Terms & Conditions Definitions “Low Moor ” Means Low Moor Motorhome hire or agents acting on their behalf “The Hirer” Means the person named who is undertaking the booking. “Booking Confirmation” Means the confirmation and acceptance of your booking, issued by Low Moor “Driver” any person who is approved and authorised to drive the Motorhome “Rental Agreement” Means the agreement signed by you at handover of the vehicle. “The Hire Period” Means the period for which The Hirer has agreed to hire the Motorhome under the terms of this agreement, as specified at the time of booking and confirmed in the Booking Confirmation “Motorhome” the vehicle that The Hirer agrees to hire from Low Moor at the time of booking, as confirmed in the Booking Confirmation “Base” means the location from where The Hirer picked up the Motorhome and must return it to This Agreement is between Low Moor Motorhome hire and The Hirer The Hirer Contract with Low Moor By booking the Motorhome The Hirer is accepting these Terms and Conditions. Please read this agreement carefully. If there is anything you do not understand or do not agree with, please ask Low Moor for written clarification. By continuing with your Booking Confirmation The Hirer is agreeing to all Terms and Conditions detailed within. Booking Confirmation and Payment An initial payment of 20% of the total hire costs is required to confirm the booking, which is non-refundable. A binding contract for the hire will come into existence when Low Moor issues your Booking Confirmation. The balance of your hire money is payable six weeks prior to the start date of your hire, or at the time of booking if booked less than six weeks from the start date of your hire. Should these timeframes not be adhered to Low Moor may cancel your booking without notice and no monies received by Low Moor will be refunded. Cancellations If The Hirer decides to cancel, they must notify Low Moor in writing. If notification of your cancellation is received more than six weeks before the start date of The Hire Period, The Hirer will be liable only for the initial deposit payment of 20% and any other monies paid to Low Moor will be refunded. If notification of the cancellation is received less than six weeks before the commencement of The Hire Period all monies paid and due are not refundable and you are still liable for any sums not yet paid. Low Moor will do all it can to rehire the Motorhome and if they are able to do so, you will be refunded up to a maximum of your total hire less your initial 20% deposit payment and a £25 admin fee. You may wish to take out separate travel insurance in case of cancelation. Availability Occasionally the booked Motorhome is not available as agreed, which is almost always due to events beyond the Low Moor control (see below). Events beyond the control of Low Moor can occasionally affect bookings. When reference is made to such events, this means any event(s) or circumstance which we could not, even with all due care, foresee or avoid. Low Moor cannot and will not accept responsibility or pay any compensation, costs or expenses where the performance of your contract with us is prevented or affected or you otherwise suffer any loss or damage as a result of these events beyond our control. This includes any delays to and/or restrictions to The Hire Period to which The Hirer may be subject. If the booking has to be cancelled (which Low Moor reserves the right to do) Low Moor will offer you the choice of an alternative motorhome if available or, if no suitable replacement is available and your booking needs to be cancelled or delayed, Low Moor will refund each day of delay or a complete cancelation. The Hire Period, Collection and Delivery Times You will have the Motorhome for the Hire Period shown in the Rental Agreement. Unless otherwise agreed in writing by the Low Moor , the Motorhome will be available on the day of collection from the Base at 14.00hrs and must be delivered back to Base by 11.00hrs on the last day of The Hire Period. If The Hirer does not bring the Motorhome back on time The Hirer is breaking the conditions of this agreement. Late returns can have a significant impact on the next hire. If The Hirer fails to return the Motorhome on time The Hirer may be liable to additional charges of £50 per hour for each full hour or part thereof, plus any additional costs incurred by Low Moor as a result. There are no refunds for returning the Motorhome early. The Hirers insurance cover will expire at the time stated on The Rental Agreement so it is important that The Hirer returns the Motorhome promptly as failure to do so may mean that The Hirer is not insured and liable in full for any damage caused to the Motorhome and may be liable to prosecution for driving an uninsured vehicle. If due to unforeseen reasons The Hirer is going to be late, it is imperative to notify Low Moor as soon as The Hirer becomes aware. Motorhome systems Low Moor carry out a pre hire inspection (PHI) prior to the commencement of The Hire Period. The PHI involves testing every system on board the Motorhome to ensure that they are working correctly. The Hirer will be given a tour of all the systems prior to The Hire Period and shown how they work, this will take around an hour, please set this time aside when planning your onward journey. Should an on-board system fail during The Hire Period, Low Moor will make every effort to rectify this while The Hirer is away, should this not be possible, Low Moor cannot be held responsible and will not refund any monies should a loss of service be encountered nor will we be obliged to provide a replacement vehicle. In the case of winter hire, any issues of damage caused by freezing conditions will be the responsibility of the hirer. The Hirer, Suitable Persons and Drivers The Hirer must produce: A photo card driving licence which is registered to their current address Two forms of proof of address, dated within 60 days, one being a utility bill, the second can be a bank/credit card statement, council tax, mortgage statement, TV/phone bill. All of the addresses must match. All Drivers must be aged between 25 and 70 years Have held a valid full driving licence for more than 2 years and feel confident to drive a vehicle of dimensions >7.00m long, >2.4m wide and >3.1m high. In order to confirm the status of your driving licence each Driver will also need to bring their national insurance number or DVLA check code. All Drivers must be present at checkout of the Motorhome. All Drivers must produce a full, valid standard driver's licence. We are unable to insure you if we have not DVLA checked your licence details. The driving licence address must be the current home address of the driver. Any Driver whose licence is issued outside of the EU or Commonwealth are required to supply a valid International driving permit alongside their standard licence at the start of The Hire Period. This must be issued in the country in which their standard licence was issued and confirm that you are able to drive a UK category C1 vehicle up to 3650kg GMW. Should any Driver fail to present all correct documentation and identification on collection of the Motorhome or do not meet the driver requirements stated in the terms and conditions, then we will be unable to release the Motorhome and no refunds will be given. Endorsements on licences: The Hirer must declare at the time of booking if there are any endorsements on their driving licence. We can only insure Drivers who have a maximum of 6 penalty points on their licence for minor driving offences. For convictions including the following codes: AC, BA, CD, DD, DR, IN, LC, MS, UT, MR and TT a minimum of 48 hours’ notice must be given prior to The Hire Period as our insurance may not provide cover. Insurance claims: The Hirer must declare at the time of booking if The Hirer or any Driver have made or had any vehicle insurance claim made against them within the last 5 years. No exceptions can be made to any of the driving or insurance requirements and it is The Hirer and Drivers responsibility to ensure that they have the appropriate and relevant paperwork required and are able to produce original documents at the time of hire. Low Moor have the right to refuse to hand over the Motorhome to any person who, in our reasonable opinion is not suitable to take charge. In such cases, all hire charges paid will be refunded but Low Moor will have no further liability. Refusal will be based solely at our discretion and belief and may be based upon our perception of the Hirers ability, experience, mental state or competence to drive Security Deposit A deposit of £750 is payable to Low Moor prior to the commencement of The Hire Period against any loss, damage to the Motorhome (externally or internally), costs or insurance claims as described in these terms and conditions. The balance less deductions for damages will be returned to The Hirer via BACS within 3 working days from the date of the Motorhome return. Use of the Motorhome and The Hirer and Driver Responsibilities The Hirer or any other authorised Driver agree that during The Hire Period, they will not allow the Motorhome to be: Driven in anything other than a cautious, prudent and normal manner; Used in a manner that could cause damage to the Motorhome Driven in a prohibited area or an area not made known to Low Moor on the Rental Agreement; Driven by any person not named as a Driver by this Rental Agreement The Hirer or any other authorised Driver must not: Use the Motorhome for hire or reward Use the Motorhome for any illegal purpose Use the Motorhome for racing, pace making, testing the vehicle's reliability and speed or teaching someone to drive Use the Motorhome while under the influence of alcohol or drugs Drive the Motorhome outside England, Scotland and Wales, unless Low Moor have given you written permission Overload the Motorhome, the maximum weight that may be carried is 420kg. The Hirer or any other authorised Driver agree: To let Low Moor know as soon as they become aware of a fault in the vehicle To bring the Motorhome back to Base, at the time agreed. Low Moor or their agent must see and inspect the Motorhome and be allowed to check that it is in good condition, The Hirer remains responsible for the Motorhome until this time The Hirer will have to pay for repairs if: The Motorhome needs more than Low Moor standard valeting (cleaning) If the Motorhome is damaged, inside or out. The Hirer or any other authorised Driver must; Look after the Motorhome and the keys to the Motorhome Always lock the Motorhome when they are not using it Use any security device fitted supplied with the Motorhome Make sure that the correct fuel is used (Diesel). The Hirer must not; Sell, rent or dispose of the Motorhome or any of its parts or give anyone any legal rights over the Motorhome Let anyone work on the Motorhome without the prior permission from Low Moor . If permission is granted by Low Moor , this must be in writing. The maximum Low Moor will reimburse is £40 and this is on production of a valid receipt for works undertaken. Mileage is limited to 150 miles per full day or 1050 miles per full week of hire, additional miles are charged at .25p per mile Insurance (provided all the personal information supplied is correct) The Motorhome is insured for damage to the Motorhome and the property of a third party; but does not include any personal insurance for the Hirer or Driver (including death or bodily injury to the driver) or cover any personal possessions. A copy of the insurance policy is available from Low Moor on request. By confirming your booking the Hirer is accepting the conditions of the hire insurance policy. Please take care when driving and pay attention to height restriction signs, car park barriers and low hanging branches. Any damage to the Motorhome that is above 6ft (183cm) will be deemed as gross negligence therefore full liability will apply to The Hirer up to £50,000 and any loss of earnings by Low Moor for the time the Motorhome is unusable and/or being repaired up to a maximum of two weeks. Internal damages, Tyres and windows are not covered by the insurance and full liability by The Hirer will apply. Tyre Replacement There is a spare wheel under the Motorhome and in the event of tyre damage, this should be used first. If The Hirer needs to replace a tyre during The Hire Period, first speak with Low Moor to ensure that the tyre fitted is of the correct make and specification. Low Moor may at their discretion choose to replace any tyre that The Hirer has had fitted should it not be to the same make and standard as the tyre supplied at the start of The Hire Period. The Hirer will be responsible for the charges involved should Low Moor need to undertake this duty. For the safety of The Hirer and others who travel in the Motorhome, Low Moor do not repair punctures on any of our tyres, a replacement new tyre is always used. Black box and tracking The Motorhome may be equipped with a tracking device or a “black box” for monitoring where the Motorhome is and how it is being driven. Low Moor reserve the right to collect and recover the Motorhome without notice should we believe that the Motorhome: Will be returned late Is being or has been used in a reckless manner Being used in locations that have not been specified in this Rental Agreement Has been or is being used on unpaved or surfaced roads Should Low Moor need to recover a Motorhome, no refunds will be given for any loss of The Hire Period and the Hirer will be liable for recovery charges of £2 per mile each way from Base. Pets The acceptance of pets in the Motorhome will be at Low Moor discretion, agreement and subject to a pet surcharge. Pets are strictly not to be left unattended in the Motorhome at any point whatsoever and are not to be allowed on any of the upholstery. You will be liable for any charges to make good any damage that Low Moor believe have been caused by pets. Any signs of pets being on the upholstery will result in a £100 cleaning charge. Should a pet be in the Motorhome without Low Moor prior permission The Hirer will be liable to an additional charge of £100 Smoking All Low Moor motorhomes are non-smoking vehicles. Low Moor reserves the right to impose an additional £100 Valeting and or Upholstery cleaning fees and charge demurrage should any evidence of smoking be detected in the Motorhome. Breakdowns Breakdown cover is provided for The Hire Period, no responsibility can or will be accepted by Low Moor for any loss or damage or expense which occurs as a result of any defect or breakdown unless it is due to a proven reason of the Low Moor failure to adequately maintain the Motorhome in a fit state and condition. If The Hirer does breakdown: Contact the breakdown service that covers the Motorhome Inform Low Moor immediately Accidents No responsibility can be accepted by Low Moor for any loss damage or expense which occurs as a result of any accident. If The Hirer has an accident The Hirer or Driver must not admit responsibility. Make the Motorhome secure Contact the Police straight away if anyone is injured or there is a disagreement over who is responsible. There is an accident form in the Motorhome which must be filled in at the scene. Contact Low Moor immediately. It is important to do this as failure to notify Low Moor of an accident within 4 hours may invalidate the insurance and The Hirer could be liable for the repair or replacement of the Motorhome up to a maximum of £50,000 and any other third party costs Assist Low Moor in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence. If due, no security deposit or insurance excess or part thereof will be refunded in the event of an accident until any claim is settled. No refunds will be given for any loss of time within The Hire Period due to an accident regardless of who was at fault Charges Charges are based on Low Moor price list at the time of booking. The Hirer will be charged for: The rental and any other charges Low Moor work out according to this agreement; A charge for any loss or damage to the Motorhome (even if it is accidental or not the fault The Hirer) subject to an excess of £500 for each incident or accident; The Hirer must empty and clean the toilet cassette at the end of The Hire Period. There is a £75 charge for un-emptied or unwashed cassettes. The Motorhome will come with a full tank of diesel and must be returned with a full tank of diesel, filled up at a garage near to Base and a receipt produced. If this is not fulfilled by The Hirer then a refuelling charge of £20 will apply and fuel will be charged at £1.50 per litre. 2 Gas cylinders are in the Motorhome, at least 1 must be returned full, should The Hirer need to replace a cylinder during The Hire Period, this is the responsibility The Hirer. Low Moor can fulfil this for you at a cost of £40 for refilling The Hirer is responsible for all fines and costs (including court costs) for parking, traffic, congestion charges or other offences, (including any costs which arise if the Motorhome is clamped). The Hirer must pay the appropriate authority if and when the authority demands this payment. Any fines that come to Low Moor from within The Hire Period will be the responsibility of The Hirer to pay the relevant authority along with an additional £25 administration fee to Low Moor . The administration fee will be reapplied to each and every correspondence that we send in relation to the fines or charges. The Hirer is liable for any charges arising from Customs and Excise or Immigration Authorities seizing the Motorhome, together with a loss-of-income charge while Low Moor cannot rent out the vehicle. To any charges due to Low Moor that The Hirer does not pay to on time, interest which will be added every day at the rate of 4% a year above the base lending rate of HSBC. Any other charges as detailed in these terms and conditions The Hirer is responsible for all charges, even The Hirer asked someone else to be responsible for them. Terminating the agreement Low Moor may terminate this agreement if The Hirer is in breach of any term of this Agreement; The Hirer has obtained the Motorhome through fraud or misrepresentation; Any statement, representation or warranty made by The Hirer in respect to himself or additional Drivers is incorrect. The Motorhome appears to be abandoned The Motorhome is not returned to Base on the agreed return date or Low Moor reasonably believes that the Motorhome will not be returned to Base on the agreed return date; Low Moor considers on reasonable grounds that the safety of passengers or the condition of the Motorhome is in danger. The Hirer understands that in the event of such termination or repossession, The Hirer will have no right to a refund of any part of the rental charges or the Security Deposit and will also be liable for recovery charges at a rate of £2 per mile each way from base Release and Indemnity of Low Moor Subject to its obligation to supply the Motorhome or, if available, an appropriate substitute vehicle, The Hirer releases Low Moor , its employees and agents, from any liability (regardless of who is at fault) for any loss or damage incurred by The Hirer by reason of this Agreement, including but not limited to: Any loss or damage caused by breakdown, mechanical defect, accident or the Motorhome being unsuitable for your purpose; The Hirer hereby indemnifies and shall keep indemnified Low Moor , its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by Low Moor or its employees and agents by reason of The Hirers use and/or possession of the Motorhome. Data Protection Act and information The information that The Hirer has provided to Low Moor will be used to fulfil this contract placed with us. Low Moor will also pass your information onto our insurer. If The Hirer breaks the agreement Low Moor may give the information The Hirer has provided to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. Low Moor can also give this information to the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose stated in the Data Protection Act 1998. Governing Law This Rental Agreement is governed by the laws of England and The Hirer and Low Moor submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute arising out of this Rental Agreement. Entire Agreement This Rental Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. Low Moor reserves the right to add or amend the Motorhome specifications and rental charges without prior notice. This Rental Agreement does not affect The Hirer statutory rights under civil law
