By making a booking, you are accepting the terms and conditions set out below. Please read the terms and conditions prior to making a booking. We will be pleased to clarify any point on which you may have a query. Collection and Returns procedure: Collection times are between 3pm-6pm and drop off times are between 9am to 11am. The vehicle check-out procedure takes approximately 30 - 40 minutes, as there will be a lot of information to go through - so please allow time for this when planning your trip. Final collection time is 1800hrs. Please check the times for collection and return carefully. If a vehicle is not returned by the time shown on the rental agreement, a charge of £25 for each hour, or part thereof, will apply. Should the late return of the vehicle make us liable for any extra costs (such as compensation for the next hirer), we reserve the right to request reimbursement of these costs from you. Please return the vehicle on time. You must have the following documentation when collecting the vehicle: 1. 2 x recent proof of home address for the main driver within the last 3 months (home utility bills, council tax or bank statements are acceptable). 2. Your UK driver’s licence and DVLA check code for each person who is to drive the vehicle. A condition of the insurance requires us to complete a DVLA license check for both drivers. In order to do this you would need to go onto www.gov.uk/view-driving-license to obtain a check code which we would need along with your license to check DVLA records. 3. Drivers from overseas must notify us when booking and present their driver's licence and a passport, (this includes EU licence holders, US, Canadian, Australian and New Zealand licences only). We cannot release the vehicle without these items being present at the time of collection, and hire fees may be forfeit. Hirer Obligations: By signing the rental agreement, you agree that you will: 1. Pay all rental charges 2. Pay the security deposit of £500.00 a. The security deposit will be refunded within 5 working days, provided the vehicle and contents are returned undamaged and in a clean and tidy condition. Any damages will be charged as set out below, and will be deducted from the security deposit. b. Should any damages or costs exceed the security deposit, the customer will be responsible to settle all additional costs over and above the security deposit value within 7 days of being notified of the cost. 3. Return the Vehicle to On-the-Roam in the same condition as it was received, and on the due date and time specified. 4. You must not use the Vehicle for hire or reward, nor use it in violation of any law, ordinance or regulation, nor remove it (without prior written consent from On-the-Roam) from the UK mainland. 5. Limit the mileage to 1000 miles per week of hire (pro rata), thereafter subject to a 40p/mile surcharge. 6. Not carry more passengers than the seating capacity of the vehicle, or allow the vehicle to be overloaded. 7. Maintain the correct level of engine oil and coolant. Failure to do so may result in engine damage, for which the Hirer will be fully responsible. ? Be responsible for the Additional Charges which will NOT be covered by our insurance as set out below; 1. Further protect the interests of the Insurer and On-the-Roam by ensuring the vehicle is always parked as safely as possible, locked when unattended, and the keys are secure. Not operate the Vehicle, or permit the Vehicle to be operated in, any way that would violate this contract - including, but not limited to: a. Any person under 25 or over 75 years of age driving the vehicle; b. Driving in motor sport events (including racing, pace making, rallying, reliability trials, and speed testing); c. Being used to propel or tow any vehicle or trailer; d. Any person driving the vehicle when unfit through drink or drugs or with blood alcohol concentration above the limit prescribed for the time being by road traffic legislation; e. By any other person other than the hirer or additional Driver(s) using the vehicle; f. Using the vehicle under authority of any licence other than their own; g. If you or any driver leaves the vehicle unlocked or fails to secure the keys; h. In a reckless or imprudent manner or if the vehicle is deliberately damaged. Additional Charges and Liabilities: In addition to the agreed rental rate, you may become liable for the following charges (which will be deducted from the security deposit): 1. All fines and court costs for parking, traffic or other legal violations assessed against the Vehicle whilst the vehicle is under your control. 2. Any fixed penalty offence committed in respect of that Vehicle; any excess parking charge which may be incurred in respect of that Vehicle during the period of hire. 3. Any uninsurable damages - including wheel & tyre damage, windscreen damage, and any internal damages or breakages - howsoever caused; 4. Any other fees or charges payable by you pursuant to this Agreement. This includes any costs incurred by On The Roam as a result of any breach by you of the terms of this Agreement; 5. £50.00 charge in the event that the vehicle is returned to us with a toilet cassette which has not been suitably emptied and cleaned; 6. £100.00 charge in the event that the vehicle smells of tobacco smoke; 7. A charge of £2.50 per litre of fuel required to return the fuel level at the commencement of hire, in the event that you fail to refuel the vehicle. (NB there are fuel filling stations in Tavistock or at Sourton); 8. £50.00 cleaning charge in the event that the vehicle is not returned in a clean and tidy condition, and rubbish and food etc. has not been disposed of; 9. A mileage charge of £0.40 per mile in excess of your allocated amount (1000 miles for a week, i.e.: 425 for a three day hire); 10. If the hirer leaves property in the vehicle, this can be returned upon request, but a P&P +£10.00 charge will be made: 11. A call out charge for damage repairs / loss of camper keys of £50.00, plus mileage at £0.40 per mile and the cost of parts / keys / recoding etc. Our time on site and repair work is also charged at £35 per hour. 12. In the event that items are missing from the inventory, a charge to replace missing items will be made; 13. An insurance policy excess charge of £500.00 for each incident claimed on the motor insurance policy. If any repair cost is less than the policy excess, you will be liable for the full claims cost. 14. General internal and bodywork damage will be charged out at cost plus 10% of the total cost. If, due to gross negligence (such as, but not limited to: driving through flood water, driving into an overhead object), it is necessary for the vehicle to undergo repairs, you may additionally be liable for the full cost of repairing damage to the actual Vehicle supplied, administrative fees, plus loss of revenue at the prevailing daily rate (up to the value of one month's full rate hire of the vehicle). On-the-Roam has the sole right and responsibility to repair the Vehicle. Damage should be reported to us as soon as possible and in any event within 24 hours after the Vehicle was damaged; In the event of the theft of the vehicle owing to your negligence (such as leaving it unsecured, or through loss of keys), we may hold you responsible for the loss of the vehicle, plus you will also be charged the excess, administrative fees plus loss of revenue at the prevailing daily hire rate (up to the value of one month's full rate hire of the vehicle) following the incident. If the vehicle is stolen, it should be reported immediately and in any event within 24 hours, after the Vehicle was stolen. It should also be reported to the Police immediately and a crime reference number should also be obtained; Any costs, including reasonable legal fees were permitted by law, incurred collecting payments due from hirer. In the event that full payment is not made after 28 days of invoice, a reminder will be sent, 14 days thereafter the account and will be passed to a collections agency incurring an extra charge of 15 % of the total balance due. You agree as part of this contract to pay this sum which represents our reasonable costs in collecting the unpaid amounts. If you seriously breach this agreement, or seriously damage the vehicle, you agree to cease using the Vehicle and to pay all expenses incurred in returning Vehicle to the collection point of rental. Please note that a Tracker device is fitted to the vehicle and indicates if the vehicle has exceeded any relevant speed limits. (This is to attempt to ensure hirer and passenger safety, motorhomes are unstable over these speeds); On-the-Roam will view the information recorded by the Tracker in the following events; that the vehicle is not returned at the designated time; the vehicle is returned with damage; or the Tracker system notifies that the vehicle has been exceeding relevant speed limits. Insurance / Eligibility: Fully Comprehensive insurance is included within the stated hire charge. You are advised to also take out additional personal holiday insurance. The vehicle is insured for the contracted period of hire ONLY. You must therefore notify us in the event that the vehicle will be returned late. Failure to do this may result in the vehicle not being insured for your use and may incur a traffic offence under the Road Traffic Act. Drivers must be over the age of 25 and under the age of 75, in good health, and must have held a full UK driving licence for a minimum of 5 years. Drivers from overseas must produce a valid Licence for their country of origin. Drivers with more than three driving convictions in the past three years cannot be accepted. No one other than the drivers notified to us may drive the vehicle, and all drivers must be present at collection. Overhead Objects and Flooding: All drivers must be aware of the unusually high nature of these vehicles when driving under low bridges, canopies, car parks etc. The headroom clearance is stated on the inside face of the sun visor. Drivers are also not permitted to take vehicles through road flood water under any circumstances. Damage to the vehicle caused through road flood water or collision with an overhead object (any damage above a height of 6’) is classed as negligence – as such the insurance excess will be deemed to not apply - and repairs and any costs arising (i.e.: cancellation of subsequent hires up to a period of one month) will be charged in full to the Hirer. Fixed Penalty Notices: In the event that a fixed penalty notice is received for parking, non payment of toll charges, or a road traffic offence, the driver’s details will be provided to the relevant authority. Accident Procedure You shall, in the event of an incident that results in damage to the Vehicle, ensure that: 1. The driver of the Vehicle completes and delivers to On-the-Roam the relevant accident report and photos within 48 hours after the end of the hire period. 2. No admission of liability is made to any person in relation to such accident; 3. Any writ of summons, summons or other document relating to any proceeding arising out of such accident is forthwith delivered to On-the-Roam at the address on the motor rental agreement; 4. You shall pay or reimburse On-the-Roam against all losses, liabilities, costs, actions, claims or demands which it may incur or have brought or made against it in relation to the Vehicle or its use and which are not recoverable under a policy of insurance whether the same is effected by On-the-Roam or hirer; 5. The names and addresses of all witnesses thereto are collected and given to On-the-Roam. Breakdowns: A full Breakdown Relay service is provided if the vehicle cannot be repaired by the road side. In the event of an accident or breakdown please contact 01274 288 488. Quoting Agency Number: 8608 and Policy Number: BART36SD01. Whilst we make every effort to ensure our vehicles are in full working order – we will not accept liability for consequential losses or claims arising from breakdown, accident or other cause. We will, however offer a refund for balance of any hire days outstanding. Parking at our farm The hirer may park one vehicle free of charge and at his/her own risk (which will be under cover) for the period of the hire. A second vehicle may be parked for a fee of £10 per week. Data Protection: For the purposes of the Data Protection Act 1984, On the Roam may hold and process by computer or otherwise the information given to us by the hirer or any Additional Driver to identify other products or services which might be relevant and for statistical analysis. Personal Information supplied will be disclosed to a third party for identity validation purposes subject to a Data Protection Act request.
