s) will be charged a fee of £30 should the van's utensils, cutlery or appliances be returned dirty. Lost/ damaged keys At the time of hire you will be supplied with a full set of keys for the vehicle. All keys and locks are checked prior to hire to ensure they are in full working order. Care must be taken to not leave the keys for the vehicle unattended or within the vehicle when parked as the hirer(s) will be responsible for replacement of keys lost/stolen. If the vehicle keys are lost, Fistral Bays VW Camper Hire must be contacted immediately as it may be possible that a spare set can be run out to the hirer(s). The hirer(s) are responsible for any costs associated with providing replacement keys during the period of hire. These costs will be deducted from your security deposit. If the hirer(s) suspect the vehicle keys to have been stolen, you MUST report the matter to both Fistral Bays VW Camper Hire and the police immediately. Keys must not be forced into the locks. If the keys become damaged due to misuse or excessive force the hirer(s) will be liable to cover the cost of replacement keys or locks .This will be deducted from the security deposit. Lost/ damaged extras Additional optional extras including awnings, bedding, van decoration, heaters must be returned in the state in which it was hired out by Fistral Bays VW Camper Hire. The hirer(s) are responsible for the cost of repair or replacement of any additional optional extras lost or damaged during the hire period. Security The vehicle must be secured at all times when parked and unattended. Any loss of items as a direct result of the vehicle not being secured will result in a deduction from the hirer(s) security deposit amounting to replacement value. If the vehicle is to be left unattended for any period of time, wherever possible the vehicle must be left in a well lit area such as a secure car park, items of value (including the CD player face plate) are to be stored out of sight. Customer car parking Customers own vehicles parked on the Fistral Bays VW Camper Hire premises are parked entirely at the customers’ own risk. It may be necessary for Fistral Bays to retrain the hirer’s car keys during the hire period. Fistral Bays will ensure all keys under their control are securely locked away. Breaches of these Terms and Conditions Once signed, if you breach these Terms and Conditions we will have the right to terminate your booking and may require you to vacate the vehicle or return it immediately. A breach of these Terms and Conditions includes, failure to comply with our instructions regarding use of the van or health and safety advice. In the event of you committing a breach of these Terms and Conditions no refund of the fees you have paid will be returnable to you. You will also be liable for any costs incurred in returning the van to our premises. Our liability to you Fistral Bays VW Camper Hire promises to supply you with a vehicle or replacement vehicle which is in sound mechanical working condition. Fistral Bays VW Camper Hire will not accept any responsibility for the loss or damage to any persons or property sustained unless it is due to our negligence. If Fistral Bays VW Camper Hire is deemed to have been negligent, then our liability will be limited to the loss or damage which is was a foreseeable result of such negligence. Excluding a case of death or personal injury, our liability will be limited to the amount agreed by the hirer(s) to pay for the right to use the vehicle for the hire period. Variation and change Fistral Bays VW Camper Hire reserves the right to change the chosen van without notice. Data protection Fistral Bays VW Camper Hire will only use the personal information supplied by the hirer(s) for the purpose of completing/fulfilling the booking/hire. We will not use it for any other purpose. Our Terms & Conditions and prices are subject to change without notice and may vary.
