Definitions: Freedom Motorhomes, we, us, our, means McKinnon Group Ltd trading as Freedom Motorhomes. You, Your, Yourself, Hirer, Driver means the person(s) listed and named in the Hire Document as the Hirer and includes all Additional Drivers as described on the Hire Document. Vehicle, means the vehicle described in the Hire Document (or any substitute vehicle if required) and includes but is not limited to its underbody, coach built body, parts, tools, components, accessories and contents supplied by us (except where specifically excluded). Rental Period means the period commencing on the date shown on the Hire Document and ending on the date that you return the Vehicle to us (For extensions the terms will be extended to the amended return date) Hire Contract: Your Contract is with Freedom Motorhomes. We agree that you may hire the Vehicle subject to the terms of this Agreement. You agree to comply with the terms of this Agreement and to pay the Fees to us. You should check the details of your booking confirmation to ensure it all reflects the booking you have requested and expect, and inform us immediately if there are any discrepancies, we cannot guarantee it will be possible to make changes later. Prices, terms of payment, security deposit: All prices are subject to change without notice. At the time of booking, you will pay the applicable deposit. All remaining balance must be paid 8 weeks before the date you will collect your vehicle. All payments must be in full, free of any bank charges. The security deposit of £1000 GBP must either be received together with the hire fee in the Freedom Motorhomes account or paid at the latest when the Vehicle is collected (MasterCard, Visa). No vehicle will be released without the deposit paid. Note the card holder must be a named driver. A payment of the deposit with Prepaid Credit Cards or cash is not possible. The Hirer has to pay the deposit, payments from anyone else will not be accepted and the vehicle will not be released. In the case of short-notice bookings (less than 56 days before hire commencement) the total hire charge will be due immediately. Freedom Motorhomes will reimburse the security deposit after the final hire account has been settled, as long as the Vehicle is returned as required. Any charges incurred in addition to the hire charge paid in advance by the Hirer will be deducted from the security deposit when the Vehicle is returned. If the Hirer defaults on payment, interest may be charged in accordance with the statutory regulations in force. Driver(s): You agree and acknowledge that: All drivers are aged between 25 and 75. Holds a full driving licence valid to drive in the UK and has not been disqualified. Has held a full driving licence for more than 2 years. Has not been convicted of any criminal / driving offences other than speeding and parking offences. Drivers must have no more than two convictions with a maximum of 3 points per conviction. The maximum penalty points on the UK licence is 6. The following conviction codes are not acceptable; BA,DD or UT. Declares any accidents on the driver declaration form after booking. Does not suffer from any physical or mental defects which would affect the driver’s ability to drive the vehicle in accordance with legal requirements and/or the driver has not been advised not to drive on medical grounds by the driver’s G.P. or other medical personnel. Has never been refused motor insurance. Is not employed in a ‘high risk’ occupation as defined by our insurer. Please contact us if you are in any doubt. Produces a valid driving licence upon collection of the vehicle. Licences from the following countries are accepted: all EU countries, USA, Canada, Singapore, Australia & New Zealand. Licence holder from other countries must receive approval from Freedom Motothomes prior to booking. It is your responsibility to check this before making a booking. Any cancellations resulting from a failure to meet the driver criteria will be subject to our standard cancellation terms (section 6) Authorises us to verify through credit agencies, the Driver and Vehicle Licensing Agency, his/her employer or any other sources his/her personal, driving and credit information. We may refuse to hire you the vehicle for any reason whatsoever at our sole discretion. All drivers must be declared at the start of your hire & named on your booking form. If you are unsure of any aspect of the above, you should contact us and we will check with our insurance company whether any premiums may apply. You acknowledge that it is illegal for an undeclared driver to operate a rental vehicle, as they will not be insured. In all cases the insurer has the final say. Where You Can and Cannot Drive the Vehicle: You must only use the Vehicle on sealed roads. You must not travel out with the following countries with your vehicle: The UK and all Member countries of the EU (European Union – Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom) plus Andorra, Iceland, Norway, Serbia and Switzerland. And if travelling outwith the UK mainland you must first seek prior permission from Freedom Motorhomes to confirm your insurance is valid. You are also responsible for understanding and adhering to the laws of each country you travel to. You must not drive or take the Vehicle: on any road which is closed or restricted; or on beaches; or through streams, dams, rivers or flood waters; or to any other area which we have, in our discretion, advised you not to enter. Use of the Vehicle: You must not: allow the Vehicle to be used for any illegal or dangerous purpose, race, contest or performance test of any kind if you do you may be charged up to an unlimited amount including fees to collect the vehicle; allow the Vehicle to be used to tow or push anything; carry more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle, or carry a greater load than that for which the Vehicle was built; permit passengers to travel in the Vehicle unless they are seated and are properly restrained with the seat belts provided in the Vehicle, and must only travel with the maximum number of passengers listed on the Hire Document; be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the country in which the Vehicle is driven; Allow the Vehicle to be used to carry passengers for payment of any kind or sublet or hire the Vehicle to any other person; use cookers inside the cabin of the Vehicle (excluding the motorhome) or in a dangerous manner; Freedom Motorhomes Terms & Conditions 2020/2021 transport any animal in the Vehicle other than a Dog, with prior permission and listed on the Hire Document; use the Vehicle when it is damaged or unsafe; use the Vehicle to transport goods other than those which would be reasonably contemplated in connection with the permitted purpose of the Vehicle without our prior written consent, use the Vehicle to carry any inflammable, explosive or corrosive substance other than that which has been provided by us; use the Vehicle in contravention of any law; transport any children in a manner which is not following the law set out in the country/countries visited. In the event of taking one of our vehicles to an unapproved country, the following will apply: You will not be covered under any Freedom Motorhomes insurance policy. Spot fine of up to £1000 may be applied at Freedom Motorhomes discretion per unauthorised country that you visit. Any cost including and not limited to theft and damage incurred to spaceships caused by your visit to an unauthorised country will be charged to you alongside an administration fee. Freedom Motorhomes reserve the right to terminate your hire immediately or request you to take the shortest and safest route back into a pre-approved country as authorised by Freedom Motorhomes. The Vehicle must be treated carefully and appropriately and properly locked on all occasions. The regulations and technical rules applicable to its use must be complied with. Its running condition, in particular oil and water levels and tire pressure, must be monitored. The Hirer undertakes to check regularly to make sure that the Vehicle is in a roadworthy condition All Vehicles are non-smoking Vehicles. This means that you may not smoke in any part of the Vehicle. Pets may only be brought along subject to Freedom Motorhomes explicit approval, and subject to the relevant fee. Cleaning expenses caused by non-compliance with regulations must be borne by the Hirer. Any costs which may be incurred by de-ventilation or for elimination of contamination with smoke, including lost profits resulting from temporary non-availability of the Vehicle for hire owing to these circumstances, shall also be borne by the Hirer Hirers Responsibility: The hirer accepts the following charges will be applied to the hirer’s credit/debit card: Accepts responsibility for all speeding/parking/toll infringements, and £30 processing fee for each speeding/parking/toll infringement transferred into the hirer’s name plus the cost of the fine where applicable; A minimum fee of £200 (£300 for the motorhomes) for any evidence of smoking odours in the vehicle plus the cost of days the vehicle is off the road; A minimum fee of £100 (£200 for the motorhomes) for returning the vehicle excessively dirty, with a stained interior and/or with rubbish left inside the vehicle: The repair of any damages to your vehicle or any third party vehicle as per the terms of your rental agreement; If any damage happens to the vehicle during a hire period when the hirer does not have a zero excess policy Freedom Motorhomes will apply a £30 admin fee. Maintaining water, oil and AdBlue levels is your responsibility. Any cost incurred will be reimbursed apart from AdBlue. Should any malfunction of the vehicle occur, any sign of overheating, you must stop the vehicle immediately or you will be held liable for the full cost of the repair. The full cost of replacing lost or damaged keys irrespective of the insurance option chosen. The full cost of repairing damage to the underside of the vehicle caused by driving off-road irrespective of the insurance option chosen. The cost of replacing any items/equipment/fittings provided with your Freedom Motorhome which have been damaged or lost. You have 24hrs to notify us if any items are missing/broken. Late returns will be charged for as per the rate in point 8. Luxury and Family Motorhome specific only: The full cost of repairing any damage to the water system caused by putting fuel in the water tank. This may be up to £10,000. Freedom Motorhomes do not supply or refund any LPG. However, any remaining LPG may be used free of charge. The full cost of any damage to the motorhome which occurs above 1.8 metres from the ground irrespective of the insurance option chosen. The full cost of any damage to the motorhome caused by reversing manoeuvres irrespective of the insurance option chosen. A fee of £150 if the toilet cassette has not been emptied. A fee of £75 if the grey wastewater has not been emptied Collection and Return of the vehicle. You will collect the vehicle at the time and location chosen on your booking. Please allow up to 1 hour for the hand-over process. All drivers need to be present on collection of the vehicle and bring their full valid licence, ID documents (passport or utility bill) and credit or debit card for security deposit (see section 3). Should any driver fail to present all correct documentation and identification on collection of the motorhome or not meet the driver requirements stated in the terms and conditions, then we will be unable to release the motorhome and no refunds will be given. UK licence holders must bring their paper or photocard licence along with a license check code from the DVLA. You will return the vehicle in a clean condition with a full tank of fuel, on the return date, on the time and at the location set out in the rental agreement or agreed separately. Please allow 30 minutes for the hand-over at return. You will return with the toilet cassette and the interior clean and in the same condition as they were at the start of the hire, otherwise a charge will be made for additional valeting and or upholstery cleaning, from £100. In addition, a separate toilet cleaning fee of £150 will apply if the toilet waste tank is not empty on return. Please see section 18, for further details. Please note: there are no toilet emptying facilities at any of our return locations so this must be emptied prior to return. Late return: If you will be late returning, you must advise us immediately. Failure to advise may result in prosecution for driving whilst uninsured. An additional charge of £80.00 per hour will be payable for all late returns. You should allow plenty of time to return on time as traffic congestion can occur during peak times and high season. Except as otherwise expressly provided in these terms and conditions late pick-up or early return of the vehicle does not entitle you to any refunds. In the event of an accident: After an accident, theft or damage by fire or collision with a wild animal, the police must be informed immediately, you must then notify Freedom Motorhomes immediately (for Telephone Number see rental contract), at the latest immediately after the working day following the day of the accident/incident. You are not permitted to accept any third-party claims as valid, all liability will be decided between the insurance companies. Even in the case of very slight damage, the Hirer must prepare a detailed written report for Freedom Motorhomes, including a sketch. If, for whatever reason, the Hirer fails to draw up such report and if, because of that, the insurance company refuses to pay the damage, the Hirer shall be obliged to pay full compensation for the damage. The accident report must in particular include the names and addresses of anyone involved and any witnesses, together with the license numbers of all Vehicles involved and has to be over handed filled out and signed to Freedom Motorhomes by drop off latest. If possible, also take photo’s at the time of the incident to assist your written report. Repairs, substitute vehicle: Repairs which are necessary in order to maintain the Vehicle in a good working and roadworthy condition during the rental period may be ordered by the Hirer up to £100 GBP without consultation. Repairs going beyond this may only be ordered with the consent of Freedom Motorhomes. Freedom Motorhomes will bear repair costs on production of the original invoices and the parts replaced, as long as the Hirer is not liable for the damage pursuant to Section 7 above. Freedom Motorhomes will not be liable for any tyre damage while you are driving the vehicle. If a defect for which Freedom Motorhomes is responsible makes such a repair necessary, and if the Hirer does not rectify the defect on his own initiative, the Hirer must notify Freedom Motorhomes of the defect immediately and set a reasonable deadline for its repair. Any circumstances specific to a particular country (e.g. infrastructure) which delay the repair must be taken into account here to avoid disadvantage to Freedom Motorhomes. If the Vehicle is destroyed without any fault on the part of the Hirer or if it appears likely that its use will be prevented or withdrawn for an unreasonably long time, Freedom Motorhomes will be entitled to supply the Hirer with an equivalent substitute Vehicle within a reasonable period, subject to availability. If Freedom Motorhomes supplies an equivalent substitute Vehicle, any termination by the Hirer is excluded. If in such a case Freedom Motorhomes offers a Vehicle from a lower price class and this is accepted by the Hirer, Freedom Motorhome will reimburse to the Hirer the difference between this and the price already paid in advance by the Hirer. If a replacement vehicle is not available, Freedom Motorhomes will not be held liable. If the Vehicle is destroyed due to the Hirer’s fault or if it is foreseeable that its use will be prevented or made impossible for an unreasonably long period due to the Hirer’s fault, Freedom Motorhomes may refuse to make a replacement Vehicle available. In such a case, termination of the contract by the Hirer is excluded. If Freedom Motorhomes provides a replacement Vehicle, it can charge the Hirer with the transfer costs incurred. Hirer’s Liability / Insurance: In accordance with the principles of a comprehensive motor insurance, Freedom Motorhomes will indemnify the Hirer from liability subject to an excess of £1,000 GBP per damage to be borne by the Hirer in case of damage subject to full comprehensive motor insurance per case of damage. The respective excess cannot be excluded. The indemnity against liability described in Subsection 11.1 will not apply if the Hirer causes a loss/damage deliberately or by gross negligence. If the Hirer causes loss/damage culpably, you will additionally be liable in the following cases: if loss/damage was caused by impaired ability to drive due to drugs or alcohol if the Hirer or a driver to whom the Hirer has supplied the Vehicle leaves the site of an accident without justification if the Hirer fails to call the police to an accident, contrary to the obligation imposed by Section 8, unless this breach of obligation does not affect either the establishment of the cause of the loss/damage or of its amount if the Hirer breaches any other obligations imposed by Section 9, unless this breach of obligation does not affect either the establishment of the cause of the loss/damage or of its amount if loss/damage is due to usage prohibited by section 6 if loss/damage is due to a breach of an obligation imposed by section 6 if loss/damage is caused by an unauthorized driver to whom the Hirer has supplied the Vehicle if loss/damage is due to a failure to take account of the Vehicle’s dimensions (height Scottish Road Traffic Regulations, with Scottish Road Traffic Regulations or equivalent country signs. if loss/damage is due to a failure to comply with load regulations To avoid increasing costs due to expenses incurred to establish the amount of the damage suffered, Freedom Motorhomes will in the event of accident damage initially supply the Hirer on request with sample invoices for the type of case concerned. The Hirer is liable for all fees, charges, fines and penalties imposed upon Freedom Motorhomes in connection with the use of the Vehicle, unless these are incurred due to the fault of Freedom Motorhomes. Freedom Motorhomes reserves the right to deduct the fees, charges, fines and penalties from the clients’ credit card. Additional handling charges are subject to the displayed pricing lists at the rental station. Freedom Motorhomes Liability, expiry by limitation: Freedom Motorhomes bears unlimited liability for deliberate action and gross negligence. In the case of simple negligence Freedom Motorhomes is only liable for foreseeable loss/damage typical of the type of contract concerned where there is a breach of an obligation the meeting of which is of particular importance for the achievement of the purpose of the contract (cardinal obligation). This standard of liability also applies in cases of obstacles to performance at the time of the conclusion of the contract. Claims which are not excluded according to paragraph 12.1 but were only limited in scope shall become statute-barred within a year of the end of the year of the claim being created and the circumstances justifying the claim and the debtor’s identity being disclosed to the creditor or the creditor, without gross negligence, being considered to be aware of such circumstances or identity. With the exception of claims for damages which are based on loss of life, physical injury, health hazards or the loss of freedom and claims based on the product liability act, claims for damages shall become statute-barred – with no consideration being given as to whether the creditor was aware of the circumstances and identity or, without gross negligence, should have been aware of such circumstances and identity – within five years of the end of the year in which the claim was created Freedom Motorhomes Terms and conditions apply. These are provided at the rental station during Pick Up and are published on our website. Additional price lists are published in each Rental Station. Storage and Forwarding of Personal Data: The Hirer agrees to the Rental Company storing personal data. Freedom Motorhomes may forward these data via the central warning ring to third parties with a justified interest if the statements made in the rental are incorrect in essential points or the rented Vehicle is not returned within 24 hours of the expiry of the rental period (also extended, if need be) or if rental claims have to be made in judicial reminder proceedings or cheques presented by the Hirer are not honoured. In addition, the data can be forwarded to all the authorities responsible for prosecution of offences against public order and criminal offences in the event of the Hirer actually behaves dishonestly or sufficient indications here for existing. This is done, for example, in the event of wrong information for the Hire, presentation of forged personal documents or such reported as having been lost, failure to return the Vehicle, failure to notify a technical defect, road traffic offences or similar. Tracking System: Freedom Motorhomes Vehicles can be equipped with Tracking Systems. Change of Vehicle: Freedom Motorhomes reserves the right, at its absolute discretion, to substitute a comparable or superior Vehicle for the Vehicle. Such substitution shall not entitle the Hirer to any refund and does not constitute a breach of this Agreement. Release and indemnity of Freedom Motorhomes: Subject to its obligation to deliver the Vehicle or an appropriate substitute Vehicle, the Hirer release to Freedom Motorhomes, its employees and agents, from any liability to the Hirer (regardless of who is at fault) for any loss or damage incurred by the Hirer by reason of this Agreement, including but not limited to; Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for my purpose. Any loss or damage to any property left in or on the Vehicle, in any service Vehicle or on any Freedom Motorhomes premises or recovered or handled by Freedom Motorhomes. Subject to any insurance arrangements agreed with Freedom Motorhomes, I hereby indemnify and shall keep indemnified Freedom Motorhomes, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle.
