Terms & Conditions 1. Cosy Campers Contract Terms: Signing this form confirms you accept the conditions of the rental agreement listed in this document. 2. Payment and Cancellation: A non-refundable booking deposit is taken when Cosy Campers confirms your reservation for the hire vehicle. This cost varies according to the type and duration of your hire. (Usually 25% of the full cost of rental) The balance is due 6 six weeks prior to departure or at the time of booking if less than 6 weeks to departure If you cancel your booking up to 6 weeks before departure we will refund 50% of the total hire charge. If you cancel your booking less than 4 weeks before departure the amount paid is non-refundable. We recommend that you take out holiday insurance that covers cancellation fees. In the unlikely event that the van is no longer available due to unforeseen circumstances or breakdown occurs for the duration of your trip cutting the trip short a refund will be given. 3. Rental Period You will have the vehicle for the rental period shown in the agreement. We may agree to extend this rental period but the rental may never exceed 30 days. If you do not bring the vehicle back at the time agreed you are breaking the conditions of this agreement. Cosy Campers can charge you for every day or part day you have the vehicle after you should have returned it. Cosy Campers will charge you the daily rate quoted until the vehicle is returned. Cosy Campers offer unlimited Mileage when hiring the vehicle. Fuel is not included; the Campervan is supplied with a full tank of fuel and must be returned as such. Cosy Campers is not currently VAT registered and does not charge VAT. 4. Inclusions Fully Comprehensive Insurance covering one driver. A second named driver will incur an additional fee – only if they meet the insurance criteria. There may be additional charges set by Cosy Campers’ insurance company for convictions, claims or other items. Full Breakdown and Roadside Assistance cover Camping equipment as agreed at the time of the booking. Loss or damage to Cosy Campers inventory will be charged for at cost for parts and fitting where applicable. 5. Cosy Campers’ Responsibilities 5.a: The vehicle is maintained to at least the manufacturer’s recommended standard. 5.b: Cosy Campers are responsible if someone is injured or dies as a result of our negligence. Cosy Campers are not responsible for any indirect or unforeseeable loss or damage (indirect losses are the losses which happen as a side effect of the main loss or damage). Foreseeable losses are the losses arising directly from, for example, the vehicle breaking down (such as the cost of repairing the vehicle or arranging other transport). You or we may not foresee other losses and so, if you want to be able to claim for such losses, Cosy Campers recommend that you arrange insurance. 5.c: Cosy Campers undertake that the vehicle is roadworthy and suitable for renting at the start of the rental period. In addition to the above, If you are not renting the vehicle for business purposes, we are responsible if we break the conditions of the rental agreement in the following ways: The vehicle does not correspond to our description of it The vehicle is not of the quality that you would be entitled to expect from a rental vehicle The vehicle is not fit to drive We do not have the right legally to rent out the vehicle. 6. Your Responsibilities 6.a: You must look after the vehicle and keys to the vehicle. You must always lock the vehicle when you are not using it and use any security device fitted in or supplied with the vehicle. You must always protect the vehicle against bad weather which can cause damage. You must make sure that you use the correct fuel. 6.b: You are responsible for any damage to the roof or upper part of the vehicle caused by hitting low level objects, such as bridges or low branches. 6.c: You must not sell, rent, loan or dispose of the vehicle or any of its parts. You must 6.d: You must not let anyone work on the vehicle without Cosy Campers’ permission. If we do not give you permission, we will only give you a refund if you produce a receipt for the work. 6.e: You must let Cosy Campers know as soon as you become aware of a defect to the vehicle. 6.f: You must bring the vehicle back to the place where we agreed during the opening hours displayed at the rental location. One of our staff must see the vehicle to check that it is in good condition, Where we have agreed that you may return the vehicle outside of business hours, you will remain responsible for the vehicle and its condition until it is reinspected by a member of staff. 6.g: You will have to pay for repairs if:- The vehicle needs more than Cosy Campers’ standard valeting (cleaning) You have damaged the inside of the vehicle You have damaged and/or lost any part of the vehicle 6.h: Cosy Campers hold a strict No Smoking policy in the van. Any Evidence of smoking will result in a £200 valeting charge. 6.i: Cleaning – Should the vehicle be returned without being in a clean condition then a cleaning fee will be charged. £100 for general valeting £200 if smoking has taken place within the vehicle £300 if the portable toilet and waste tank have not been emptied and cleaned 6.j: You must check before you bring back the vehicle that you have not left any personal belongings in the vehicle. Cosy Campers are not responsible for any items remaining post-rental. 7. Property We are only responsible for property in the vehicle if the loss or damage is a result of our negligence. 8. Conditions for using the vehicle. 8.a: The vehicle must only be driven by the person named on the rental agreement. Anyone driving the vehicle must have a full, valid driving licence and not be prohibited by law from holding or obtaining such licence. 8.b: You or any authorised driver must not do any of the following: Carry passengers for hire or reward Use the vehicle for any illegal purpose Use the vehicle for racing, pacemaking, testing the vehicle’s reliability and speed or teaching someone to drive Use the vehicle under the influence of alcohol or drugs Carry a number of passengers and/or baggage which would cause the vehicle to be overloaded or in the case of a commercial vehicle, a payload which exceeds the maximum payload and individual axle plated weights or for a purpose which requires an Operator’s Licence where you do not have one. Drive the vehicle outside England, Scotland, Northern Ireland and Wales, unless we have given you permission in writing and appropriate charges paid. 9. Security Deposit 9.a. A security deposit is taken to cover any damage, loss or similar to the Campervan or its equipment. The vehicle must be returned in the same condition as it was when the reservation commenced. 9.b: A security deposit of £500 is payable 5 days prior to the departure date. Unless other arrangements have been agreed. 9.c: The security deposit is payable by BACs or by credit/debit card. 9.d:.Should an incident occur during hire that results in the loss of the security deposit, a further security deposit must be provided to continue hire. Failure to make payment of a further deposit may render the insurance invalid. 9.e: The security deposit is refundable within 1 week following satisfactory return of the vehicle and following an inspection of its condition. Refunds will be processed within this 1 week period but funds may not clear within this timescale. 9.f: The security deposit may however be retained pending the outcome of an insurance claim, regardless of fault. 9.g: The security deposit will be charged and lost in the following circumstances: Insurance Excess – The security deposit forms an insurance excess should any claim be made against the insurance Chargeable Fees – If prohibited activity occurs within the vehicle we will charge the related fee as indicated throughout this document Loss or damage – Including to the vehicle and/or its equipment; including fixtures, fittings, windows, tyres and extras 10. Charges Cosy Campers charges follow the current price list. You will pay the following charges: 10.a: The rental and any other charges we work out according to this agreement. 10.b: Any charge for loss or damage as explained in the ‘your responsibility’ section 10.c: A refuelling charge if you have used and not replaced more fuel than we supplied originally. 10.d: On demand, all fines and court costs for parking, traffic or other offences (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs. If you do not, you will be responsible to pay our reasonable administration charges which arise when we deal with these matters. 10.e: On demand, the full cost of any insurance excess for repairing or replacing the vehicle if it is damaged or stolen. 10.f: On demand, any charges made by Customs and Excise as a result of seizure of the vehicle by them, together with a loss of income charge whilst the vehicle is unavailable for rental. 10.g: Any discussed rates for delivery and collection of the vehicle. 11. Our Insurance Cosy Campers’ use specialist insurance and do not allow you to self-insure the vehicles. 11.a: If Cosy Campers arrange separate insurance, you will receive separate information on the insurance cover and any restrictions which may apply. Otherwise, the condition of our Insurance (including any waivers of liability) will apply. 11.b: We have a legal responsibility to have insurance to meet the RTA requirements. This provides cover for claims made if you injure or kill any 3rd party, whilst driving the vehicle, or damage their property (subject to a minimum cover of £250,000), 11.c: Cosy Campers will provide cover for theft and damage to the vehicle caused during an attempted theft. You can get details of our minimum legally required Insurance and our Damage Protection Programme (including the main exclusions) upon request. 12. What to do if you have an accident. If you have an accident you must not admit responsibility. You should get the names and addresses of everyone involved, including witnesses. You should also make the vehicle secure, tell the Police straight away if anyone is injured or there is a disagreement over who is responsible and call us straight away. 13. Information You agree that Cosy Campers may use any information you have given to carry out market research. If you break the agreement Cosy Campers can give the information to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. 14. Ending the Agreement 14.a: If you are a consumer Cosy Campers will end this agreement straight away if we find out that your goods have been taken away from you to pay off your debts, or a receiving order is made against you. We will also end this agreement if you do not meet any of the conditions of this agreement. 14.b: If you are a company, Cosy Campers will end this agreement straight away if: you go into liquidation, you call a meeting of creditors, we find out that your goods have been taken away from you until you pay off your debts, or you do not meet any of the conditions of the agreement. 14.c: If Cosy Campers end the agreement it will not affect our right to receive any money we are owed under the conditions of the agreement. Cosy Campers can also claim extra costs from you if you do not meet any of the conditions of this agreement. We can repossess the vehicle and charge you if we do this. 15. Governing Law This agreement is governed by the laws of the country in which it is signed. Any dispute may be submitted to the non-exclusive jurisdiction of the courts of that country. In certain cases the renting company reserves the right to appoint an Arbitrator.
