1. DEFINITIONS In these Terms and Conditions: “Conditions” refers to these written Terms and Conditions “Hire Agreement” is this written documentation of your specific Hire Period details “Hire Schedule” means the list of stated facts and services contained in the booking form “Hire Period” means the period for which you have agreed to hire the Vehicle “Us, Our or We” means Your Name trading as ‘Your Business Name’ “Vehicle” means the vehicle that you have agreed to hire “You, Your or Yourself” means you, the primary hirer “Booking” means the entirety of the agreement entered into by Us and You “The Deposit” means the non-returnable funds paid by You to secure the Booking “The Balance” means the outstanding funds which make up the Hire Charge “Hire Charge” means the monies paid excluding the Deposit Bond “Damage Bond” means the returnable funds deposited with Us minus and incurred damages “Drivers Declaration” means the signed statement of fact about all Drivers “Drivers” means those people named on the Declaration insured to drive the Vehicle 2. YOUR HIRE CONTRACT We take full responsibility in providing You with the agreed service described in the signed Hire Schedule throughout the Hire Period including but not exclusive to: providing the booked Vehicle or a suitable substitute on time and in suitable condition including all legalities, serviceability and cleanliness; procuring or overseeing the required accident, theft, breakdown and public liability insurance; managing the ‘handover’ process including safety and damage inspections both before and after the Hire Period; checking and recording licences and identification paperwork on day of hire. Please read these Conditions carefully. By firstly signing and ultimately by taking the Vehicle you will be deemed to have read, understood and agreed to all these Conditions. No additions, alteration or substitution of these Conditions shall bind us unless they are expressly accepted in writing by Us or a person authorised by Us to sign on Our behalf. 3. BOOKING CONFIRMATION AND PAYMENT The Hire Charge is based on the price agreed upon and recorded in writing at the time of booking. An initial deposit payment of 20% of the total hire fee (The Deposit) is required to be received to confirm the booking. Even if a written or verbal booking is agreed, until such a payment is received, we reserve the right to accept the booking of an alternative hirer who has made a Deposit payment. This deposit is non-refundable. A binding contract for the hire will come into existence when we issue your booking confirmation. We are under no obligation to accept any booking. The Balance of the Hire Charge is payable four weeks prior to the start date of the Hire Period, or at the time of booking if you book less than four weeks from the start date of the Hire Period. 4. HIRE PERIOD Unless otherwise agreed with the Owner, the Vehicle will be available on the day of collection from the agreed location at the agreed time and must be delivered back to the agreed location at the agreed time on the last day of the Hire Period as stated in the ‘Hire Agreement’. 39 If you do not bring the Vehicle back on time you will be liable to be charged for every day or part day you have the Vehicle after you should have returned it at the daily rate of the Hire Charge plus 50%. Should the late return of the Vehicle make us liable for extra costs (e.g. compensation of the next hirer) we reserve the right to recover these costs from you. There are no refunds for Vehicles returned early. 5. YOUR CANCELLATION OF HIRE All cancellations must be notified in writing but please call us immediately to inform us as this will improve the chances of rehiring the Vehicle and refunding some of your costs. Cancel up to 14 days before check in date and get a full refund of the hire price. Cancel within 14 days of your check in date and 50% of the hire price will be refunded. If you arrive and decide to finish your rental early, there is no refund. At the Owners discretion, if the dates can successfully be re-booked there may be a limited refund. 6. OUR RIGHTS OF CANCELLATION We reserve the right to cancel the hire if, at the commencement of the Hire Period: a) The driver(s) licence(s) are invalid b) You are unable to provide the required identification documentation (referred to in Condition 10) . In these circumstances the total Hire Charge will be forfeited. We also reserve the right to cancel the Hire if: c) You fail to pay the Balance at least four weeks prior to the commencement of the Hire Period or at the time of booking if your booking is less than 4 weeks from the commencement of the Hire Period or if you fail to provide any details that we request that you provide (referred to in Condition 10). In these circumstances you will forfeit the Deposit and we reserve the right to retain or require payment of an appropriate proportion of the Balance as compensation for loss of revenue. d) The Damage Bond is not received e) We have the right to cancel the hire and refuse to hand over the Vehicle to any person who, in our reasonable opinion not suitable to take charge or any driver is/are not competent or responsible for the safety of all passengers and road users and the safe return of the Vehicle. In such cases, the Hire Charge paid will be refunded in full save for where it is reasonable for Us to cancel the hire in which case you will forfeit the Deposit and we reserve the right to retain or require payment of a proportion of the Balance as compensation for loss of revenue. Should the hire be cancelled under any of the above Conditions, we have no further liability. You are strongly advised to insure against unavoidable cancellation. 7. AVAILABILITY Occasionally the Vehicle may not be available as agreed through unforeseeable circumstances. If your booking has to be cancelled because the vehicle that you booked is no longer available, we will endeavour to source and offer you the choice of an alternative vehicle. This may be of similar size to the vehicle booked or larger, and will be similarly equipped. In this event, you will not be liable for higher rental charges. If a smaller vehicle is offered and accepted, the difference in charges will be refunded. If a larger vehicle is offered, we are not liable for additional expenses e.g. higher ferry charges, fuel costs and road tolls Apart from as mentioned in this condition no liability will be accepted for any expenditure (including increased travel expenses to the vehicle) should you agree to the hire of the alternative vehicle. 8. THE HIRE INSURANCE The Vehicle is fully insured for the period of the hire ONLY and a copy of the insurance policy is available on 40 request. By signing the Hire Agreement, you are accepting the conditions of the appropriate hire insurance policy that is in place. Fully Comprehensive insurance is normally included within the Hire Charge and any alternative arrangement will be agreed in writing. A late return of the Vehicle would in effect, incur a traffic offence under the road traffic act. You are strongly advised to take out additional personal holiday insurance. 9. DAMAGE BOND You will be required to pay a ‘Damage Bond’ prior to the commencement of the Hire Period. This sum is subject to conditions and will be agreed at the time of booking. This Bond is taken to safeguard the vehicle and will be returned within 7 working days of the vehicle’s return undamaged. At the point of hire you will be required to fill in and sign a ‘handover sheet’ which gives a comprehensive description of vehicle condition at time of collection. On return the vehicle will again be inspected by You and Us and any damage or losses will be noted and reasonable costs will be deducted from the Damage Bond. Costs will also be taken to pay or part-pay for any loss or damage suffered as a result of your breach of these Conditions (in particular you are referred to Condition 20) or to cover the insurance excess on the insurance policy should it be necessary to claim on the insurance policy. You agree that any such costs will be released to us. Any damage or breakages will be immediately reported and in the event of damage costs estimated to add up to equal the deposit bond payment, we reserve the right to terminate the Hire Agreement immediately. The above is in respect of each separate incident of accidental damage. Assuming there is no damage or other deductions the bond shall be held by Us for no more than a period of 7 days following the return of the vehicle. The 7 days does not include any time taken by the issuing bank to return the fee into the hirers account. 10. DRIVERS. All Drivers must meet the standards as laid out in the Drivers Declaration. In certain circumstances at the Owners and Insurance underwriter’s discretion, these standards can be relaxed. The licence must be unendorsed (except for allowable speeding and parking offences) although at the same discretion the hire may be able to commence even if the licence is otherwise endorsed. The licence must be produced at the time of collecting the Vehicle. Visitors from abroad must hold a current international driving permit or licence. You must provide Us with all necessary details of all the driver(s) so that we can deal with the insurance requirements of the Vehicle during the Hire Period. Two forms of proof of identity along with photographic identification (either a passport or photographic driving licence) must be produced by you at the start of the Hire Period i.e.: your most recent Utility bills, Bank statements or Credit Card statements. Mobile phone bills are not acceptable. Should you fail to provide the necessary information or produce the correct documentation in accordance with this Condition 10 the booking may be cancelled under Condition 6. There will be an additional charge to the standard Hire Charge should the licence be foreign or endorsed. This additional charge will be advised to you at the time of booking. Unless made aware otherwise, all drivers will be assumed to be of a level of competence suitable to drive a larger vehicle safely without undue risk of damage. It is your responsibility to make Us aware of any concerns before you leave. If We have good reason to believe the safety of Our vehicle, its occupants or the general public are compromised we reserve the right to cancel the Hire Period (see 6). YOUR RESPONSIBILITIES 11. USING THE VEHICLE a. The Vehicle must only be driven by drivers covered by insurance and written on the Driver Declaration section of the Hire Agreement. You and/or any other authorised driver will: b. Not use the Vehicle for hire or reward; c. Not use the Vehicle for any illegal purpose; d. Not use the Vehicle for racing, pace making, testing the Vehicle’s reliability and speed or teaching someone to drive; e. Not use the Vehicle while under the influence of alcohol or drugs; f. Not drive the Vehicle outside England, Scotland and Wales, unless another EU country(s) are agreed to in the Hire Agreement; g. Not overload the Vehicle; h. Not if the Vehicle is a commercial vehicle, use it for a purpose for which you need an operator’s licence if you do not have one. i. Not carry more passengers than the belted seating capacity of the Vehicle or allow the Vehicle to be overloaded. j. All drivers must be aware of the (unusual) height of the motorhome and are responsible for ALL damage if driven under an obstruction that is too low for the vehicle to clear. The obvious examples are low bridges, trees, height barriers into car parks etc. In this event neither the basic vehicle insurance nor the CDW (if applicable) will apply and the hirer will be responsible for the repair of all damages. Overhead damage is deemed as any damage to any part of the vehicle which occurs above 6 feet (1.83 metres) and or any third party property. k. Be responsible for all fines and costs (including court costs) for parking, traffic or other offences, congestion/emission charges (including any costs which arise if the Vehicle is clamped) and you will pay the appropriate authority any fines and costs if and when the authority demands this payment. VEHICLE COLLECTION Collection timings will be agreed during the booking process (normally between 14.30 and 15.30). To make the most of your Hire period, there needs to be a detailed handover, which includes the hot water system, central heating, electrics, toilet facilities etc. It is your responsibility to not depart until your 100% certain that you are competent to drive and operate the vehicle properly without the risk of damage. VEHICLE RETURN Please bear in mind that once you finish your hire, there will probably be someone else due to collect on the same day, so it is important that vehicles are returned before the agreed time. This gives sufficient time to prepare for next hirer. You must ensure that the vehicle is returned exactly as you picked it up: clean and tidy with a full tank of fuel (see deposit bond deductions). Failure to return your hired vehicle at the agreed time could result in charges of £25 per hour overdue, which may be taken from Your Damage Bond, however, early returns do not qualify for a refund. 12. CARING FOR THE VEHICLE a. You must return the vehicle in the exact same condition in which you picked it up b. You must look after the Vehicle and the keys to the Vehicle. You must always lock the Vehicle when you are not using it, and use or activate any security device fitted to or supplied with the Vehicle. You must always protect the Vehicle against bad weather which can cause damage. You must make sure that you use the correct fuel. c. You must not sell, rent or dispose of the Vehicle or any of its parts. You must not give anyone any legal rights over the Vehicle. d. You must not let anyone work on the Vehicle without Our permission. If We do give you permission, you will only receive a refund if you have a receipt for the work. e. You must let Us know as soon as you become aware of a fault in the Vehicle. f. You must ensure that the Vehicle is kept in good condition and repair g. You must bring the Vehicle back to the place agreed, at the time agreed and remain responsible for the Vehicle until this time. We must see the Vehicle to check that it is in good condition. 42 h. Before you bring back the Vehicle you must check that you have notleft any personal belongings in the Vehicle. i. You must not tamper with the mechanics of the Vehicle at any time. j. You must carry out all appropriate mechanical inspections and maintenance as communicated to You by the Us. 13. PETS All animals other than guide dogs have special terms and conditions and must be approved by us at the time of booking. If approved, you will have accepted all the extra T&C’s and understand that all damage however caused by the animals will be charged to you in full. 14. SMOKING Smoking is strictly prohibited in all Vehicles and in the event the vehicle is returned with evidence of smoking, You will incur an automatic £250 charge for deep cleaning and sanitising. 15. BED LINEN AND TOWELS Bed linen, pillows and towels are provided with the Vehicle as standard. If on return these are stained and require specialist cleaning, a surcharge will be incurred. 16. GAS Enough bottled gas is included in the Hire Charge which should last the Hire Period. Should you need to replace an empty bottle during the course of your hire, this is your cost and responsibility. 17. WHAT TO DO IF YOU BREAK DOWN If you do breakdown you should: Contact the breakdown service that covers the Vehicle. Inform Us immediately. In the unlikely event of a breakdown, you should seek the help of the appropriate breakdown company quoting the registration number of the Vehicle. You are only authorised to request repairs up to a value of £50, repairs costing in excess of £50 must first be authorised by the Us PRIOR to the work being undertaken. 18. IF YOU HAVE A COLLISION If you have an RTC (Road traffic Collision) you must not admit responsibility. You should get the names and addresses of everyone involved, including witnesses. You should also: a. Ensure the safety of You and all other road users b. Make the Vehicle secure. c. Tell the police straight away if anyone is injured or there is a disagreement over who is responsible; d. Contact Us immediately. You must produce an accident report. LIABILITY ANDLIMITATION 19.WINDSCREENS & TYRES You are responsible for any damage to windscreens and windows, punctures or other damage to tyres during the hire. Where possible it should be repaired or replaced as appropriate and paid for by you at the time but you should contact Us to seek instructions before carrying out the repair. 20. YOUR LIABILITY Where damage is caused to the Vehicle during the hire We may, at Our absolute discretion, utilise the insurance policy to claim for the loss or damage sustained. In these instances you will be liable for the excess. If We claim under the insurance policy this will not reduce your liability under any other provision of this Condition 20. We will not claim under the insurance policy where damage to the Vehicle is caused by a breach of any of these Conditions. 43 You agree that you will be liable for any damage sustained to the Vehicle during the hire where such loss or damage is not claimed under the insurance policy. You also agree that you will be liable for any loss or damage suffered by Us resulting from you breaching these Conditions Without limiting the generality of the above this includes the following charges: a. Reasonable administration charges for resolving damage to the Vehicle. b. Charges for any loss or damage to the Vehicle (even if it is accidental or not your fault) subject to the cover provided by the hire insurance. c. Charges for damages to windscreen and windows, punctures, or other damages to tyres d. A standard £75 valeting fee if the Vehicle is not returned in the condition it was collected in with regards to interior cleanliness or if you do not comply with Condition 14. e. The cost of making good any damage to the interior of the Vehicle (including cigarette burns) living or cooking equipment if not remediable under 16.c f. The cost of making good any damage caused to the Vehicle caused by improper use. g. A standard £50 fee for un-emptied toilet cassettes at the end of the hire. h. A refuelling service charge if you have used, and not replaced, more fuel than was provided at the start of the hire. The charge is based on the cost of the fuel plus £20. i. Any costs and reasonable administration charges which arise when the Owner deals with your failure to pay charges that you are responsible for under Condition 11(k). j. Any charges arising from Customs and Excise or Immigration Authorities seizing the Vehicle, together with a loss-of-income charge while We cannot rent out the Vehicle. j. Any published or agreed rates for delivering and collecting the Vehicle k. Interest which will be added every day to any amount you do not pay on time, at the rate of 4% a year above the base lending rate of Bank of England. Value added tax and all other taxes on any of the charges listed above, as appropriate. You are responsible for all charges, even if you have asked someone else to be responsible for them. We will utilise the damage bond referred to in Condition 9 to meet any amounts for which you are liable under this Condition 20. Should the damage bond be insufficient to cover all of your liability, you agree to pay the additional amounts for which you are liable within 28 days of Our demand. 21. EVENTS BEYOND THE OWNER’S CONTROL Unfortunately, events beyond Our control occasionally affect bookings. When reference is made to such events in these Conditions this means any event(s) or circumstance(s) which We could not, even with all due care, foresee or avoid. We cannot accept responsibility or pay any compensation, costs or expenses where the performance of your contract is prevented or affected or you otherwise suffer any loss or damage as a result of events beyond Our control. This includes any delays to and/or restrictions to the hire to which you may be subject. However, if your booking has to be cancelled as a result, We, will endeavour to offer you an alternative motorhome (if available) or refund You as described in Condition 6. Our liability will be limited to the return of any monies paid by you. 22. PERSONAL BELONGINGS We will not be responsible for any claims in respect of any loss or damage to personal belongings or effects of you or any other person or persons. 23. BREAKDOWN AND ACCIDENT We will not be responsible for hotel costs, losses or any other expenses subsequent to a breakdown. You are strongly advised to take out personal travel insurance to cover against termination of the hire due to the unlikely event of a breakdown. No responsibility can be accepted by Us for any loss or damage or expense which occurs as a result of any accident. 44 24. PARKING Any vehicle that you park at Our premises is parked solely and absolutely at your own risk. 25. GENERAL LIMITATION We will not be liable to you for any loss of profit or for any special, consequential or indirect damage or loss suffered. Nothing in this clause or in these Conditions shall be construed to operate so as to exclude or limit any liability for death or personal injury caused by our negligence or of our servants, employees or agents or to exclude or limit any liability in respect of fraud or fraudulent misrepresentation. TERMINATION 26. ENDING THE AGREEMENT Notwithstanding anything stated elsewhere in these Conditions .We will be entitled to end this agreement straight away if: a. We find out that your belongings have been taken away from you to pay off your debts, b. Being an individual you become subject to a bankruptcy order c. Being a company, you go into liquidation d. You make a proposal to enter into any voluntary arrangement e. You are in breach of any of these Conditions If We end the agreement it will not affect our right to receive any money we are owed under these Conditions. 27. INFORMATION If you are in breach of any of these Conditions we can give the information you have provided to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. We will also disclose any information we are required to by law. GENERAL 28. COMPLAINTS Any complaints should be received in writing within 7 days of the Vehicle being returned from the Hire Period. 29. NOTICES Any notice required to be given under these Conditions should be sent by prepaid first class post or facsimile or e-mail to that party’s registered office or to its last known address. 30. SEVERABILITY If any provision of these Conditions is held to be void, illegal or unenforceable under any enactment or rule of law such term or provision shall to that extent be deemed to not form part of these Conditions but all other provisions of these Conditions shall remain in full force and effect. 31. GOVERNING LAW This agreement is governed by the laws of England and Wales. You agree that any dispute will be settled in the courts of England and Wales. By signing below You accept responsibility for all the above Conditions, and agree to any fair deductions from the damage deposit bond that We feel fair. HIRER DRIVE ENDORSEMENT This insurance covers the Insured Vehicle whilst let out on hire, subject to the following conditions: - . 1)  The Insured shall verify the identity and permanent address of the Hirer and any other permitted driver by means other than relying solely on the information contained in the Hirer’s or driver’s driving licence and that such person is not amongst the excluded persons enumerated below. ? . 2)  Two forms of ID shall be obtained i.e. Utility Bill (no more than 60 days old) and Driving Licence. ? . 3)  The Insured Vehicle shall not be let out on hire to or be driven by: - . a)  Hirers under 21 or over 79 years of age unless otherwise agreed by the Insurer ? . b)  Hirers under 21 or over 79 years of age if vehicle is a Minibus, MPV (8 seats including driver) or 7.5 ton GVW ?or above. ? . c)  Hirers aged 21 to 22 unless a full valid United Kingdom or EU driving licence has been held for 2 years and ?prior authority has been given by insurers. ? . d)  Hirers who have not held a full valid United Kingdom or EU driving licence for 2 years. ? . e)  Persons who have been convicted of an offence in connection with the driving of a motor vehicle or ?motorcycle and/or have had their driving licence endorsed or suspended or more than 6 penalty points ?imposed. “Spent” convictions, covered by the Rehabilitation of Offenders Act 1974 may be disregarded. ? . f)  Persons who have had their insurance declined and/or renewal refused and/or special insurance terms ?imposed as a result of claims experience and/or have had their insurance or cover cancelled by any Motor ?Insurer . ? . g)  Persons engaged wholly or partly in professional entertainment or professional sports persons. ? . h)  Jockeys and persons connected with racing, gaming industry or press of any sort. ? . i)  Undergraduates and/or students under 25 years of age. ? . j)  Persons who, whilst driving, have been involved in more than one accident during the past 3 years. ? . k)  Foreign Service Personnel other than persons holding a full UK/EU licence for two years or more. ? . 4)  The insured vehicle(s) shall be driven only by the Hirer or other permitted driver who has completed and signed a hirer drive proposal (by each hirer or other permitted driver). Such proposal shall be forwarded on request to the Insurers. The proposal must be fully completed by the Hirer or other permitted driver in all respects. In addition to the usual declaration and warranty contained in the proposal, the following declaration shall appear on the proposal, namely: - “I further agree to be bound by the terms and conditions of the Insurance which I have seen and read or have had the opportunity to see and read”. If the statements and particulars in the proposal are in the handwriting of any person other than the Hirer or other permitted driver, such person shall be deemed to have been the Hirer’s or other permitted driver’s agent for the purpose of completing the proposal form. ? . 5)  The Insured shall be considered as the being the agent for the Hirer or other permitted driver for all purposes in connection with this insurance but under no circumstances shall the Insured be considered as agent for the Insurers. ? . 6)  The Insured vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire and reward. ? . 7)  Any vehicle which is added to the Motor Insurance Database will be charged the appropriate premium. ? Subject otherwise to the terms, exceptions and conditions of this insurance
