*Sweet Campers Terms and Conditions for Self Drive Vehicle Hire - OLIVE Definitions & Terms and Conditions The basis of hiring a vehicle from Sweet Campers is that you have read and understood and agree to the terms and conditions of this Agreement relating to the Vehicle and sign a rental agreement at the time of hire. Where you have completed the Owner's insurance proposal you declare that the information given is to the best of your knowledge and believe correct and complete in all respects and that no information has been withheld which might influence the acceptance of the proposal which with this declaration shall form the basis of the contract of insurance. You acknowledge that during the term of this Agreement and any extension thereof you will be liable as the driver of the vehicle and any other vehicle let hereunder in respect of any parking, road traffic or other offences or contraventions of any statutes, regulations or bye-laws from time to time in force committed in relation to the Vehicle. If any payments hereunder are to be made by credit, debit or charge card, your signature shall constitute an unconditional and irrevocable authority to debit your nominated credit, debit or charge card account with the total amount due. You will not admit liability for any accident and will obtain the names and addresses of witnesses. You will maintain all fluid levels and tyre pressures. When not inside the vehicle you undertake to have it locked and properly secure at all times. You will not use the Vehicle for hire and/or reward. There will be no other drivers other than those named and approved by the Owner in writing. You will return the Vehicle to 2, Dene Grove, Darlington before 11am on the day of return, unless another time is otherwise specified. We permit you to use the vehicle on the terms and conditions of this rental agreement only. Definitions 'The Vehicle' = The VW Camper Van This Agreement' = Sweet Campers Terms and Conditions 'Rental Agreement' = Document listing terms of rental which hirer must adhere to 'The Customer/Hirer' = The person or persons signing this agreement 'Security Deposit' = £500 which is equal to the insurance excess fee (AGED 25-75), £750 (AGED 23-24), £1,000 (AGED 21-22) 1) Booking and Payment Details Customers must send a completed booking form to Sweet Campers, a signed copy of these terms and conditions and a completed insurance form (using the online process or by forwarding a hard copy) together with a non refundable booking deposit of £50, payable by credit/debit card or by BACS or cleared cheque. The balance of the hire charge is due 140 days (approx 20 weeks) before the first day of hire. Before customers can depart with the Vehicle on their day of hire, they must review and sign the Rental Agreement on arrival. By signing the Rental Agreement customers accept the conditions set out in the document which include, but are not limited to, conditions with regards to 'Your Responsibilities', 'Conditions for Using the Vehicle', 'Charges', 'Insurance and Collision Damage Waiver Fee', 'Maintenance' and 'Collection and Delivery of the Vehicle'. Availability is on a request and confirm basis at the time of reservation. A reservation is only binding after Sweet Campers has confirmed it and a non-returnable deposit has been received. A booking deposit of £50 rental is payable at the time of making a reservation and will be deducted from the total hire charge. This deposit is non-refundable in the event of cancellation (please see our cancellation policy). A confirmation of booking will be posted or emailed to you together with an invoice in respect of the rest of the balance of the hire charge. This balance needs to be paid 140 days prior to commencement of hire. If booking within 20 weeks of the hire date, full payment is required at the time of booking. 2) Driver Age All drivers must be aged between 25 and 75. (AGED 21-24 AVAILABLE UPON REQUEST) 3) Collision Damage Waiver Fee A collision damage waiver fee (CDW) is optional and available for all vehicles at an extra cost of £250. This extra fee will eliminate the full £500 excess fee to be paid by you in the event of a collision. Neither the CDW or insurance applies to windscreens, windows, wheels, tyres, the underside of the vehicle, the roof or the interior of the van, towing charges, where the van is driven off road or on unsurfaced roads or without due care and attention, negligently, recklessly or where the driver is under the influence of alcohol or other drugs. Your liability to pay the cost of the damage will therefore not be waived in these cases and you may be liable for the full cost. 4) Fuel Policy All vehicles are supplied with a full tank of fuel at the start of the hire. Customers must return the vehicle with a full tank of fuel. Customers that return the vehicle with the fuel tank either empty or part full will be charged for the missing fuel at the end of the rental at the locally determined price, along with a fuel collection fee of £15. This can either be deducted from the Security Deposit or paid up-front. Also if you are on a “special deal” agreement such as Groupon, etc. there is a limited mileage of 100 miles per 24 hours. If you exceed your allowance you will be billed £0.50 per mile. 5) Payment Payment is preferred by BACS. All rental charges are to be paid in full by 140 days before the first day of hire. 6) Security Deposit On taking delivery of the Vehicle, customers must pay the refundable Security Deposit (£500 / £750 / £1000). This deposit is taken as security to cover the possibility of damage, whether negligent, wilful, accidental or otherwise, loss to the van or the fixtures and fittings therein or the living equipment and windows, wheels, tyres etc included with the van. The customer must irrevocably authorise Sweet Campers to deduct from the Security Deposit any amounts due by the customer to Sweet Campers arising out of this Agreement The security deposit will be refunded within 5 working days of the vehicle being returned on time, to the correct location, undamaged, with a clean interior, a full fuel tank and with all equipment in place and intact. We reserve the right to retain a £100.00 valeting fee if the Campervan is not returned with the interior in a clean condition. The remainder of this security deposit will be returned to the hirer once the damage/loss has been paid for. 7) Driving Licence and Identification Required Upon booking we will be required to validate your driving licence details with the DVLA for insurance purposes. On collection of the vehicle customers driving the vehicle must present their valid UK/EU Driving Licence Card in person and with proof of their current address. No copies of licences will be accepted. Proof of identification plus photo identity will need to be produced prior to commencement of hire with original drivers licence card, one other form of photographic ID; and two proofs of address in the form of a utility bill, bank statement or council tax bill (no older than two months) Note: the address on driving licence and those on proofs of identification must all match up, otherwise rental will be refused and your deposit will not be refunded. Drivers aged between 21 and 75 must have held a full driving licence for at least 2 years. Licence endorsements up to 6 points are accepted (two SP30's) Additional drivers must present a valid driving licence and be present. Insurance cover provided is Fully Comprehensive the excess on each vehicle is £500.00 / £750.00 / £1,000.00, the insurance company require your credit card details as security for the excess. They will only charge your card in the event of an accident. The hirer will also be fully liable for replacement or repair of windscreen or tyre damage. Our insurance policy protects us and any authorised driver against legal claims from any other person or death or personal injury or damage to any other person’s property caused by use of the vehicle on the road, on condition you report all such incidents to us during the hire period or on return of the vehicle (and use of the vehicle is within the terms and conditions and those of our insurance company). In the event than any third party suffers death, personal injury or damage to property caused by use of the vehicle which involves a breach by you or any authorised driver of any of the terms and conditions of this agreement and that of our insurance policy, you agree to reimburse us if we are obliged to compensate (a) the insurers for any payment they make to a third party on your behalf and/or (b) any third party. Drink Driver & Dangerous driver convictions. We are unable to insure any drivers with previous Drink driver or dangerous driver convictions. Personal Travel Insurance Insurance is only for the vehicle and equipment that belongs to the vehicle. It is the hirer’s responsibility to provide their own insurance to cover personal items and belongings and personal injury in the event of an accident. Driver(s) Driver must be between 21 to 75 years and in good health. Driver must have held a valid license for more than two years Details of additional drivers required. Production of valid standard driver's license required from all drivers at start of hire. Driver is personally liable for all legal penalties (eg: parking tickets, speeding etc), which are incurred during the period of hire. Any charges subsequently notified to us, will be immediately invoiced to the hirer and we will require payment within 14 days. If we are still holding your deposit at this time, we will deduct this sum from that deposit. By signing this agreement, you agree to accept this. Maximum of 3 drivers per rental vehicle (additional drivers will be charged at £5 per day) The vehicle must only be driven by the hirer or any other person who has first been authorised by us, for whom you have provided the insurance, driving licence and personal identification information. 8) Collection/Delivery and Return of the Vehicle The Vehicle will be supplied in a clean condition and in sound working order in accordance with the Departure Checklist. Customers must sign to acknowledge this. (The Rental Agreement will be produced for signature prior to departure). Customers must comply with the collection and delivery times as set out in the Rental Agreement. Collection: Please allow 1 hour for the hand-over at the depot - to complete the documentation (including vehicle condition check, occupants details), to demonstrate the vehicle to you and to transfer your luggage to the camper. Please allow the same on your return. Return: The vehicle must be returned on the date, and at or before the time stated on the rental agreement. Vehicles must be returned clean, and in the same condition as they leave the depot, allowing for fair wear and tear, otherwise a charge will be made. Late return: If you will be late returning, Sweet Campers must be advised immediately. Failure to advise may result in prosecution for driving whilst uninsured. An additional charge of £50 per hour will be payable for all late returns. 9) Rental Payment Terms When paying by credit card customers must agree to the following: Sweet Campers is authorised to complete any documentation and to take any other action to recover from the customer's credit card issuer all amounts due by the customer in accordance with this Agreement, including but not limited to, any amounts due in respect of damage to the Vehicle or to property of a third party and all other additional charges as they are incurred (including all parking and traffic infringement penalties and associated administration costs). Customers will not dispute their liability to Sweet Campers for any amount due under this agreement and shall indemnify and keep indemnified Sweet Campers against any loss incurred (including legal costs) by reason of notifying my credit card issuer of such dispute. In the event that Sweet Campers elects to accept payment of the Security Deposit by holding an open security payment which will be cancelled at the completion of the Rental Period, the customer must agree that Sweet Campers is entitled to recover payment from their credit card in respect of any amounts due which were not known at the time of cancelling the open security payment All transactions under this agreement are conducted in Pounds Sterling. Due to exchange rate fluctuations, there could be some variance between the amount initially debited against credit cards and the amount refunded within 7 days after the expiration of the rental period. The customer must release Sweet Campers from any liability for such variation. 10) Rental Payment Terms When the customer books by phone, in person or online they accept the conditions set out below: The vehicle will be available on time and on the day it was requested If the customer does not arrive to collect their reserved vehicle on the day and at the time it was reserved no refunds will be made. If the customer fails to pay the full cost of rental 140 days prior to hire then the booking will be cancelled (the initial booking deposit is non-refundable). By booking you are accepting these Terms and Conditions you consent to Sweet Campers applying charges to your credit or debit card account. You will not be required to make the excess deposit payment or pay for any possible additional rental costs until you collect your vehicle. 11) Terminating the Agreement The customer acknowledges that Sweet Campers may terminate this Agreement and repossess the Vehicle at any time, without notification to the customer, and that the customer will pay the reasonable costs of repossessing the Vehicle, including towing charges if: They are in breach of any term of this Agreement. They have obtained the Vehicle through fraud or misrepresentation. The Vehicle appears to be abandoned. The Vehicle is not returned on the agreed return date or Sweet Campers reasonably believes that the Vehicle will not be returned on the agreed return date. Sweet Campers considers, on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered. The customer understands that in the event of such termination or repossession, they have no right to a refund of any part of the rental charges or the Security Deposit. 12) Cancellation Charges The booking deposit of £50 is non-refundable. In the event of cancellation, booking deposits are not transferable to alternative hire dates. If appropriate identification and/or the necessary payment/deposit are not produced at the time the Vehicle is to be collected or the Terms and Conditions are not adhered to in any way then the rental cannot proceed and the cancellation policy will be enforced. Cancellations may be only be made by contacting Sweet Campers by phone or in writing. At Sweet Campers we want you to have your campervan of choice, however we must allow for unforeseen circumstances. We therefore reserve the right to provide you with a suitable alternative, without notice. Should a substitute not be available, our liability is limited to a full refund of monies received by Sweet Campers. We will not have any other liability to you. All rights are reserved to refuse any hire under any circumstance. No refunds are payable on accommodation, or vehicles not being available where a hirer changes, cancels or seeks to vary agreement after departure. The company takes no responsibility for any detention, delay, loss, damage or injury that a hirer might experience no matter how it is caused or by whom. You acknowledge that you will be responsible for any loss or damage to the vehicle, its documents, parts or accessories arising during the rental. If you cause damage to the vehicles engine through driving too fast, over too long a period of time, and ignoring the warning lights, you will be liable for any repairs required or even the cost of a replacement engine. If you cancel: 141 days prior to rental: you are entitled to a refund of 100% of total payment (less £50 booking deposit) 140 days – 63 days prior to rental: you are entitled to a refund of 50% of total payment (less £50 booking deposit) Within 62 days prior to rental: you are entitled to a refund of 25% of total payment (less £50 booking deposit) 13) Rental Period The customer will have the vehicle for the rental period shown in the Reservation Confirmation and on the final page of the Rental Agreement. If the vehicle is not returned on time, or if the customer does not contact Sweet Campers requesting an extension of the rental then the conditions of this agreement have been broken. Sweet Campers will charge the customer for every day or part-day that the vehicle has not been returned. Until Sweet Campers receive the vehicle the customer will be charged the daily rate specified on the rental agreement. Use of the vehicle The hirer agrees that during the rental period, he/she will not and will not allow the vehicle to be: Driven otherwise than in a cautious, prudent and normal manner; Used in a manner which could cause damage; Driven in a prohibited areas; Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law; Left with the ignition key in the vehicle while it is unoccupied; Driven by persons: Under the age of 25 years (21-24 WITH WRITTEN PERMISSION); or Who is not authorised by law to drive the Vehicle. Damaged by: Submersion in water Contact with Salt Water Used for any illegal purpose for any race, rally or contest; Used to tow any vehicle or trailer; Used to carry passengers or property for hire or reward; Used to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this agreement; Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material; Otherwise used in breach of my obligations under this Agreement. The hirer agrees that during the rental period, he/she will: Will be responsible for the cost of making good any damage caused to the vehicle by improper use; Understand that any damage to the interior of the vehicle or equipment will be charged to the hirer in all cases; Understand that Sweet Campers are not liable to you or any authorised driver or passenger for loss of or damage to property left in the vehicle either during or after the hire period unless such loss or damage results from our negligence or breach of this Rental Agreement. Such property is entirely at your own risk. Responsibility when accidents occur In the event of any accident, loss or damage arising out of the use of the vehicle, you will; Notify Sweet Campers within 24hrs of the happening of the event; Obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station; Not make any admission of liability to other parties, settlement offer or other like offer; Assist Sweet Campers in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence; You acknowledge that the excess or other amount due by you in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period; You will pay for any costs relating to the delivery of a change over vehicle as a result of an accident regardless of which party is at fault. You will need to return the damaged vehicle to the Sweet Campers depot, at your own cost, but preferably with RAC breakdown service; Sweet Campers will not refund the hire charge for any days you lose use of the vehicle due to an accident, theft or vandalism. We cannot accept liability for any costs arising from accident, theft or vandalism e.g., replacement vehicle costs, travel, accommodation or phone calls. Breakdown & Maintenance In the event of breakdown, recovery or repair services will be provided. Our van has full breakdown cover. If you incur any minor repair bills we will give you a refund of up to £50. Just produce your valid VAT receipt on the completion of your hire. Repairs costing in excess of £50 must first be authorised by Sweet Campers prior to the work being undertaken. A replacement van may be offered but this will be subject to availability. We cannot accept liability for any costs arising from accident, breakdown or any other cause. Sweet Campers liability extends to either replacing your van with a similar one or refunding your hire charge for any days you lose the total use of the vehicle. You will need to return to the depot, at your own cost, but preferably with the breakdown service returning your original campervan, to collect a replacement vehicle, if one is available. If you have broken down you must remain at a safe distance from the vehicle until the Recovery Vehicle arrives. You must not abandon the vehicle in any location, unless you have express permission to do so by Sweet Campers. If you wish to continue your journey with another form of transport, you must hand over the keys to the Recovery Vehicle Driver or Sweet Campers. Damage and Loss You will be liable to us for all losses and costs incurred by us in the event of loss, damage to or theft of the vehicle, its parts or accessories, while on rental if this damage, loss or theft involves deception of the hirer or another party, or as a result of the keys remaining in the vehicle whilst it is unoccupied, or was caused intentionally by you or your party. Your liability may include the cost of repairs, loss in value of the vehicle, loss of rental income, towing and storage charges and an administration charge, which recovers our costs for handling any claim arising from damage caused to the vehicle unless responsibility for the damage lies with us or has been determined by a third party or their insurers to lie with the third party. You will not be liable to us for any charge or excess if the loss or damage is directly due to our negligence or breach of this rental agreement. Termination of the agreement You acknowledge that Sweet Campers may terminate this Agreement and repossess the Vehicle at any time, without notification to you, and that you will pay the reasonable costs of repossessing the Vehicle, including towing charges if; You are in breach of any term of this Agreement; You have obtained the Vehicle through fraud or misrepresentation; The Vehicle appears to be abandoned; The Vehicle is not returned on the agreed return date or Sweet Campers reasonably believes that the Vehicle will not be returned on the agreed return date; Sweet Campers considers on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered. You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges or the Security Deposit. Miscellaneous Fuel - The tank will be supplied full with unleaded petrol on collection and must be returned with an equivalent amount of fuel. Pets – Pets are welcome with an additional charge of £20 per rental to cover the additional cleaning. Pets must be disclosed on our Booking Form. All damage, however caused by your animals, will be charged in full. Smoking - It is illegal to smoke in any of our vehicles. Your vehicle – We will store your vehicle for the duration of the hire. Sweet Campers cannot accept responsibility for the loss of, or damage to the vehicle or its contents however caused. Spare keys - In the event that keys are lost or damaged, YOU will be liable for the costs of obtaining a replacement or any costs incurred with Sweet Campers having to deliver a spare key to you. Range of hire – We ask that you remain in the North East/North Yorkshire/Cumbria area unless agreed in writing by Sweet Campers before the hire period commences. Gas & Batteries – Gas and Batteries are provided as part of the vehicle hire. If you need to purchase gas during your hire period, the cost will be refunded to you on your return on production of a receipt from the place of purchase. 14) Release and Indemnity of Sweet Campers Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, the customer must release Sweet Campers from any liability to the customer (regardless of who is at fault) for any loss or damage incurred by the customer by reason of this Agreement, including but not limited to: • Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for the customer's purpose. • Any loss or damage to any property left in or on the Vehicle or in Sweet Campers' premises or recovered or handled by Sweet Campers. Subject to any insurance arrangements agreed with Sweet Campers, I hereby indemnify and shall keep indemnified Sweet Campers, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle. 15) Rental Agreement The customer will be asked to sign a Rental Agreement upon collection of the vehicle and the terms of the Rental Agreement can be found in the box below. The Rental Agreement must be signed before a customer can depart so please review them prior to your departure. 16) Privacy Policy During the enquiry and reservation process Sweet Campers will collect personal information, including but limited to, your name, e-mail address, postal address and telephone number. This information is necessary for booking and for insurance purposes. We may use this information to notify you of any news you may interested in regarding Sweet Campers. None of your personal information will be passed on to any third party companies (other than the insurance company that Sweet Campers uses). No copies of licences will be accepted.
