Motorhome Rental Agreement Terms and Conditions By confirming your booking, you agree to these Terms which are legally binding, so please read them carefully and contact us if you have any queries. These terms relate to the Motorhome Rental Agreement between Mr. James Higham (Owner of Motorhome, Owner, we us, our) of 25 Newstead Road, Bournemouth, BH6 3HJ and the Hirer (you, your, the primary driver) relating to the private hire of the Burstner Viseo I676 - Registration number MX10 HZE (Motorhome, vehicle, van) and these definitions apply throughout this document. 1. BOOKING REQUIREMENTS DOCUMENTATION We need the following before the hire can begin and in order for your insurance to be validated:- 1. Motorhome Rental Agreement Form completed and signed by every driver in order for them to be covered. 2. Signed copy of these Terms and Conditions signed and dated by each driver. 3. Copy of the Driving Licence photocard for each driver who must also present their original licence with the driver present on the day. 4. DVLA Online Check for the Counterpart Licence: We will also need to do a DVLA online check for which we need you to send us your 'Check Code' within 21 days of the hire date (or it expires). You get this by going online to https://www.gov.uk/view-driving-licence and putting in your drivers licence number, National Insurance number and postcode on your licence. 5. 2 Forms of Proof of Address no older than 90 days for each driver – Utility Bill/Bank Statement/ Credit Card Statement or Council Tax Bill – (anything outside these examples may be acceptable but must first be referred to the insurer prior to hire for acceptability and may cause delays) 6. Motorhome Handover condition report completed at check-in prior to start of hire. The Return condition report will be completed at handover at the end of the hire. DRIVERS Drivers must be 30 – 70 years of age and have held a full UK driving license or its international equivalent for a minimum of 3 years. For legal reasons and for validating your insurance, any driving convictions, accidents, insurance refusal, endorsements, disabilities or medical conditions must be declared prior to booking on the Motorhome Rental Agreement Form. In certain circumstances insurance may be refused or a surcharge be payable. Only the drivers specifically named in the Motor Rental Agreement may drive the vehicle and each driver must have no more than 6 points on their licence or two 3 point offences and been involved in no more than 1 fault claim in the last 3 years. An Individual Conviction of 6 points or accumulative more than 6 and /or disqualifications will need referral to the insurer for confirmation prior to the hire commencing. We reserve the right to cancel the hire if, at the commencement of hire, the Drivers’ licences are invalid or not according to the required conditions or if insurance is declined for any reason. PASSENGERS For legal and insurance reasons, the motorhome must not carry more passengers than the belted seating capacity of the vehicle (i.e. 4 including the driver) and seatbelts must be worn at all times when the vehicle is in use. Including passengers and any luggage, the vehicle must not exceed its Gross Vehicle Weight of 3700 KG. 2. PAYMENTS & SECURITY DEPOSIT PAYMENTS If you have booked via an online booking agent then payments are handled entirely by their own system in accordance with their terms and conditions. Otherwise, please request our own separate payment terms. The Vehicle Hire Charge levied by the booking agent does not include: Insurance Surcharges (if applicable), Optional Extras (unless specifically mentioned as included), Refundable Security Deposit or surcharges in excess of the security deposit. Please see the list of possible surcharges at the end of this document. SECURITY DEPOSITS A security deposit of £1000 is taken by the booking agent on the collection date and released back to you within 14 days of the end of your rental period, provided that the vehicle and its internal fixtures and fittings have been returned on time in a clean, complete and undamaged state. You will be responsible to for the cost of making good any damage caused to the vehicle caused by improper use and for any fines (including parking fines) which may be incurred during the hire period. Damage to tyres, windows and windscreens are also not covered by insurance and the costs will be deducted from the deposit. MILEAGE Reasonable mileage is included within your booking, subject to a fair usage policy of 500 miles per rental week. When making a booking you should supply a hire mileage estimate which forms part of the Rental Agreement. Additional blocks of 250 miles can be purchased for £100 each as required. 3. COLLECTION & RETURN VEHICLE COLLECTION Please allow at least 1 hour for the handover of the vehicle and completion of necessary paperwork. We want you to enjoy your holiday to the full – time spent in familiarization with your new “home” will help to ensure that you get the maximum benefit from your hire. You will need to check the vehicle thoroughly before leaving and must acknowledge that the motorhome and it's contents are free from any defect or damage, fit for purpose and complete (other than as specified in the Handover Condition Report). The breakdown or malfunction of equipment after the Motorhome has been handed over will not be accepted as reason to abort or cancel the Rental Agreement, although we will endeavour to rectify any such fault as soon as possible (if possible). Your own vehicle can be parked responsibly near our house and this will be at your own risk. VEHICLE RETURN Upon return we will need up to an hour to check over the vehicle. We will complete the Return Report jointly with you. Please return the motorhome in a clean and tidy state, otherwise additional cleaning charges may apply. Please also return the vehicle to us by the agreed time on the final day of your rental period. Otherwise there may be an additional charge of up to 1 day’s (or night’s) rental plus the cost of any impact on a subsequent hire being affected. There are no refunds for the early return of the vehicle. 4. INSURANCE & BREAKDOWN COVER Fully comprehensive European-wide self-drive hire insurance and European-wide breakdown cover are included within the hire charge. For further details on both of these policies, please see the documentation which will be kept in the motorhome. The insurance principally covers damage to Third parties as well as fire, theft and damage to the vehicle and medical expenses in relation to the driver and any passengers and the excess for any claim is £500. In the event of a claim, you are responsible for the first £500 (i.e. the excess) plus any associated uninsured costs (not limited by the amount of the security deposit), plus, depending on circumstances, any resulting loss of subsequent rental revenue at the prevailing daily hire rate (up to max 5 days). The insurance cover excludes (amongst others) claims for loss or damage to personal possessions, and cancellation costs so you are advised to take out additional personal holiday / travel insurance for the duration of the hire period. For a more comprehensive list of all exclusions, please request details from us. You are responsible for the care and security of the vehicle, its contents and its keys for the duration of the Rental Period and agree to return the vehicle to the Owner in same condition received, ordinary wear and tear excepted, on the date specified. If the vehicle is left unattended, you must ensure it is parked in a safe, well-lit location and that all the doors, windows and hatches are locked and immobiliser activated via the key fob. Failure to do so may result in an insurance claim being refused and you may be liable for all associated costs. Whilst not an exhaustive list, the following should clarify some ‘What Happens If….’ questions relating to insurance and breakdown: A) VEHICLE BREAKS DOWN UK and European breakdown cover is included in the hire fee and includes homestart, roadside assistance and nationwide recovery. Full details can be found in the folder in the vehicle and we ask you to familiarise yourself with these. You may use this service if you are unable to use the vehicle because of a mechanical breakdown, accident, vandalism, fire, theft or break-in, flat tyre, flat battery, no fuel, misfuelling, missing or broken keys. In the event of a breakdown, call 0333 3339711 from UK or +44 1444 442044 from Europe and state you are an ALPS Road Rescue policy holder quoting the registration of the vehicle and policy number 313667. UK Recovery options (differing slightly from European) are generally either: 1. Taking you and the vehicle to your destination or home address then taking the vehicle for local repair; 2. Overnight B&B accommodation for one night; or 3. 24-hour UK hire vehicle. There are likely to be additional costs incurred so, for minor repairs which help you get back on the road and enjoying your holiday, you may instruct any repair up to the value of £100 without prior approval (keep receipts). Otherwise please contact us for approval. If a breakdown occurs due to a pre-existing fault with the vehicle, which causes significant disruption to your holiday or results in an early return home, we will refund you pro rata for each day of your holiday lost, however no further losses or costs will be compensated. Otherwise, a breakdown not linked to a pre-existing fault of the vehicle will be deemed as your responsibility and we are unfortunately unable to offer any refund or compensation whatsoever and any additional associated costs will be deducted from your security deposit. We therefore recommend you take out suitable travel insurance to cover these. B) ROAD TRAFFIC INCIDENT If you are involved in a road traffic incident you must first ensure your own and other road users’ safety then contact the relevant emergency services. Unless the police arrange for recovery, call the breakdown recovery firm ALPS Road Rescue on 0333 3339711 quoting the policy number and vehicle registration number as above. You should obtain the names and addresses of all involved, including witnesses. In the event of any incident that results in damage to the vehicle or the involvement of a Third Party, please report the incident details to us as soon as possible and in any event within 24 hours after the vehicle has been damaged. You are required to complete and deliver to us the relevant accident report (and any other relevant documentation) within 48 hours after the end of the rental period to include the names and addresses of all witnesses. No admission of liability is to be made to any person in relation to such accident. C) FIRE OR THEFT OF VEHICLE OR POSSESSIONS The vehicle is equipped with a smoke detector, fire blanket and fire-extinguisher and you must familiarise yourself with these before setting off. In the unlikely event of a fire, break in or theft of the vehicle, contact the police and us as soon as possible and send us the crime reference number. There is no cover in place for your personal possessions so we recommend you put in place your own travel / holiday insurance to cover these. D) PARKING OR ROAD TRAFFIC VIOLATIONS You are fully responsible for all parking, road-traffic or other legal violations which occur during the hire period and you agree to pay us any associated costs plus a minimum £25.00 administration fee, whether or not the security deposit has been refunded. E) WINDSCREEN & WINDOW DAMAGE In the event of any windscreen or window damage, please arrange, for a repair or replacement to be carried out by a reputable company as soon as possible (e.g. Highway Glassline - 0800 678 1010) so you can continue with your holiday and return all documentation to us on return. (See list of possible surcharges at the end) F) FUEL, GAS & TYRE PRESSURE ISSUES Fuel, oil, windscreen wipers and tyres (and any damage to them) should be checked before you take the vehicle and any defects noted on the Vehicle Condition Report. From the start of the hire, you are responsible for the care and maintenance of these during your hire and you are therefore advised to check and maintain the pressures, condition and levels. The vehicle is supplied with a full tank of diesel fuel and must be returned with a full tank of diesel fuel. The vehicle is also supplied with a enough LPG for the duration of your rental – you are not required to refill the LPG on return. G) FRESH WATER AND FUEL TANK CONTAMINATION You must take special care when adding water and refuelling since both inlets and caps look similar and are close to one another. A few drops of either fluid in the wrong tank can cause contamination, rendering the vehicle or the water system unusable. If you smell fuel in the water system you must inform us immediately and not use it at all. In the event of fuel tank contamination, call the breakdown recovery firm ALPS Road Rescue on 0333 3339711 quoting the policy number and vehicle registration number as above. You are fully responsible for any costs associated with such contamination so please be sure to check the water by smelling it before you leave at check-in. H) LOSS OR DAMAGE TO FIXTURES, FITTINGS OR INVENTORY An inventory is supplied with your hire and should be double checked before you leave. Any loss or damage to items as listed upon the inventory, or to fixtures and fittings within the vehicle will be charged at replacement cost on a like for like basis. If replacing them takes a considerable amount of time then a reasonable administration charge may also apply. (See list of possible surcharges at the end) 5. EXCLUSIONS The following is a list of things which we strictly do not allow during the hire of this vehicle and failure to comply will result in curtailment of your trip and surcharges (See list of possible surcharges at the end) PETS - No animals are allowed in the vehicle at any time SMOKING - Smoking is not allowed in this vehicle whatsoever. TOWING - The vehicle must not be used for towing unless you have prior written permission from us to do so. OTHER EXCLUSIONS - The Primary Driver and any other driver of the Motorhome must not: use the Motorhome for hire or reward; use the Motorhome for any illegal purpose; use the Motorhome for either racing, pacemaking, testing the Motorhome's reliability and speed and or teaching someone to drive; use the Motorhome whilst under the influence of alcohol and/or drugs; or drive the Motorhome outside England, Scotland and Wales, unless you have requested this in your booking. lend or hire the Motorhome to a third party. 6. TRAVEL OUTSIDE THE UK Travel outside the UK and within Europe (except Turkey) may be possible by prior written agreement. We must be informed of all countries intended to be visited at the time of booking. We will inform you of any additional requirements prior to the confirmation of booking. To comply with current EU traffic regulations, whilst travelling in Europe, you must carry the following items: Fluorescent/High Visibility Jacket Road Safety Triangle Spare Bulbs GB or EU sticker Head Light Angle Adjusters. Travel through France - Two Government Approved breathalyser test kits must be carried in the motor home – failure to carry this kit may result in prosecution by relevant authority. These items are not provided with the Vehicle but can be purchased from the outbound port/ferry terminal. 7. CANCELLATIONS We will make every effort to ensure that the vehicle is available for you at the correct time. If, due to circumstances beyond our control, this is not possible then our liability is limited to the sum of all monies paid by you. If you have booked through an online agent and need to cancel your booking at any point then the agent has specific arrangements for dealing with this. Otherwise, please request a copy of our own cancellation policy. We reserve the right to cancel a booking, decline hire to any person or terminate a hire at any time. If this is for our own reasons or for reasons outside of your control and unrelated to any breach or suspected breach of these terms, we will reimburse you up to the limit of any monies you have already paid. We reserve the right to cancel the hire if at the commencement of the hire the driver’s license(s) are invalid or not in accordance with the conditions set out in this document. In these circumstances the total hire charge will be forfeited. For any actual or suspected breach of these terms, your total hire charge will be forfeited and any related costs deducted from your security deposit. We shall not be liable for any failure to perform our obligations under the Agreement due to any event of Force Majeure. You are advised to insure against unavoidable cancellation, to protect yourself in the event of cancellation costs. POSSIBLE SURCHARGES The following surcharges may be charged to you after returning the motorhome. These charges will be deducted from your Security Deposit. In the event of the Security Deposit being insufficient due to other damages/insurance claims, you agree to pay us the balance via Paypal or direct bank transfer within 7 days. The actual cost to you can be a greater or lesser amount, based on the actual cost of repair.
