Omnihire.co.uk - Omni Hire Terms and Conditions DEFINITION OF TERMS AND CONDITIONS In the event of any discrepancy between these Terms and Conditions and any other of our literature, the provisions of these Terms and Conditions apply. ‘DRIVER / HIRER’ means the person(s) nominated as the driver(s) under the RENTAL AGREEMENT. ‘Motorhome’ means the vehicle under hire as described under the heading ‘Vehicle Details’ under the ‘Rental Agreement’ and includes tyres, tools, accessories, living equipment and any other special equipment, documents relating to the vehicle and any replacement or substitute vehicle provided by us. ‘RENTAL AGREEMENT’ means the document read and signed by the hirer on collection and return of the vehicle. It includes details of ‘Customer’, ‘Vehicle Details’, VCR (Vehicle Check Report) ‘Rental Period’ and ‘Departure Checklist’. The Driver/Hirer accepts that signing the Rental Agreement that they have read and fully understand and agree to all of Omni Hire’s Terms and Conditions. 1. RESERVATIONS: • A reservation is only binding after Omni Hire has confirmed it and 50% payment for the week of hire has been received, including any additional extras. This will be via our secure BACS payment following the booking procedure through omnihire.co.uk. Our terms and conditions including cancellation policy apply from this point onwards. Once the reservation is confirmed, a confirmation email will be sent out to the Hirer including an invoice detailing dates for balance payments and reservation dates. • Payment of balance of invoice must be paid no later than 8 weeks prior hire. Failure may result in cancellation and or cancellation fees applying in accordance with 9b in our terms and conditions. • There is a surcharge of 1.8% if a business and or International credit card is used for payment of security deposit. • Short-term reservations made after 6 weeks prior to hire will have to be paid in full at the time of booking. • All prices quoted and charged in £ (GBP). • Security deposit payment is only accepted by credit card (Visa or MasterCard) or debit card (Visa Debit or Maestro). Please note, we do not accept American Express. • Vehicles will not be released without full payment being received. • Vehicles will not be released without 2 forms of valid photo identification and funds for deposits being available on collection. The vehicle will not be released until security deposit is paid and all the required documentation has been agreed as set out in 4b. Hirer Documents. • One security deposit payment (standard excess) is payable by credit or debit card only on collection. This covers insurance excess, security deposit and cleaning deposit. 2. HIRE PERIOD: • ‘Hire Period’ refers to the dates agreed in the Rental Agreement. • Rental is charged on a per night basis. (9am -12pm) • Rental up to 6 nights ‘Short Break’ charged at premium rate during high seasons. • Delivery by us or collection by the hirer is strictly between 09.00am - 12.00pm and collection/return is strictly before 12.00pm, charges apply for late returns. • Out of hours collection and return service available by agreement, please email us directly at [email protected] before making your booking or for more information and pricing for out of hours collections or returns • Collection or return times which fall outside the dates and times given must be agreed with us in advance at time of booking. Day early collections will be charged accordingly. • Please note: If the hire ends on a Sunday or a bank holiday, the next available drop off time will be first thing the following morning as we are closed on Sundays, this extra day is priced within the original quote. • As we carefully plan the times for collections and returns, please return the Motorhome on time. A penalty of £25.00 per hour is payable for returning the vehicle late. • Should the late return of the vehicle make us liable for extra costs (e.g. compensation of the next Hirer), we reserve the right to pass on these costs to you, deducted from your deposit. Often the Motorhome is going out shortly after it returns, therefore lateness could affect the next customers holiday. • NO REFUND IS GIVEN FOR THE EARLY RETURN OF A VEHICLE. 3. HIRE RATES INCLUDE: • Limited Mileage of 750 miles (0.75 pence per mile charged thereafter) • Full Breakdown & Roadside Assistance** * Excluding any insurance loading, extra charges may be incurred if the driver to be insured has a traffic conviction, holds a driving licence from a non-EU country or is in an occupation which is deemed high risk. These charges will be passed onto the customer. ** Omni Hire will supply full breakdown/roadside assistance cover to deal with any mechanical faults to the base chassis of the vehicle. Any call out charges necessitated by the Hirer through operator error, e.g. a flat vehicle battery etc. will be the responsibility of the Hirer. 4a HIRER / DRIVER AGE LIMITS: • Driver(s) must be aged over 25 years to 74 years for rental of our Motorhomes. • Driver(s) aged 70 to 74 years, see additional insurance charge in section 5a. 4b HIRER DOCUMENTS / DRIVER(S) LICENCE REQUIREMENTS: • Driver(s) must hold a valid full driving licence for at least 24 months. • Driver(s) have not had their license suspended for any period within the last three years. • Driver(s) have not been involved in more than one fault incident within the last three years. • Driver(s) have no more than two convictions with a maximum of 3 points per conviction. • Driver(s) have not obtained a BA,DD or UT conviction • All drivers must be present for collection of the Motorhome. No exceptions can be made. • Driver(s) must provide two separate forms of photographic identification on collection of vehicle otherwise hire will be invalidated i.e.: valid passport and driving licence. • If you have a GB driving licence, we require you to log in to the DVLA website to obtain a check code to enable to check the counterpart of your driving licence. This will only be valid for 21 days. We are unable to insure you if we are not able to check your driving licence details. We will need to paper copy for our records. • If you have a Northern Ireland driving licence, we require both the photo card and the paper counterpart. • You must declare at the time of booking if there are any endorsements on your driving licence. Omni Hire may not be able to provide cover for some endorsements. Charges apply for penalty points, failure to declare an accident or driving conviction invalidates insurance. • Drivers holding only an automatic driving licence are not permitted to drive any of our Motorhomes. • Proof of address is required in the form of 2 utility bills or Bank/Credit Card Statement. No copies accepted. Has to be original and dated within three months of the hire. • Should any driver fail to present all of the correct documentation and identification on collection of the vehicle or the documentation does not meet the driver requirements set out in the terms and conditions, then Omni Hire will be unable to release the vehicle. No refunds will be given. Identification Required when Collecting the Vehicle 1. a. Valid UK Driving Licence – plastic card & Share my Driving Licence Code (*see below) b. Non-UK Licence Holders – International Driving Licence or International Driving Permit 2. Credit or Debit Card 3. Two of the following: Passport / Bank Statement or Utility Bill within last 3 months / Return Flight Confirmation 4. The above also applies to additional drivers. *You will need to bring your driving license, and 2 recent documents with your address on. Since the abolition of the paper part of your driving licence, you now need to generate a one-time passcode that you will need to give to us either before or at the point of handover to allow us to check your driving licence (The code only last 72hrs, so we advise to do it 24hrs before you are due to collect the Motorhome. The web link to the share driving licence service is https://www.gov.uk/view-driving-licence. It is important to note that you will need your national insurance number to use the service. It is mandatory for us to complete this check and will be unable to release the Motorhome to you if you have not generated the code for us to check. 5. INSURANCE: We provide fully comprehensive insurance through our insurers to the driver(s) named on the rental agreement. • Comprehensive (COMP) covers damage to your insured vehicle by accident, fire, theft & vandalism. • *The policy provides cover for any injury & damage you cause to other people and/or their property. • The vehicle is insured for damage to the vehicle and the property of a third party but does not include any personal insurance for the customer including death or bodily injury to the driver nor does it cover any personal possessions. *Certain exceptions and limited liability will apply under certain conditions. **It is important that all Hirers should arrange additional personal travel insurance suitable to their particular requirements. Only persons named on the Rental Agreement are insured to drive the vehicle. 5a. ADDITIONAL INSURANCE CHARGES: • Insurance for an additional driver is charged additionally per hire. Only one additional driver is permitted. The same driving licence and hirer requirements, as set out in 4b for additional driver will apply. • There is a minimum Excess of £500 on any claims that are made. • Additional insurance charges may apply if the Hirer/Driver has an occupation that is deemed to be high risk. • Additional insurance charges may apply if the hirer holds a non-EU driving licence. The security deposit is fully refundable within 28 days of return of the vehicle provided there are no outstanding insurance claims or the following conditions: • This security deposit will be used to fund any loss or damage what so ever to equipment, fixtures, fittings, windows, cleaning fees, tyres or negligent damage to the vehicle. • The security deposit will be used to fund any road traffic violation administration fees. • The security deposit will be used to fund any cleaning fees. A nominated valeting fee of up to £75 will be charged against the deposit if the vehicle is not returned with the interior in a clean condition. An additional fee of £75 will be charged against the deposit if the toilet and waste tank are not emptied and cleaned prior to the return of the vehicle. An additional fee of £75 will be charged if it is found that smoking has been permitted in the vehicle. An additional £75 will be charged if an unauthorised pet has been carried in the vehicle. • The security deposit will be used to fund any refuelling costs arising from not returning the vehicle with a full tank of fuel. A £25 administration fee will be applied in addition to any costs for refuelling. • The hirer agrees to pay Omni Hire any additional costs over and above the security deposit value should damages exceed the security deposit value within 28 days of your hire. In the event of an insurance claim, regardless of fault, the security deposit will be retained until the insurers have settled the claim. Please note this can be a lengthy process and is out of Omni Hires control. The hirer irrevocably authorises Omni Hire to deduct from the security deposit any amounts due to Omni Hires arising out of this agreement. 5b. EXCLUSIONS: The following are not covered by insurance, therefore the hirer accepts full liability for these, which is in addition to the standard vehicle excess/security deposit should that apply. • Mechanical problems e.g. clutch/gearbox due to driver negligence. • Any damage caused by a negligent act. • Replacement or repair of aerials, glass, wheels or incorrect fuelling. • Missing wheel trims, tools or spares. • Damage to the underside of the vehicle or the roof, which includes the overhead “Luton” area, is not covered under any insurance and any damage to these areas is deemed as gross negligence. Any such damage will be charged at a fixed cost of £3000 plus the full insurance excess on your vehicle. • The theft of a Omni Hire Motorhome will not be covered by insurance if the keys are left in the ignition or in or on the vehicle whilst unoccupied and the hirer shall be held fully responsible for a replacement vehicle. • Windscreen mirrors and/or tyre damage is not covered by the standard vehicle insurance or excess reduction options but can be covered under the special cover package. *No other hire insurance is acceptable for the rental of our Motorhome other than the one we provide. 6. SECURITY DEPOSIT: The security deposit on your Motorhome hire covers both the insurance excess in the event of a collision and the proper return of the vehicle in same condition as it was let out to the hirer. The hirer must pay the refundable security deposit by credit or debit card at the time of collection or earlier if agreed. No other form of payment is accepted. The card should be in the lead driver’s name and the amount will be debited from your account immediately. Pre-paid currency cards cannot be accepted. Omni Hire reserves the right to increase the insurance excess. o A refundable security/excess deposit of £750 is payable for the rental of our Auto sleeper – Stanway, Warwick Duo, VW Campervan and Swift Escape Motorhome. This amount will be debited from your credit card account immediately and is fully refundable within return of the vehicle provided there are no outstanding insurance claims on the following conditions: • This security/excess deposit will be used to fund the full replacement costs of any loss or damage whatsoever to hired accessories, equipment, fixtures, fittings, windows including any installation charges where necessary, cleaning fees, tyres or negligent damage to the vehicle, The damages will be assessed and a cost will be evaluated on the extent of damage. • The security/excess deposit covers the cost for replacement or repair of aerials, glass, wheels, roof, underside of vehicle, windscreen, wing mirror, tyre damage or incorrect refuelling (e.g. putting petrol into diesel tank) for which the hirer is responsible. • The security/excess deposit will be used to fund any cleaning fees, the damage administration fee, road traffic violation administration fees. Including tolls and congestion charges. • The hirer agrees to pay any additional costs over and above the security deposit value should damages exceed the security deposit value within 28 days of your hire. The hirer irrevocably authorises us to deduct from the security/excess deposit any amounts due to Omni Hire arising out of this agreement. • A £45 administration fee will be applied against any loss or damage to our vehicle or any item contained within. *Security deposit refunds could take longer dependant upon banking clearing and crediting systems which is outside of Omni Hire’s control *Omni Hire reserves the right to increase the security deposit for specific events e.g.: festivals, events or rallies. *A cleaning fee of £75 will be charged against the deposit if the vehicle is not returned with the interior in a clean and satisfactory condition. *An additional fee of £75 will be charged against the deposit if the toilet and waste tank are not emptied prior to the return of the vehicle. *A cleaning fee of £25 will be charged against the deposit if the BBQ is not returned in a suitably clean condition. * The vehicle will be handed over with a full tank of fuel. An additional charge of £25 to re-fuel will charged against the deposit if the vehicle is not returned with a full tank of fuel. 7. HIREABLE EXTRAS: Other hireable extras available for the duration of Hirers’ stay in an Omni Hire Motorhome includes: Please note: These are subject to change at the discretion of Omni Hire. • Double bedding kit – includes: 1 double duvet & cover, 1 sheet, 2 pillows & cases (£25 per hire) • Single kit – includes: 1 single duvet & cover, 1 sheet, 1 pillow & case (£25 per hire) • EU insurance £20 per day • Extra driver £30 per hire • Use of sun canopy awning (£40 per hire) (applies only to swift escape) Use allows padlocked awning to be unlocked • Drive-Away Awning + Groundsheet, air pump, mallet, pegs etc. (£100 per hire) (Please ensure that the Awning contents are packed away dry and tidy)** • Gas BBQ and connector for Motorhome £40 per hire - (Must be returned in a clean condition or cleaning charges could apply) (applies only to swift escape) • Levelling Blocks. (£10 per hire) • Pre-paid gas 14 litre ‘Full Fill’ on-board gas tank £20 (subject to current gas prices) • Toilet chemicals £10 (full bottle) £5 (half bottle)* (applies only to swift escape) • Generator £50 per hire • European ‘Pack’ (EU/Rest of world to UK electrical adapter, bulb kits, breath test kits, High VIS jackets, warning triangle etc. (This is an obligatory for hire requirement for Mainland European travel) - (POA). • Entertainment Pack – ‘Standard’ (Including, HD LED 18” TV with incorporated DVD & CD player, exterior hook up TV aerial & satellite cables) (£40 per hire) ** (applies only to swift escape) • Entertainment Pack – ‘Premium’ (Including, HD LED 18” TV with incorporated DVD & CD player, exterior hook up TV aerial & satellite cables and exterior fully automated portable satellite system – ideal for European Travel) (£75 per hire) ** (applies only to swift escape) Please see omnihire.co.uk website for prices. ** PLEASE NOTE. These particular accessories are specifically designed to be used with our vehicles and will be fitted by us ready for your hire. Using your own personal alternatives to these exterior fitments is prohibited due to safety and avoiding potential vehicle damage. *Some camping gas is included in the rental and provided on collection. Only customers who have pre-paid for a ‘Full Fill’ of the on board gas will receive a full quantity camping gas. Additional gas purchased throughout the rental period is at the customer’s own expense. *Toilet chemical is compulsory and will be charged per rental, amount will be advised depending on length of hire. 8. MOTORHOME DELIVERIES AND RETURN: Delivery and return of the Motorhome is to an agreed location specified at time of booking as set out under ‘hire period’ in the rental agreement. Agreed location for delivery / return: Home address, unless rearranged prior to payment as extra charges may apply. Other collection / return: - Alternative locations requests will be considered on request. Charges may apply. Delivery – We aim to make delivery directly to the Hirer’s home address during office working hours, this can be changed with agreement to an alternative suitable location, within the 5 miles radius or outside of this area by separate negotiation. Please allow 1 hour to complete the documentation, collection of deposit and demonstration of vehicle. Vehicle will be handed over in a clean condition and in sound working order in accordance with the ‘Vehicle Condition Report (VCR)’. All drivers must be present on delivery of the Motorhome and must present their full valid driving licence, passport and credit/debit card for the security deposit. Photocopies will not be accepted. Pick Up - Return – We will pick up the Motorhome during office working hours at the end of the hire period from the same address as the delivery, unless otherwise rearranged prior with Omni Hire. Allow 1 hour to complete documentation, the ‘Vehicle Condition Report (VCR)’. There are no refunds for early pick up or returns. Charges apply for late returns. Vehicles must be returned undamaged including its contents and all additional extras that are included in the Hirer’s Rental Agreement, with the same level of fuel as the vehicle was received, with an empty toilet cassette, a clean interior and in the same condition as they received the vehicle on delivery. Charges will apply if the vehicle is returned with additional damage, unclean or if the toilet cassette is not empty. Late Return – We must be notified immediately to prevent any prosecution for driver(s) driving whilst uninsured. Late returns will be charged at one day’s rental cost regardless of circumstances. An out of hour’s collection and return service is available outside our opening hours between 7.30am-7.30pm. Please contact us on [email protected] for information on pricing for out of hours. 9a. CANCELLATION BY US/OWNER: We reserve the right to cancel a reservation before or at the proposed commencement of hire as follows: • If Named Driving Licence is not produced or valid in accordance with stated conditions. • Hirer fails to provide funds for security deposit payment (standard excess) by credit card or debit card. • We reserve the right to cancel if the Hirer/Driver fails to pay balance of invoice 8 weeks prior to hire. Our cancellation policy set out in 9b in these terms and conditions will apply in this event. • Over occupancy of vehicle in accordance with the provision of seatbelts. • The Address on driving licence does not match billing address. Additional proof of id is required • Hirer/Driver does not provide a valid passport and driving licence as proof of ID. • Due to operational issues affecting rental fleet. • Hirer/Driver is in breach of any term in this agreement. • The Hirer obtained the vehicle through fraud or misrepresentation. • If any statement, representation or warranty made by the Hirer/Driver in respect to him/herself or additional drivers is incorrect. • The vehicle appears to be abandoned. • The vehicle is not returned at the agreed date or we reasonably believe the vehicle will not be returned on the agreed return date. • Omni Hire considers on reasonable ground that the safety of passengers or the vehicle is in danger. The Hirer/Driver understands that in the event of such termination or repossession that the hirer has no right to a refund or any part of the rental charges or the security deposit. • Our liability is limited to the refunds of all monies paid by the Hirer. No compensation is available for additional arrangements booked by Hirer/Driver (e.g.: flights, concert tickets). • We reserve the right to amend our cancellation policy for certain events. *We reserve the right to refuse to hire to any person, without stating cause. 9b. CANCELLATION BY HIRER/DRIVER: In the event of a cancellation by the Hirer/Driver the following charges shall be incurred: • 4 weeks prior to rental to no show: 100% of total hire charge. • 4 weeks to 6 weeks prior to rental: 50% of total hire charge. • 6 weeks plus prior to rental: 20% of total hire charge. • We reserve the right to cancel the booking if payment is not received six weeks prior to departure. Booking payment is by bank transfer only and security deposit is by card payment only. Administration fee of £25 will be charged on the processing of any refund in the event of cancellation. Customers are advised to check their own travel insurance policy in the event of a cancellation by the hirer. 9c. RIGHT TO CHANGE OF VEHICLE: Every effort will be made by us to ensure you receive the Motorhome type ordered. However, we reserve the right to change your Motorhome type in the event of an operational issue. A full refund will be offered if the alternative Motorhome is not acceptable and the hirer chooses to cancel the rental. No other refund will be available. The Hirer/Driver is not liable for any increased rental charges from the substitute vehicle. The hirer is liable for any additional running costs pertaining to the substitute vehicle. 10. MOTORHOME SYSTEMS: We will carry out a full pre-rental inspection of every vehicle before the commencement of hire. The inspection involves testing every system on board the motorhome to ensure they are operating correctly. On delivery, the Hirer/Driver will be demonstrated the vehicle and shown how each system works. Should an on-board system fail during the hire, we will make every effort to remedy the fault whilst you are out on rental, but in some circumstances, this may not be possible. We cannot be held responsible and will not refund any monies should a loss of service be encountered nor have any obligation to provide a replacement vehicle. In the case of winter hire, we cannot be held responsible in the event of any damage or inconveniences caused by freezing conditions. This is the responsibility of the Hirer/Driver. 11. USE OF THE VEHICLE: During the rental period, the hirer agrees that the vehicle will not be: • Driven by persons under the age of 25 years. • The owner authorizes the use of these vehicles up to the stated number of passengers. Each person to use the safety restraints provided at all times whilst vehicle is in motion. • Driven other than in a cautious, prudent and normal manner or used in a manner which could cause damage. • Driven in a prohibited area. • Used for any illegal purpose for any race, rally or contest • Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law. • Driven by a person who is unauthorised to drive the vehicle as set out under the heading ‘Driver details’ of the Omni Hire Rental Agreement. • Left with the ignition key in or on the vehicle while it is unoccupied (invalidates insurance). • Damaged by submersion in water or in contact with salt water. • Used for any illegal purpose for any race, rally or contest. • Used to tow any vehicle or trailer, without prior permission from us. • Used to carry passengers or property for hire or reward. • Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material. • All Vehicles may only be driven on sealed / bitumen roads. Not to be driven on any road surface that is unsuitable for the vehicle or within its capabilities of normal use. No ‘Off Road’ driving. • I understand that we reserve the right at any time, at its sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause. Vehicle Tracking: • All of our vehicles are tracked and monitored for speed and location SMOKING: • Smoking is not permitted in any of our vehicles. We reserve the right to impose additional cleaning charges should smoke be detected in the vehicle. PETS: • Animals are not permitted in any of our vehicles. We reserve the right to impose additional cleaning charges should animal use be detected in the vehicle. ACCESSORIES, TOWING & ROOF RAIL USE: • The accessories we use are specifically designed to be used with our vehicles and will be fitted where applicable by us ready for your hire. Using your own personal alternatives to these exterior fitments is prohibited due to safety and avoiding potential vehicle damage. • Our vehicles are equipped with tow bars; these are used for supporting bike racks for hire only. Towing of any other type of vehicle, trailer, caravan etc. is strictly prohibited. The use of the pre-installed roof rails is also strictly prohibited. The roof area of the vehicle has various electronic, roof vents, which could be damaged. These rails are for aesthetic purposes only and are not designed carry any weight. FESTIVALS AND OTHER PUBLIC EVENTS: • We permit use of the Motorhome for Festivals and other events; this will be on a request basis only and will be subject to security deposit increases, price increases and or excess payments. We reserve the right to decline the use of the Motorhomes for these types of use. 12. DRIVING IN MAINLAND EUROPE: • Travel in Mainland Europe is permissible. However, you must notify us at the time of booking of your wish to travel to Mainland Europe (Outside of the UK). A European travel ‘Pack’ is mandatory for travel to Mainland Europe and you will be in breach of these terms and conditions should you take the Motorhome into Mainland Europe without prior notification purchasing this. Travel is permitted to the following countries: • Austria • Belgium • Denmark • Finland • France • Germany • Greece • Hungary • Italy • Luxembourg • Netherlands • Norway • Poland • Portugal • Spain • Sweden • Switzerland Travel outside of these countries in our Motorhome/s will be in breach of your terms and conditions and you will not be covered by any insurance. 13. BREAKDOWNS AND VEHICLE MAINTENANCE: • The hirer will take all reasonable steps to properly maintain the vehicle whilst on hire, including checking oil and coolant levels, tyre pressures and batteries • The Hirer/Driver acknowledges that we will reimburse me for expenditure up to £50 reasonably incurred in rectifying any mechanical failure. Valid receipts must be provided for reimbursement. • The Hirer/Driver will be liable for any costs associated with the incorrect use of fuel. All our vehicles run on diesel. • 24 hour Breakdown/Roadside Assistance is provided under the hire contract. The Hirer/Driver may instruct small repairs to the maximum value of £50. We must be notified by telephone for repairs in excess of this amount. 14. RESPONSIBILITY WHEN AN ACCIDENT OCCURS: In the event of any accident, loss or damage arising out of the use of vehicle including damage to a third party vehicle, the Hirer/Driver will: • Notify us within 24 hours of the event • Obtain the names and address of third parties and any witnesses and report the event to the nearest police station • Complete the incident reporting form supplied in the vehicle • Assist us in handling any claim arising from the event • Acknowledge that the excess or other amount due in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period, regardless of which party is at fault. • Will pay any costs relating to the delivery of a change of vehicle as a result of an incident regardless of which party is at fault. • Accept that no security deposit/excess will be refunded until the claim is settled. • Obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station; • Not make any admission of liability to other parties, settlement offer or other like offer; • Assist the owner in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence. • Hirer/Driver acknowledges that the excess or other amount due by me in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period. • Hirer/Driver will pay for any costs relating to the delivery of a change over vehicle as a result of an accident regardless of which party is at fault. 15. VIOLATION OF TRAFFIC LAWS AND REGULATIONS: • Hirer/Driver(s) are personally liable for all legal penalties and fees pertaining to any traffic violation infringements under the current Road Traffic Legislation applicable in the United Kingdom including Northern Ireland, Republic of Ireland and those Mainland European Countries listed in section 13. • We will contact the customer after the rental agreement finishes if any traffic violation infringements are presented to us for your hire period. The Hirer/Driver(s) will be liable for any penalties and fees pertaining to any traffic violation that has been incurred during their hire period. We will notify the driver(s) of any speeding or parking fines and an administration charge of £45 for each infringement incurred throughout the hire period. 16. CONDITIONS OF HIRE: The company’s Motorhome rental agreement is the sole contract for hiring the vehicle between us and the Hirer(s), Driver(s) and/or passenger(s). • The company takes no responsibility for any delay, loss, damage or injury that a hirer might experience no matter how it is caused or by whom. • No refunds are payable on accommodation if they are not available where a hirer or passenger changes or cancels or seeks to vary agreements after collection. • These conditions cannot be varied or altered or waived by any employee or representative of Omni Hire or by anyone providing services or facilities. • Any representative or statement cannot bind the company unless it is confirmed in writing by Omni Hire management. Title to: • I am in breach of any term of this Agreement; • I have obtained the Vehicle through fraud or misrepresentation; • The Vehicle appears to be abandoned • The Vehicle is not returned on the agreed return date or the owner reasonably believes that the Vehicle will not be returned on the agreed return date; • The owner considers on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered. I understand that in the event of such termination or repossession, I have no right to a refund of any part of the rental charges or the Security Deposit and Indemnity of the owner • Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, I release the owner, its employees and agents, from any liability to me (regardless of who is at fault) for any loss or damage incurred by me by reason of this Agreement, including but not limited to: • Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for my purpose; • ii. Any loss or damage to any property left in or on the Vehicle, in any service vehicle or on any of the owner’s premises or recovered or handled by us. • Subject to any insurance arrangements agreed with the owner, I hereby indemnify and shall keep indemnified the owner, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle Vehicle: • I acknowledge that the owner/Omni Hire retains title to the Vehicle and that I possess the goods as a mere bailee only. You do not have any right to pledge the owners credit in connection with the Vehicle and agree not to do so. You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle. Changes: • Any changes to this agreement must be in writing and must be signed on behalf of us and Hirer/Driver. Proper Law: • The law of Great Britain in which this agreement was accepted shall govern this agreement. Entire Agreement: • This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. The owner reserves the right to add or amend any rental charges without prior notice. • Release and Indemnity of the owner: • Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, I release the owner, its employees and agents, from any liability to me (regardless of who is at fault) for any loss or damage incurred by me by reason of this Agreement, including but not limited to: • Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for my purpose; • Any loss or damage to any property left in or on the Vehicle, in any service vehicle or on any of the owner’s premises or recovered or handled by us. • Subject to any insurance arrangements agreed with the owner, the hirer hereby indemnifies and shall keep indemnified the owner, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle. *Should any part of these Terms & Conditions prove to be unenforceable, for any reason, the remainder of the Terms & Conditions shall remain unaffected. 17. Or email [email protected] throughout the rental period. All faults, damage or complaints must be reported immediately on this number or at the latest on return of the vehicle. In the event that a complaint is not satisfactorily resolved upon return, the hirer must inform us in writing within 10 working days.
