Highland Auto Campers - Terms and Conditions 1 Drivers identification The Hirer and any other named drivers shall provide the following documentation 14 days before the hire start date: a. Driving Licence Photo Card – address must be your current home address b. National Insurance Number c. Online DVLA Licence Check Result/Print Out from https://www.gov.uk/view-driving-licence d. You must provide a total of 2 proofs of address from 2 different companies from the following. These must be dated within the last 90 days and match the name and address shown on your driving licence: Electricity (bill/statement) Water (bill/statement) Gas (bill/statement) Broadband/Landline Council tax (Annual Bills accepted) TV licence Bank Statement Credit card bill/statement Mortgage statement Polling card HMRC self-assessment/tax credit Student loan Shotgun licence Payslip Mobile phone bills Pension letters Car finance statement Loan statement Property deed When you collect the vehicle, please bring your photocard driving licence with you and original copies of the other forms of ID. Highland Auto Campers cannot be held responsible for any lost holiday time as a result of you forgetting to bring the correct documentation. No refund will be given if the hirer fails to provide the correct documents. 2 Drivers a. To be insured to drive one of our hire vehicles you must be aged between 25 and 75 years of age. b. Insurance for drivers over 75 years of age may be possible by special request and agreement only with Highland Auto Campers & our insurer. Highland Auto Campers must be notified at the time of booking should any driver be over the age of 75. Additional information will need to be provided. The cover is not guaranteed and an additional security deposit charge may be stipulated by our insurers c. Maximum of 2 drivers per rental d. All drivers must have held a valid licence for more than 2 years which entitles them to drive a UK category B1 vehicle e. Drivers holding only an automatic licence cannot be insured f. All drivers must be present at collection and handover of the vehicle - no exceptions can be made g. Production of a full, valid standard driver's licence, is required from all drivers at the start of hire h. Copies will be taken of all identification presented and will be retained for 7 years for the purpose of, but not limited to, the defence of any legal claim(s) i. If you have a modern Northern Ireland licence, we require both the photocard and paper counterpart j. Your licence address must be your current home address. k. All drivers whose licence is issued outside of the EU or Commonwealth are required to supply a valid standard licence at the start of hire. This must be issued in the country your standard licence was issued and confirm you can drive a UK category B1 vehicle. Should any driver fail to present all correct documentation and identification on collection of the vehicle or do not meet the driver requirements stated in the terms and conditions, then Highland Auto Campers will be unable to release the vehicle and no refunds will be given l. Endorsements on licences: you must declare at the time of booking if there are any endorsements on your licence. Highland Auto Campers can accept no more than two convictions with a maximum of 3 points per conviction. We cannot accept drivers with BA, DD or UT convictions or any driver disqualification within the last 5 years. No refund will be given if the hire is cancelled because we are unable to insure you to drive. m. Insurance claims: You must declare at the time of booking if you have made or had a vehicle insurance claim made against you within the last 5 years. Highland Auto Campers may not be able to get cover should you have had 2 or more claims within the last 3 years n. The campervan shall be driven only by the Hirer or other permitted driver who has completed and signed the booking form immediately before any hire and has provided all the required identification. o. The Insured vehicle shall not be used for the carriage of goods of an explosive or hazardous nature, or the carriage of goods or passengers for hire and reward or any other form of profit or remuneration. p. The campervan is not insured outside the contract of hire. **Please note that if any of the above applies to any proposed driver of the vehicle, this may prohibit you from hiring the campervan. For insurance purposes you must declare ANY endorsements, motoring accidents, or physical or mental conditions** 3 Insurance a. The Vehicle is insured for theft and damage to the vehicle and the property of a third party, but does not include any personal insurance for the customer (including death or bodily injury to the driver) or cover any personal possessions. b. The hire rate quoted includes a standard excess of GB£750.00 per accident, reported incident or vehicle theft. In the event of any damage to either the vehicle or third-party property, the hirer will be liable for the first GB £750.00 per claim. c. In the event of the theft of the vehicle, the hirer will be liable for the full cost of the Vehicle; once a theft has been reported to both Highland Auto Campers and the police, a claim will be lodged with the insurer. The keys must be returned to Highland Auto Campers, should the insurer accept the claim and agree to reimburse Highland Auto Campers for the cost of the vehicle, the liability to the hirer will reduce to the first GB£750.00 of the claim. d. Please note: if the keys are not returned to Highland Auto Campers, the insurer will not accept the claim and liability for the full cost of the vehicle will remain with the hirer. e. Only persons named on the Rental Agreement are insured to drive the vehicle. Please note that no insurance cover is offered for overhead damage, any damage deemed as gross negligence, or any internal damages, therefore the hirer accepts full liability for these which is in addition to the standard vehicle excess, should that apply. f. The hirer will also be fully liable for replacement or repair of windscreen, tyre or alloy damage. g. In the event of a claim resulting from the use of cooking/heating appliances, a 25% excess will apply, subject to a minimum excess of £750. 4 Security Deposit a. A security bond of £750 will be taken 2 days before commencement of hire. This will be taken from the credit card you use to book your hire. This will be refunded within 7 working days of the end of the rental period, so long as the terms of the rental are met, subject to final audit. These terms are: • Campervan returned with a full tank of diesel • The campervan is clean and in the same condition as when rented out • Toilet (if borrowed) must be emptied and sanitised • Cooking appliances and utensils clean for use (a cleaning charge of £15 per hour will be applied to rectify) • The campervan is returned by the agreed time (a late charge of £50 per hour will apply). • All equipment provided to use is returned with the campervan free from damage b. The security deposit will be used to fund any loss or damage whatsoever to equipment, fixtures and fittings, windows, valeting or upholstery fees or negligent damage to the vehicle. Should these damages exceed the security deposit held, the customer will be liable for the total cost and the difference will need to be settled within seven days of returning the vehicle. c. If any damages do not exceed the security deposit Highland Auto Campers will only charge for the necessary amount. d. In the case of gross negligence, Highland Auto Campers reserves the right to recover full costs to return the vehicle to the state in which it was handed over. The hirer will be liable for any additional costs over and above the security deposit value, should damages exceed the security deposit value 5 Fines and Liability Drivers are responsible for any penalties such as parking fines and speeding tickets during the hire period. 6 Checking in and out procedure On collection of the campervan, we will jointly inspect the van’s condition and sign out the campervan. On return of the campervan, the van will be inspected to ensure the van is in the same condition as it was at the beginning of the hire period. 7 Payment A reservation is only binding once the booking is confirmed by Highland Auto Campers by email, and a non-refundable 25% has been received. Settlement of the remaining balance will be due four weeks before departure. Payment is taken by debit or credit card. Vehicles will not be released without full payment being completed. 8 Cancellation For cancellations, more than 4 weeks from the rental date, the 25% non-refundable deposit will be retained. For cancellations, less than 4 weeks from the rental date, 100% of the hire cost will be retained. We advise all hirers to take out holiday insurance to cover any eventualities. There will be no refund in the event of early return e.g. illness, accident. 9 Force Majeure If the UK Government impose mandatory travel restrictions due to an event beyond Highland Auto Campers control, such as a pandemic, epidemic, war, terrorism, earthquakes, hurricanes or acts of government which renders the planned hire impossible to commence or complete, Highland Auto campers will consider this a force majeure under the law and will enforce their standard cancellation policy. If this happens during an ongoing hire, the vehicle will be recalled as soon as possible. For this reason, customers are strongly advised to take out appropriate travel insurance for their trip. Alternatively, any existing booking may be deferred to a later date upon discussion and formal agreement with Highland Auto Campers should a force majeure be activated. Any deferred booking must be taken within 12 months of the postponement or the offer will expire, and the force majeure refund policy will be enforced. 10 Breakdown In the event of the campervan breaking down and being un-drive-able, Highland Auto Campers will provide you with details for contacting vehicle breakdown assistance, who will attempt to fix the vehicle or recover it back to Highland Auto Campers. In the case of you being without the van, you will be refunded on a pro-rata basis. We cannot accept liability for missed functions or events due to breakdown. 11 Unforeseen Cancellation In the unfortunate event that the campervan is damaged and un-drivable or stolen before your hire, and we cannot provide a replacement vehicle, a full refund of all monies paid will be given. We cannot accept liability for missed functions, travel costs and other commitments such as campsite bookings due to breakdown or theft, and we cannot accept liability for adverse weather conditions affecting any hire. 12 Personal Travel Insurance It is the hirer’s responsibility to provide their own insurance to cover personal items and belongings, personal injury, and cancellations. 13 Rental restrictions Smoking and candles are strictly not permitted inside the campervan We welcome dogs but this must be booked with us in advance, hirers found to have taken a dog without our permission will be charged an additional cleaning charge of £50 per hour. The maximum number of passengers is 4 The hirer must not leave keys in the ignition or anywhere in view to prevent theft The hirer will be responsible for the loss of keys The hirer will be responsible for using the correct fuel (diesel) and will incur any costs to rectify The driver must not drive the campervan off public roads and only drive on sealed / bitumen roads/camp sites. Highland Auto Campers reserves the right to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause. Theft of the campervan or equipment must be reported to the police and Highland Auto Campers immediately 14 Pet Policy We allow our guests to bring their dog, at no extra cost, all that we ask is that you keep to a few rules when bringing your pet on holiday: a. You must notify us at the point of booking that you are bringing your pet with you. b. We allow small or medium dogs and a maximum of 2 per booking. The camper would not be suitable for larger breeds, due to the size of the vehicles c. All pets must be kept off the bed, seats and fabric covers at all times. d. Please do not leave pets alone in the vehicle at any time. e. Please return the van in a clean condition - the guests following you may not be dog lovers! An additional cleaning charge will be made if the camper is not cleaned to an acceptable level when returned at £50 per hour. If you have any questions about bringing your dog, please contact us before booking. 15 Use of the Vehicle The Vehicle is not to be: a. driven otherwise than in a cautious, prudent and normal manner or used in a manner which could cause damage b. driven on non-metalled roads other than on campsites. The hirer will be fully liable for damage caused to the underside of the vehicle caused by driving on inappropriate surfaces. c. driven in a prohibited area or an area other than the areas indicated by Highland Auto Campers d. driven by a person under the influence of alcohol or drugs or with a blood alcohol level above that permitted by law e. left with the ignition key in the vehicle while it is unoccupied. f. driven by persons under the age of 25 years or who is not authorised by law to drive the Vehicle or named in the agreement g. damaged by submersion in water h. put into contact with Salt Water i. used for any illegal purpose for any race, rally or contest j. used to tow any vehicle or trailer; used to carry passengers or property for hire or reward k. used to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this agreement l. used to carry volatile liquids, gases, explosives or other corrosive or inflammable material or otherwise used in breach of the Hirers obligations under this Agreement. The hirer also agrees not to carry more passengers than the seating capacity. 16 The Hirer will pay Highland Auto Campers the following All rental charges; there may be a cleaning fee of £15.00 per hour if the vehicle is not returned with the interior in a clean condition, the cost of any damage to the Vehicle or the property of any third party, subject to the insurance cover. All government fees and duties etc; All parking fines, other fines or penalties, and/or accidents including third party property damage not reported on return of the Vehicle and associated administration costs incurred in relation to the Vehicle during the Rental Period; Any other fees or charges payable by the Hirer under this Agreement. This includes any costs incurred by Highland Auto Campers as a result of any breach by the Hirer of the terms of this Agreement. The cost of recovering a vehicle that has become bogged. 17 Alterations to the Vehicle The Hirer shall not make any alterations or additions to the Vehicle without the prior written consent of Highland Auto Campers. 18 Maintenance The Hirer shall take all reasonable steps to properly maintain the Vehicle, including daily checks on oil and water levels, and tyres and batteries, and will stop and react to any dash warning lights. In the event of any problems, the hirer will contact Highland Auto campers. Highland Auto Campers will reimburse the Hirer for expenditure reasonably incurred in rectifying any failure to the Vehicle, provided that the Hirer produces relevant receipts at the end of the hire period and has received the prior consent of Highland Auto Campers, and that the damage or failure is not due to any fault or breach of this Agreement by the Hirer. 19 Responsibility if an accident occurs In the event of an accident, loss or damage arising out of the use of the vehicle, the Hirer will notify Highland Auto Campers, obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station. The Hirer must take photographic evidence of the incident, including any third-party damage. The Hirer undertakes to assist Highland Auto Campers in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence. 20 Terminating the Agreement The Hirer acknowledges that Highland Auto Campers may terminate this Agreement and repossess the Vehicle at any time, without notification to the Hirer, and that the Hirer will pay the reasonable costs of repossessing the Vehicle, including towing charges if the Hirer is in breach of any term of this Agreement, has obtained the Vehicle through fraud or misrepresentation, the Vehicle appears to be abandoned, the Vehicle is not returned on the agreed return date or Highland Auto Campers reasonably believes that the Vehicle will not be returned on the agreed return date, Highland Auto Campers considers on reasonable grounds, that the safety of passengers or the condition of the vehicle is endangered. In the event of such termination or repossession, the Hirer has no right to a refund of any part of the rental charges or the Security Deposit. 21 Change of Vehicle Highland Auto Campers reserves the right, at its absolute discretion, to substitute a comparable or similar Vehicle for the Vehicle. 22 Release and indemnity of Highland Auto Campers Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, the Hirer releases Highland Auto Campers, its employees and agents, from any liability to the Hirer (regardless of who is at fault) for any loss or damage incurred by the Hirer by reason of this Agreement, including but not limited to any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for the hirer's purpose, any loss or damage to any property left in or on the vehicle, in any service vehicle or on any Highland Auto Campers premises or recovered or handled by Highland Auto Campers. Subject to any insurance arrangements agreed with Highland Auto Campers, the Hirer hereby indemnifies and shall keep indemnified Highland Auto Campers, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of the hirer's use and/or possession of the Vehicle. 23 Title to Vehicle The Hirer acknowledges that Highland Auto Campers retains title to the Vehicle and that the Hirer possess the goods as a mere bailee only and do not have any right to pledge Highland Auto Campers credit in connection with the Vehicle and agree not to do so and shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle. 24 Pick up & Parking Hirers may leave their vehicles at Highland Auto Campers site. Highland Auto Campers will not accept any liability for hirers vehicles or possessions while on Highland Auto Campers premises 25 Privacy Policy Please refer to our Privacy Policy for details of how we collect, store and use your personal information Please Note This agreement shall be governed by Scottish Law. This agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. Highland Auto Campers reserves the right to add or amend any rental charges without prior notice. Updated 21st July 2023
