Terms and Conditions General These terms & conditions govern the relationship between: Lets Go Biking Limited Tarka North Tawton Devon EX20 2DD, A company incorporated in England & Wales (“MTS” the “Company”, “we” or “us”) and “you” the customer. These Terms and Conditions (the “Terms”) will form part of a Contract of Hire of a motor vehicle (“Rental Agreement”) between the hirer and the hire company. Collecting the motor home. Please try not to plan a major journey of your holiday on the same day you collect your vehicle. We show you how the motor home works, so please allow some time for this process. We check that Oil, Water & Tyres levels are at the correct level each time before handover. We recommend that you check the oil, water and tyre pressures daily and you acknowledge and agree that doing so during the period of hire is your responsibility. You agree that you will be responsible for any damage, accident or breakdown resulting from your failure to keep the oil and water levels and tyre pressure at an appropriate level. You agree to the cost of repairing or replacing the tyres of the vehicle during the rental period is your responsibility, unless the tyre is defective due to manufacture and is returned to us for inspection and replacement. You agree to repay to us any and all costs incurred by us as a result of your damage to tyres. If you have any questions about the condition of the tyres on Collection, or during your hire, you should contact us immediately on [01837 880075. Cleaning On collection the motorhome will be clean and should be returned in the same condition . Cleaning equipment and materials are provided free of charge so part of your holiday package. If the vehicle is not returned to us in a clean condition we reserve the right not to accept it’s condition. If we do not accept its condition, we will notify you at the time and we reserve the right to levy an additional valet charge of £78.75 Replacement Vehicles. If you have chosen a particular specification, size, model or make of motor home and it is not available, you agree that we may need to offer you another vehicle of a different specification, size model or make. You may ONLY travel within the UK. Written confirmation of fully comprehensive insurance cover is required before beginning the journey. Collection and Return Your hire starts and finishes at the Okehampton motorhome site. For information on how to access the site, please ask at the time of booking. We expect you to return the vehicle to us at the end of your hire in the same condition we gave it to you at the beginning of the hire. Please allow one hour before the end of your hire period to return the vehicle, clean and unload it and complete the check in process. For example, if your vehicle is due back at 11.30a.m., please aim to be back at 10.30a.m. to complete the hand over. Our trained staff will visually inspect the vehicle at the beginning and end of the hire for any obvious damage and mileage recorded with you on return of the Motorhome. We reserve the right to charge the following levies: For toilet tanks that are not empty: £80 For a vehicle not in the same clean condition as on collection: £78.50 Per hour (or part hour) for a late returned vehicle: £45 You agree and acknowledge that we may undertake full or remedial repairs without referral to the hirer, and those costs, which you agree are reasonably incurred, will be charged to the hirer at least up to the value of the insurance excess lodged that you have paid to us. Collection / Return Times Collection times: 15.30. to 17.30. Return times: 09.30. to 11.30 Collect or return of a vehicle outside of these hours can be arranged at the time of hire subject to availability and possible extra charges. We will not be deemed to have received the vehicle until we have signed in acceptance of it. You will remain liable for the vehicle until we have signed our acceptance for it and any damage that occurs to the vehicle prior to our acceptance of it shall remain your responsibility in accordance with this agreement. We request that you return the vehicle on time. We reserve the right to charge a penalty of £50.00 per hour from the time your vehicle should have been returned to the time. We will charge fractions of the hour as a full hour. If we become liable for any fees, costs, compensation or other expenses as a result of you returning the vehicle to us late, we reserve the right to pass these costs on to you in their entirety and you agree that you are liable for them. Period of Hire The times and dates of the contract of hire must be strictly adhered to. Unfortunately, we cannot offer a refund if you bring the vehicle back early and you acknowledge and agree that you will remain liable for the entire amount of the vehicle hire as agreed with you in advance of the hire. NO REFUND IS GIVEN FOR THE EARLY RETURN OF THE VEHICLE Drivers. You may register additional drivers of the vehicle with us, provided that: They have a full, legal and valid UK driver’s license or equivalent, suitable for the vehicle type being hired, They are listed as additional drivers in the insurance documents They meet the criteria listed below under ‘Driving Licences’, and We have accepted them as drivers by countersigning the form and taking copies of the documents and details relevant to their addition to the insurance. Driving Licences. We have some specific rules about drivers’ licences and driver’s ages which are designed to protect you and us and which are imposed by our insurance company. Drivers must be over 28 and under 70 years of age. Drivers must have held a full driving license for at least 3 years. The license must have no endorsements. Visitors from abroad must hold a current international driving permit or license (Foreign license holders will incur an additional insurance premium charge). 2 forms of proof of address must be produced by all hirers at the start of the hire i.e. utility bills, bank statements or credit card statements. If your driver’s licence does not have your photo on it, we will also need to see a copy of your passport. Insurance. We do not provide motor insurance cover but are happy to recommend a number of insurance providers. You will need to provide proof of fully comprehensive motor insurance cover for the UK during the rental period: The vehicle is ONLY hired for the contracted period of the hire contracted. This means that late return of the vehicle will put you at risk of committing an offence under the Road Traffic Act 1988. We advise you to take out additional personal holiday insurance to cover personal loss, illness, injury and holiday cancellation. We take an excess deposit by cash, credit or debit card pre-authorisation, bank transfer or cleared cheque in advance of the hire period as follows: £1000 for ordinary hires, As long as you return the vehicle in the same condition that it was hired out to you, we will refund the deposit within 7 days of the end of the hire period. If we have to make any claim against the insurance as a result of your hire, this will result in the full or partial loss of the excess deposit. Any charges we incur for loss or damage to the vehicle, its equipment or accessories which is not covered by the insurance policy, will be deducted from this deposit and/or billed at the time of return. We also charge a £50 management fee, per incident, for the repair of any damage incurred to the vehicle during your hire and you are solely responsible for this fee. This fee covers the time and cost involved in taking the vehicle to be repaired, sourcing materials etc You agree that you will advise us of any damage to the vehicle at the time it occurs (except for minor breakages and superficial damage such as scratches). You also agree that you will contact your insurance company using the details provided to you and complete the required paperwork such as claim forms or accident reports and any additional paperwork requested by the insurance company. You agree to complete any such paperwork prior to handing back the vehicle. You agree to indemnify us for any costs or liabilities incurred as a result of your failure to do so. Insurance Excess Insurance. Repairs to Motorhomes can be extremely expensive, even for damage that appears to be quite minor. We strongly recommend you to take out a specific insurance policy to cover the insurance excess and any damage to glass & tyres. If the vehicle is damaged by a third party we will treat the incident in exactly the same way as if it had been damaged by you. Our web site contains links to an independent supplier of insurance cover . You acknowledge and agree that although we may act as the introducer for an insurance provider we are not their agent and do not represent that company. You should obtain your insurance directly from the insurance provider you select and make sure that you pay and keep up to date all relevant insurance premiums directly with them. You must obtain all quotes for insurance direct from an appropriate insurer. Booking Details. You may make enquiries and bookings by phone or email In order to confirm the booking, we need you to complete and return a copy of our booking form to us along with a non-refundable booking deposit of £55 per week of hire . We will also email you an invoice for the balance payment and a confirmation of your booking. Full payment of the balance in respect of your hire is due 6 weeks before the commencement of the hire (or with completed booking form if booked less than 6 weeks before hire). If we do not receive payment in accordance with this section of this agreement, you agree that we may release the vehicle reserved for your dates and that it may no longer be available for your hire. If you have any problems making payments in accordance with this schedule we request that you contact us to discuss them directly. Payment. Payment can be made by Paypal cheque, bank transfer, debit card or credit card. Cancellation Policy. You may cancel your booking any time up to 6 weeks prior to the commencement of your vehicle hire. You will only forfeit the booking deposit of £55 per week of hire. If we have already taken payment from you for the balance, we will refund the balance payment within 7 days of you notifying us of the cancellation in writing. If you cancel your booking with 6 weeks or less to the commencement of your vehicle hire then you will be liable for 100% of the booking. If you have not already paid the balance of your booking fee, you agree that you will pay it to us. If you have authorised us to take payment from a card, we will take the balance payment from your card. All cancellations must be made in writing. Breakdown cover. We provide the vehicle with UK breakdown cover for the period of your hire. Breakdowns. In the unlikely event of a breakdown, the hirer seeks the help of the appropriate breakdown company quoting the registration number of the vehicle. You should not allow a breakdown team to perform any repairs without our PRIOR authorisation. We will reimburse you for the costs of such a pre-authorised repair against a valid value added tax receipt. You agree that any breakdown, malfunction or damage caused by your negligence will be made good at your expense. We cannot accept any responsibility for hotel or any other consequential expenses subsequent to a breakdown. We agree to refund the loss of any complete days of hire in which the vehicle was unusable providing the hirer has documentation to support this claim. Liabilities. You are responsible for all costs and expenses incurred as a result of offences against the Road Traffic Act 1988, for any negligent act or omission, including without limitation filling the vehicles’ tanks with the wrong liquids or allowing frost and ice damage to occur to the vehicle or for any act of vandalism by you or your guests in the vehicle from time to time and you are also liable for any uninsurable damages including tyres, windscreen, and any internal damages or breakages. You agree to indemnify and hold us harmless for any liability arising out of this. This means that you agree to be responsible for any costs (including legal costs) resulting from these offences and that you agree to pay us any amounts due as a result of this term. Motorhome Systems. Fuel. All of our vehicles run on diesel. We supply the vehicle with a full tank of fuel and you agree to return it with a full tank of fuel. If you do not return it with a full tank of fuel, we will charge you the cost of the refuelling the vehicle and a £20 administrative surcharge. We reserve the right to deduct this money from your security deposit or to charge it to your credit card without further reference to you. Gas. We supply you with 2 propane gas cylinders, one of which is full and one of which is partially used. If you require more propane gas cylinders, you should purchase this at your own expense. Smoking is not permitted in any part of the hired vehicle.
