DEFINITIONS USED WITHIN: Where the following words appear, we mean: You / Your – the person who has booked and the person who will be driving the hire vehicle. This may be the same person or separate individuals where each person is liable jointly and severally for all obligations to you pursuant to this agreement. Us / We / Our – Wanderlust Camper Co Ltd and our agents. Campervan – the vehicle declared on the booking confirmation, Campervan Rental Hire agreement and insurance schedule cover. 1.SAFETY DEPOSIT, INSURANCE AND DAMAGES 1.1 A £250 safety deposit is required, payable by credit or debit card, BACS or cleared cheque only. 1.2 We reserve the right to increase the safety deposit for specific events or longer-term hire periods. We will have advised you of this amount at the time of booking. 1.3 If there is minor damage to the campervan, either inside or out or to any of the contents (or there are missing items) we will deduct the cost of repairing the damage or replacement where applicable from the safety deposit and refund the balance owed to you. 1.4 We will release the safety deposit within 7 days where the campervan is returned in the same condition it was let it out. 1.5 We will check the interior and contents are clean / undamaged including but not limited to: cooking equipment, appliances, fridge and upholstery. We will check the exterior of the campervan is reasonably clean and undamaged including but not limited to: bodywork, wheels and tyres, glass, mirrors, lights, grills, roof, upholstery of roof unit and licence plate. 1.6 We ask you to sign a vehicle condition report upon collection and return of the campervan. 1.7 Upon returning the campervan, we will do a tertiary check back with you and a more detailed inspection will take place when cleaning within 48 hours. Particularly where the campervan is returned in the dark, we will require good light and clean campervan to fully inspect. 1.8 In the event of damage to the campervan you will be liable to the sum of up to £1000 as a damage excess. 1.9 The self-drive hire insurance driver criteria is for drivers who: - Have held full UK/EU licence for more than 24 months (licences from further afield must be referred in advance) - Who have up to 6 points on their licence (providing they are two minor offences) - Aged between 25-75 - Have no more than one fault or non-fault claim within 5 years - Who have not had their licence suspended for any period within the last three years. - Have not obtained a BA, DD or UT conviction 1.10 The driver must supply the following to us to be insured: - Valid driver’s licence (address and photo to be up to date) - Cleared and traceable safety deposit - 2 forms of proof of address (must match drivers licence, less than 90 days from date of hire) - Online licence check code obtained from https://www.viewdrivingrecord.service.gov.uk/driving-record/licence-number - Signed Campervan Rental Hire Agreement 1.11 Persons excluded form insurance: Those engaged wholly or partly in professional entertainment or professional sports. Jockeys or persons connected with racing of any sort. Foreign Service Personnel other than persons born in the UK. 1.12 The campervan is insured for damage to the campervan and property of a third party. You are liable for the first £1000. Where an insurance claim has been rejected because of your negligence, you will be liable for the full cost of rectification or replacement to our campervan or third-party property. 1.13 Items not covered by the insurance include amongst other things: front and rear bumper, roof lights, windows, wing mirror and external doors and hinges, campervan engine other than wear and tear, incorrect fuel or fuel contamination or the property of any third-party subject to the insurance. 1.14 You must have our consent to carry out repairs. 1.15 Damage or defective wheel and tyres is your responsibility and have left our premises with serviceable tread and without defect- this is acknowledged on the vehicle condition report. 1.16 You will be liable for any cost associated with the incorrect use of fuel and resolving any associated issues and repairs. 1.17 If your claim is due to theft, attempted theft, malicious damage or vandalism, you must notify the police within 24 hours of discovery of the loss or as near as practical and obtain a crime report number. 1.18 Glass/windscreen cover excess is £80 and repairs excess are £25. There is no cover for roof vents. 1.19 Replacements keys – you are liable for costs for up to £300. We will take this cost from your safety deposit. 1.20 No personal cover for personal effects is included. We recommend you take out suitable insurance. 2. USE OF THE VEHICLE 2.1 At no time should the campervan keys be left in the vehicle while unoccupied, or keys be left with an unauthorised person. 2.2 The campervan will not be used to tow any vehicle or trailer unless otherwise approved in writing by us. 2.3 Weight limits and loading details are provided. You must not exceed the gross vehicle weight or individual axel weight. Our website advises on the payload by individual campervan. It is the driver’s responsibility to ensure that the campervan and the contents do not exceed the advised pay load. You can be fined or get a court summons if the campervan exceeds its maximum permitted axle weight. We are not liable for any weight calculations on your behalf. 2.4 The insured campervan shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature, or passengers for hire or reward or any other form of profit or remuneration; or for racing, pace making, testing the campervan reliability and speed or teaching someone to drive. 2.5 The campervan shall not be taken outside of the UK. 3. BREAKDOWN COVER 3.1 We will supply full breakdown cover to cover any mechanical faults to the campervan. 3.2 In the unlikely event of breakdown, no responsibility will be accepted by us for any loss, damage, or expense which occurs because of any defect or breakdown. 3.3 Call out charges from operator error or mismanagement eg flat battery / flat or defective tyre / broken windows or screen, are not covered by the breakdown cover and to be paid by you. In the event of a flat tyre, campervans that are not supplied with a spare wheel are supplied with temporary inflation foam. 3.4 Non-mechanical breakdown, such as rescue from a non-solid road surface, are not covered under breakdown cover and you will be liable for the cost. The campervan must not be driven into water or on beach or boggy flooded land / terrain. 4. PETS 4.1 Pets are only allowed by prior agreement and not all campervans are pet-friendly. 4.2 We will charge a cleaning charge of £35 to clean where the campervan is not returned reasonably clean, whether the pet is authorised or not. 4.3 It is a legal requirement that drivers need to ensure ‘dogs or other animals are suitably restrained’. We provide seat belt clips for this purpose in our pet friendly campervans however it is your responsibility to bring with you suitable equipment to secure your dog. Failure to do so may invalidate our insurance. 5. SMOKING 5.1 It is a condition of your insurance and hire that you must not smoke in the campervan, this includes e-cigarettes, vaping and any form of smoking apparatus. 5.2 You will be liable for any damage caused to the campervan and an additional cleaning fee of £65. 6. PASSENGERS 6.1 It’s the driver’s responsibility to make sure all passengers are wearing seatbelt. You must not exceed the number of passengers to belted seats fitted. 6.2 Child seats are not provided. You must bring your own and installing these are the driver’s responsibility. 7. LPG GAS 7.1 You must only replace with Calor blue cylinders. 7.2 Our gas connections and installations are inspected annually as required by law. The Gas Safety Certificate is available in the campervan for your inspection. 7.3 You must take care to check the condition and position of the rubber seal when changing the gas cylinder, as if you undertake the replacement, you take responsibility for ensuring you have correctly refitted the connection (including rubber seal), cylinder and rubber seal. RESPONSIBILITY WHEN AN ACCIDENT OCCURS 8.1 In the event of any accident or damage to the campervan, you must notify us immediately for advice and assistance. 8.2 You must obtain the names, addresses and details of all third parties and witnesses related to the event and to subsequently report to the police. Please take photographs where possible. You will be required to supply an accident report and / or incident report. 8.3 You are advised not to make any admission of liability, settlement offer or other similar offers to any parties involved as this may hinder an insurance claim. 8.4 Following an incident, you must ensure that the campervan is safe and secure as you will continue be liable for any further incidents that occur due to not securing the campervan safely. 8.5 You agree to assisting us, to the best of your ability in handling any claim arising from any event during your hire period including providing all relevant information and attending court to give evidence where needed. 9. MAINTENANCE 9.1 You are advised to undertake reasonable steps to properly maintain the campervan during your hire period including oil checks, water and batteries. Failure to do so and any damages or losses resulting from lack of maintenance during your hire period will be your responsibility. 10. RETURN 10.1 The campervan must be returned by 11am. Exceptions must be agreed in writing in advance. We do not refund if you return the campervan early. 10.2 Late returns will incur a charge of £50 per hour for up to 3 hours from the return time. After this time, you will be charged the relevant full day hire fee. You must keep us informed. 10.3 You will be liable for any additional costs that may be incurred to us or in respect of the follow-on hire. 10.4 If the campervan is returned late your collection day delaying your departure, we will extend the same curtesy to you by pursuing reasonable costs occurred by the previous hire. 11. YOUR PRIVACY 11.1 The General Data Protection Regulation stipulates that we can hold copies of your identification for as long as we feel necessary. Our insurance recommends this for 24 months. We will update details of our compliancy when required. 1.2 A tracking device is fitted to the campervan to enable recovery of the campervan if it is stolen or for unauthorised use or where we suspect breach of this agreement. 11.3 We will not use this data for any purpose that will infringe your privacy. The data will not be shared with any other party, unless we are required by an agent authorised to request it. 11.4 Any tracking data will not be kept after 6 months unless there is a specific reason to do so, in which case, you will be advised. You can request a copy of this data. 12. OTHER CHARGES 12.1 Refilling the fuel tank is charged at fuel cost plus £10 fee. This will be deducted from the safety deposit. 12.2 All parking fines, congestion charges, other fines court or penalties, costs arising from being clamped and/or accidents including third party property damage not reported on return of the vehicle and associated administration costs incurred in relation to the campervan during the rental period are your responsibility. Your details will be passed to those authorised to request it. 12.3 During or relating to your rental period, you are responsible for any charges arising from Customs and Excise or Immigration Authorities seizing the campervan together with a loss-of-income charge while we cannot hire out the campervan. 12.4 You are liable for any costs incurred with a late return whether caused by lateness or incident that you are involved in that affects an follow-on hire (see 10.2 and 10.3 for charge details) except mechanical breakdown, where it is deemed not to be operator error. This includes but not limited to the loss of follow-on rental charges affected and costs incurred that relate to accident repairs or replacement (see 1.8 and 1.9 with regards to damage excess). 12.5 Mileage is included at 500 miles week or on a pro rata basis for a part week. We will notify you of your mileage allowance. Exceeding the mileage allowance is charged at £40 per block of 500 miles (or part thereof). This is payable upfront, upon return or from your safety deposit. 12.6 You acknowledge that the excess or any other amount due by you in respect to any damage arising from an accident, loss or damages are payable at the time of reporting the event and not at the completion of the rental period. 12.7 All charges and expenses payable by you under this agreement are due on demand. If you do not pay all charges when due, we will charge a late payment fee of 1.5% per month on the outstanding balance and any collection cost incurred by us including reasonable legal fees. 13. EVENTS BEYOND OUR CONTROL 13.1 Unfortunately, events beyond our control may occasionally affect bookings resulting in cancellation, delays or damage. 13.2 Where your rental has been cancelled, because of an accident or breakdown we will refund the rental charges you have paid. Unfortunately, we cannot accept any responsibility or pay any compensation, or other costs or other expenses incurred. This includes any delays to and/or restrictions to your hire to which you may be subject. We recommend you take out travel insurance. 13.3 We will do our best to ensure you are a happy customer and a replacement will be offered if we can, although we are under no obligation to do so. 13.4 In severe weather conditions, we may refuse use of the campervan where we believe you or the campervan could be endangered. In this instance we will provide a full refund. 14. ENTIRE AGREEMENT 14.1 We are not liable for any loss, damage or costs incurred resulting from breakdown, defect, accident or the campervan being unsuitable for your purpose; including but not limited to: -Any loss or damage to any property left in the campervan. -Any costs associated with breakdown, defect or accident that are not authorised by us. 14.2 This agreement is governed by the laws of the country in which it is signed. Any dispute may and must be settled in the courts of that country. 15.TERMINATING THE AGREEMENT 15.1 We may terminate the agreement and repossess the campervan at any time, without notification and you will repay reasonable costs of repossessing the campervan including towing charges if you: - are in breach of any terms & conditions. - have obtained the campervan through fraud/ misconception. - appear to have abandoned the campervan. - have not returned the campervan on the agreed date or we reasonably believe that the campervan will not be returned on the agreed date. - We consider on reasonable grounds that the safety of the passengers or the condition of the campervan is endangered. 15.2 You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges, safety deposit or insurance excess. 16. RELEASE AND INDEMENITY 16.1 Subject to our obligation to deliver the campervan you release us, our employees and agents, from liability to you (regardless of who is at fault) for any loss, damage or injury incurred by you, including all members of your party, by reason of this agreement, including but not limited to: - Any loss or damage caused by breakdown, mechanical defect, accident or the vehicle being unsuitable for your purpose; - Any loss or damage to any property left in our campervan. 16.2 Subject to any insurance arrangements agreed with us, you hereby indemnify and shall keep us indemnified, our employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by you or any member of your party by reason of your use and/or possession of the vehicle. 16.3 RELEASE You hereby waive and release any claims against us, our employees or representatives, for any injuries or death that may be sustained by you on or near or adjacent to the campervan, including any common facilities, activities or amenities, outside of the self-drive hire insurance. You agree to use any such facilities or amenities entirely at your own initiative, risk and responsibility.
