Terms & Conditions of Hire by booking with Starsys Ltd (T/a Rent my Camper). You agree to the following Terms and Conditions. 1. Definitions and Interpretations: • This Agreement means the ‘Rental Agreement’, the ‘Insurance Motor Rental Agreement’ and these ‘Terms and Conditions’. • In the event of any discrepancy between these Terms and Conditions and any other Rent my Camper literature, the provisions of these Terms and Conditions apply. • The ‘Hirer’: The person who has booked and paid for the hire of the vehicle and is named on the Rental Agreement. • The 'Rental Period' means the hire period referred to under the heading 'Hire period' or any agreed variation thereof and any additional period during which the vehicle is in the customer's possession or control. • 'Vehicle' means the vehicle described on the website and includes tyres, tools, accessories, the living equipment and any other special equipment and documents related to the Vehicle. 2, To drive the hire VEHICLE, you need: • To be between 25 and 70 years of age. • To hold a full valid driver's licence, held for a minimum of two years with have a maximum of 6 points. • To have two forms of identity with also 2 proofs of current permanent address from the last 3 months (utility bill, bank statement etc.) • To be fit and capable to drive. • To provide a code from DVLA to enable relevant driver licence checks to be carried out 7 days prior to collection of the vehicle o https://www.gov.uk/view-driving-licence • No more than 1 fault accident in last 3 years. • No more than 2 motoring convictions in the last 5 years 2. Included in the price: • Mileage allowance of 100 miles per day. Excess Mileage will be charges at 45p per mile. (Rent my Camper may request details of proposed mileage prior and destination plans prior to booking) • A full tank of fuel (Hire vehicle must be returned with Full Tank of Diesel Fuel). Any difference will be charged at market rate + 10p per litre plus £25, this will be withheld from the security deposit. • UK breakdown cover. • Fully Comprehensive UK insurance for the first driver. Additional Drivers by request, these will be charged at insurance rates • On board equipment (see equipment list). 3. Security deposit: • A £1000 security deposit is required, this deposit must be paid 7 days prior to collection. o Payment link will be sent via email • The security deposit will be refunded in full within 7 working days of the end of the hire period, providing the vehicle is returned as follows: o To the agreed location no later than the agreed date and time. o In the same condition as it was let out to you. o With the interior & any equipment provided clean. o With a full tank of diesel fuel • Please note any damage to the campervan exterior or interior will be deducted from the security deposit accordingly. • Deductions will be made fairly and honestly for making good any damage to the vehicle or equipment that has occurred. • Where charges are levied, we will discuss these with you and provide you with an itemised invoice detailing any charges. • The following items are not covered by vehicle insurance and all associated costs will be the responsibility of the hirer. Whether out of the security deposit or by further payment if necessary: o Any deliberate or wilful act o Putting incorrect fuel in the vehicle o Windscreen/window damage o Locking keys in vehicle o Internal damage or breakage o Tyre / wheel damage or punctures o Any damaged caused by animals o Damage caused by cooking o Damage caused by driving Campervan into low barrier/car park entrance. (Minimum of 2.1m height clearance, 2.3m width clearance and is 5.1m length required. Bike Rack if hired adds 1m to length). 4. Vehicle Collection and Return: • Collection and return are to be arranged for each individual booking. • If you haven’t driven a van before, please ask us to take you for an accompanied drive to make sure you are comfortable driving the vehicle. • Remember to bring your photocard driving licence, and a recent utility bill with your name and address on it. Without these the insurance isn’t valid, and you won’t be able to drive away! • Your vehicle will be ready in a clean and roadworthy state, with a full tank of diesel. • Any minor scratches or defects will be pointed out on the day. • Please allow at least an hour for collection to enable us to complete all necessary paperwork and to demonstrate how to use all the features of the campervan. • If the vehicle is returned past the date and specified time, without prior written approval from Rent my camper. The hirer renders themselves liable to charges of £50.00 an hour. No refund is given for early return of vehicle. • Any damage or defects must be reported to us on return of the vehicle. 5. Payment and Cancellation: • A booking deposit of 25% is required to confirm your reservation. • The balance is due 6 weeks (42 days) prior to departure or at the time of booking if less than 6 weeks to departure. • We accept payment by Bank transfer or Credit / Debit Card. • If you cancel your booking o Prior to 42 days of departure, we will refund your 25% booking deposit. o within 42 days of departure, we will refund your hire charge excluding the 25% booking deposit • We recommend that you take out holiday insurance that covers cancellation fees. • In the unlikely event that the van is no longer available due to unforeseen circumstances a full refund will be given. 6. Rental Period Restrictions: • No one way rentals. Collection and return of the vehicle will be at Unit 21 Eden Business Park, Avalon Road, Kirton, PE20 1QR • Strictly no smoking. A £250 valeting charge will be deducted from the security deposit where there is evidence of smoking inside the hire vehicle or awning if hired. • The number of passengers is limited to the capacity of how many seatbelts in the van. Any booster seats or baby seats required are to be supplied by the hirer, The hirer is responsible for the safety and use of. • One small dog may travel with you for an extra charge of £30 to cover cleaning. • If the vehicle is returned and damage has resulted from carrying a pet o e.g. scratching of units, chewing, dirt/hair on the upholstery etc. • Then a standard charge of £150 will be taken from the security deposit to cover repair / cleaning costs. Should the damage costs exceed £150 then the remainder of the costs will be taken from the security deposit. • Pets not to be left in the van unaccompanied. • Please Note: If an animal has been transported in the vehicle without prior consent, then the whole security deposit of £1000 will be forfeited. • Road Restrictions: the vehicles may only be driven on sealed / bitumen roads / camp sites. • Rent My Camper reserves the right at any time, at its sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause. 7. Use of the Vehicle: The Vehicle is NOT to be: • Driven otherwise than in a cautious, prudent and normal manner; • Used in a manner which could cause damage; • Driven in a prohibited area or in an area other than the areas indicated by Rent my camper; • Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law; • Left open or unlocked whilst the vehicle is unoccupied. • Left with the ignition key in the vehicle while it is unoccupied. • Driven by persons under the age of 25 years or over the age of 71 or who are not authorised by law to drive the Vehicle or named in the Rental Agreement; • Damaged by submersion in water; • Put into contact with salt water; • Used for any illegal purpose for any race, rally or contest; • Used to tow any vehicle (including caravan) or trailer; • Used to carry passengers or property for hire or reward; • Used to carry volatile liquids, gases (other than the butane gas cylinders provided), explosives or other corrosive or flammable material; • Or otherwise used in breach of the Hirers obligations under this Agreement. • Not to be driven off road, unsurfaced roads or on roads unsuitable for the vehicle. 8. Insurance: • Standard Insurance Excess is £1500 and in the event of any damage to either the vehicle or to third party property, the hirer will be liable for the first £1500. • The hirer will be fully liable for replacement or repair of windscreen or tyre and wheel damage. • Any license endorsements or at fault accidents must be declared at the time of booking and any subsequent endorsements reported to us before hire. Our insurer may require additional fees or increased excesses for some endorsements or accidents. • It is a condition of the insurance that you must present your photocard driving licence and a DVLA ‘Check Code’ 7 days prior to collection. You will not be able to hire the vehicle until these conditions have been met. • Fully comprehensive insurance cover is included in the hire price for the first driver for the duration of the hire period for driving in the UK only. The vehicle is not permitted to be driven abroad and has no insurance to cover this. • Additional Drivers can be added and will be charged at insurance rates. • Details of additional drivers is required 7 days in advance of hire period. • Allowing someone else to drive without prior permission the van will mean the insurance is invalid. In the event the vehicle is seized by police due to invalid insurance as outlined above it’s the hirers responsibility to pay for any charges or fines associated with this. • Drivers are to be aged between 25 to 70 years old with a minimum of 2 years driving experience with a full UK driving licence for a manual vehicle. • During the booking phase we check the licence to meet our insurance criteria - should anything change to the licence after the initial check and before the hire date, it is the hirer/drivers responsibility to notify us so a further check can be completed to ensure you still meet the criteria. • Our insurance company may impose surcharges for certain medical conditions therefore you must inform us of any medical conditions you may have at the time of booking or prior to collection of the campervan or the insurance may be invalid. 9. Personal Safety: • Please note that it is the responsibility of the parent or guardian to ensure the safety of children while in or around the vehicle, particularly while using the upper bunk. • There are 3 seat belts fitted in the front of the campervan and 2 in the rear. • Do not use the gas stove to heat the van and always have a door/window open when using the indoor stove (this should only be used for boiling the kettle) • Cooking must be done outside on the stove provided. 10. Accidents and Damage: • Any damage to the interior or exterior of the hire vehicle will be repaired at the hirer's cost and be deducted from the security deposit. • There is a standard insurance excess of £1500 should you be involved in an accident. • In the unlikely event of a breakdown the vehicle has UK breakdown cover (details provided at time of collection) • In the event of a breakdown the hirer is permitted to spend up to £100 on minor essential repairs, although prior approval should always be sought from Rent my Camper. Any costs incurred by the hirer will be reimbursed on the production of a valid receipt. • If you lose a day’s holiday due to breakdown, we will refund you the cost of a day’s hire, providing the vehicle has been cared for and driven in accordance with the above. • Any call out charges incurred through operator error, e.g. flat vehicle battery, wrong or insufficient fuel, lost keys or keys locked in campervan will be the responsibility of the hirer. • It is the hirer’s responsibility to provide their own insurance to cover personal items and belongings and personal injury in the event of an accident. 11. Responsibility if an accident occurs: • In the event of any accident, loss or damage arising out of the use of the vehicle, or theft. • The Hirer will notify Rent my Camper within 2hrs of the event happening (M: 07795 177455 E: [email protected]), • The Hirer must obtain the names and addresses of third parties and any witnesses along with as many photographs as possible and report the event to the nearest police station. • The Hirer undertakes to assist Rent my Camper in handling any claim arising from any event, including providing all relevant information and photographic evidence and attending Court to give evidence. • No admission of liability to other parties, settlement offers, or other like offers must be made. • The excess or other amount due by the hirer of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period, regardless of which party is at fault. • No security deposit will be refunded until claim is settled. 12. Parking: • We provide free, off-road parking for customers vehicles. Vehicle are parked / left at the owner’s risk. Rent my Camper accept no liability for loss or damage to customers vehicles. 13. Data Protection. • Any personal information you give us will be kept confidential and will only be used by ourselves or our insurers in connection with your hire. • We may occasionally send you information about Rent my Camper offers or news, but we will not disclose your details to other third parties. • If you submit stories or photos to us in connection with your trip, you grant us permission to use such content on our website and in any other publications or online presence. 14. Variation. • Rent my Camper reserves the right to amend these terms and conditions, tariffs, specifications at any time. 16. Summary of Charges • Cost of rental. • The security deposit of £1000 • The nominated valeting fee £100 if the camper is not returned with the interior in a clean condition. • A standard charge of £150 deducted from the security deposit to cover repair / cleaning costs caused by pets. • Full forfeit of £1000 security deposit should a pet be transported in the vehicle without prior approval. • £250 valeting charge will be deducted from the security deposit where there is evidence of smoking inside the hire vehicle. • All parking fines, other fines or penalties, congestion charges / Tolls and associated administration costs incurred in relation to the vehicle during the rental period are the responsibility of the Hirer. • Any other fees or charges payable by the Hirer pursuant to this Agreement. This includes any costs incurred by Rent my Camper due to any breach by the Hirer of the terms of this Agreement. • Daily rental rate of £100 per day for the period the Vehicle is off fleet for accident repairs. • The cost of recovering a Vehicle that has become bogged. • Overtime charges of £50.00 an hour If the vehicle is returned past the date and specified time, without prior written approval from Rent My Camper Hire. • Fuel surcharge : Market rate + 10p per litre plus £25 should the vehicle be returned without a full diesel fuel tank. • The cost of any damage to the Vehicle or the property of any third party, subject to the insurance cover. • In the case of Gross Negligence, Rent my Camper reserves the right to recover full costs in order to return the campervan to the state in which it was handed over. Should any damages exceed the security deposit the hirer will be responsible for settling the additional costs in full
