Terms and conditions of Breakaway Campervan Hire Limited Hirer (Person making the booking or paying for the booking) Booking process: Make Enquiry online using our enquiry page or call us. We will reply back ASAP, if the dates are free, we will send a quote, Terms and conditions and list of documentation you will need to bring on the day of hire. If you are happy with the quote & Terms and conditions, simply reply back you wish to procced with the quote. We will send you an invoice for the non-refundable booking deposit of :£100.00, including any extras chosen (Payment via Bank transfer or credit/debit card payment). On receipt of the Deposit payment we will send you a Confirmation of your Booking and a receipt for the £100.00 payment. Balance of Booking is Due no later than 4 weeks prior to start date of the hire. A security deposit of £500 is required on or before collection day. Cancellation: In the event of a cancellation of the booking: A non-refundable deposit is taken to secure the booking. Cancellation less than 7 days before booking start date 100%, Prior to the 7 days deposit only taken. (Booking cancellation must be emailed to Breakaway campervan hire) Bookings can be moved up to 4 weeks prior to rental period starting, at no cost. Covid-19 cancellation policy: • Should a customer need to cancel a booking due to covid-19 restrictions; we will refund the booking value 100% of what has been paid to date. Or you have the option to move your booking (Should you move the booking to a date when the rate is higher, you will have to pay the additional cost, should the booking move to a date when the rate is lower, we will refund you the difference. ) • Breakaway Campervan Hire Ltd is not responsible for when customers are travelling between tiers, customers must check the tier levels on there journey. • Once the hire has started no refunds will be issued, should the hire be cut short due to covid restrictions. • Breakaway Campervan Hire Ltd are not responsible for any campsite, ferry or additional bookings our customers have made for their trip, should the hire of the vehicle be cancelled due to covid-19 restrictions or lockdowns. Security Deposit: No money will be taken from the security deposit upon safe return of the campervan/Motorhome, in the condition in which it was hired, Your deposit will be refunded with in 2 working days. Subject to a satisfactory inspection by us (Breakaway Campervan Hire Ltd). this must be paid to cover the possibility of damage (whether negligent, wilful, accidental or otherwise) or loss of the campervan or the fixtures, fittings therein or living equipment and windows, wheels, tyres etc included with the campervan/Motorhome. The campervan/Motorhome and its equipment must be returned to us in good condition, with no damage to it, its contents or third-party property. Should any damage (whether negligent, wilful, accidental or otherwise) or loss of the campervan or the fixtures, fittings therein or living equipment and windows, wheels, tyres etc included with the campervan/Motorhome, (Breakaway campervan Hire Limited) Will send a report out detailing any charges or deductions from your security deposit with in 5 working days. Should you be involved in an accident with the vehicle, our insurance may ask you to fill out one of their accident report forms. Collection and Return: When you arrive to collect your campervan/Motorhome, please bring all documentation we have requested and allow at least 30 minutes for vehicle inspection, and for us to show you around the van, how to drive the campervan/Motorhome, and how to operate the cooker, sink, fridge, roof, camping gas, water storage and other accessories. We will also need to complete any outstanding paperwork in that time. Vans are available for collection from 2:30pm on the pickup day and must be returned no later than 11:30am on the return date. Please return the campervan/Motorhome by the agreed time. Please allow sufficient time to get back to our base so that you do not push the campervan/Motorhome too hard trying to get back in a hurry. If at any time we have agreed that you may return the campervan/Motorhome to a place other than our office address, or if we have agreed to collect it, you will remain fully responsible for the campervan/Motorhome until it is collected by us or Breakdown assist. You are responsible for any costs incurred in returning the campervan/Motorhome to our Location should you abandon the vehicle. We will not refund the hire charge if the campervan/Motorhome is returned prior to the return date due to weather, personal circumstances or any other reason whatsoever. Late Return: If a campervan/Motorhome is returned to our premises later than the agreed time, without our prior agreement, £35 per hour will be payable. You will also be affecting the holiday of the next person to hire your campervan/motorhome. Should the late return of the campervan/Motorhome make us liable for extra costs, we reserve the right to pass on these costs to you. Charges and costs for late return will be deducted from your security deposit. By signing the Agreement, you agree to us making such deductions. Should the late return be due to accident you will be liable for any revenue lost due to the van being unavailable for hire. No refund is given for early return of the vehicle. The vehicle will be inspected upon return and any damage or missing items marked on the vehicle return form, you will be asked to sign the form. Rental Agreement: Upon collection of the campervan/Motorhome each driver will be asked to sign the Rental agreement, doing so means you agree to hire under these Terms & Conditions, and agree the information on the Rental agreement form is accurate. Vehicle return form: Upon return of the vehicle , you will be asked to inspect the vehicle with our representative, and sign the return form stating any damage or missing items if any noted. Insurance criteria (each driver) 1) Drivers are aged between 25-75 years of age. 2) All drivers have held a full UK or EU Licence for a minimum of two years. 3) Has not had their licence suspended for any period of time within the last 3 years. 4) Has not been involved in more than one fault incident within the last three years. 5) Has no more than Two convictions with the maximum of 3 points per conviction. 6) Has not obtained a BA, DD or UT conviction. 7) You Have no medical conditions which may affect your ability to drive safely which you are required by law to inform DVLA about. Documentation to provide: (each driver) 1) Uk/Eu driving licence photo card copy. 2) Online licence check- https://www.viewdrivingrecord.service.gov.uk/driving-record/licence-number 3) Two forms of proof of address (must meet all mentioned below criteria) The following documentation is acceptable for proof of address alongside the drivers licence You must provide the following:- 1 Utility bill/statement (primary form of proof) 1 Of the documents listed below (secondary proof) Key document criteria:- Both must be dated within90 days of the hire date The address & name on your licence must match both documents What is acceptable:- Utilities are as follows: Electricity, Water, Gas, Broadband, Council tax or Landline 1 Of the following alongside a utility:- Tv/internet/landline telephone bill (Including Sky/Virgin/BT etc) Bank or Credit Statement Credit card bill/ statement Mortgage/pension statement HMRC & DWP documentation is acceptable in addition to one valid utility bill/utility statement Mobile Phone Bills What is declined:- Any document relating to insurance. Any document that does not meet the above mentioned criteria- please contact us if you are unsure. Fuel Policy: The van must be returned with a full tank of Diesel fuel, and will be supplied with a full tank of Diesel fuel. Should you return the van with insufficient fuel, we will bill you for the fuel required to fill the van up and an admin fee for this process of £25. Should you fill up with the wrong fuel, you will be liable for any damage or costs incurred. Smoking Policy: We have a strict no smoking policy in our campervans/Motorhomes. Should you have been found to be smoking in our campervans/motorhomes we will charge an additional fee of: £50 to cover additional cleaning of the vehicle. Driving: It is the driver’s responsibility to obey and adhere to all UK/European road laws and regulations, and check the vehicle condition prior to driving the vehicle. Our Campervans/Motorhomes must not be raced, used to transport goods or equipment. They are only to be used as a campervan/Motorhome. Extra care should be taken when entering/Exiting Gateways, negotiating around buildings, country lanes and steep inclines (eg: roll-on/ roll-off Ferries, where there is a risk of grounding the rear). Such damage is not covered by the insurance and the hirer will be responsible for all repair costs. Children: It is the responsibility of the person/ driver of the campervan to make sure child seats are supplied and used for children. (Breakaway campervan hire does not provide car seats) Passenger(s): Passenger must not move around the campervan/Motorhome when the vehicle is being driven on public roads. Pets: We allow max of 2 dogs in our Campervans/Motorhomes, we charge £24 per Dog per booking. Only pets declared on the booking form and that we confirm are acceptable may be brought into the campervan/Motorhomes. Any damage caused by animals will be charged to you. You must comply with all current laws for transporting pets, and pets must not be left alone in our campervans/Motorhomes unattended. Dogs are not allowed on the seats or beds of the campervan/motorhomes. Should we find out you have had any undeclared pets in our campervans/motorhomes, we will bill you a cleaning fee of £50. Customers own Vehicle: Should you wish to leave your vehicle at our premises while you are away, Breakaway Campervan hire Limited accept no responsibility or liability for your vehicle. Carbon Monoxide & Smoke alarm: All our campervans/Motorhomes are fitted with carbon monoxide alarm & Smoke alarm , these will be test prior to you collecting the campervan/Motorhome. Camping Toilet/cassette Toilet: Motorhome cassette toilet or campervan camping toilet must be emptied at a designated Elson disposal point on campsite. Bike Rack: We do offer bike racks as an optional extra for our campervans/Motorhomes, these must be inspected regular during your trip. Gas Bottle: Your hired Campervan/Motorhome will come complete with a full Gas Bottle, the gas must be switched off at the bottle when the vehicle is being driven, and when the gas is not in use. Pop up roof vw campervan: Or campervan is fitted with a pop-up roof, this must be lowered and secured prior to driving the campervan. How to lower, raise and secure the roof will be demonstrated when you collect the vehicle. Return of left items in campervan/motorhomes: We will contact you should we find any items of yours left in the campervan/Motorhome; we can arrange to have them sent to you at an additional cost. Vehicle Dimensions: Vehicle Dimensions are on the driver’s side sun visor. Lost Keys: Should you lose or damage the campervan/Motorhome keys, we can provide additional keys at a cost to you. You must lock the campervan/Motorhome at all times when not in use. Tyres: Tyres You agree that the tyres on the Van are visibly sound and appear within legal limits. Should you experience a tyre problem, please call us and we can arrange a tyre service company to come out to you. Should it to be found out that you have damaged the tyre you will be responsible for the cost incurred, should the tyre be defective or worn we will cover the cost of the repair. Tyres should be visually inspected prior to driving the campervan/Motorhome. Vehicle insurance Tracking: All our campervans & Motorhomes are fitted with trackers, this is a term of our insurance policy. Cleanliness: Should the Campervan/Motorhome be returned in such a Dirty/unhygienic state (Either external or Internal) to what we at Breakaway campervan hire Ltd deem as (normal/usual). The Hirer(s) may have to pay an additional cleaning fee to cover the additional time required to prepare the vehicle for our next customers. £25 per hour. Should this affect our next customers booking, we reserve the right to pass on any additional charges we may incur. Faults/Problems: Should any problems/Faults arise during the hire of the Campervan/Motorhome, Breakaway Campervan Hire Ltd will do its upmost to assist in repair/Diagnose any Problems, sometimes this may not be able until the Campervan/Motorhome returns to our Depot. Breakaway would appreciate if any problems/Faults arise, you could inform us so we can facilitate sourcing repair or replacement items ASAP. Vehicle warning lights: Should any vehicle warning light appear on the vehicle dash, please inform us immediately. The vehicle handbook is located in the vehicle and this will give you a description of the warning light. Should you keep driving the vehicle and you have not informed us, and damage caused to the vehicle will be passed on to you. Breakdown: Should you experience a breakdown in one of our campervans/Motorhomes please notify us immediately. All our campervans/Motorhomes are covered by 24hr roadside breakdown assist. Should the breakdown turn out to have been caused by the hirer doing something untoward then the hirer may be liable to pay any costs incurred. A replacement van may be offered but this will be subject to availability. Where a replacement is not available, we will be responsible for your reasonable and foreseeable costs/expenses arising from the breakdown unless caused by your negligence. Our liability extends to either replacing your van with a similar one or refunding your hire charge for any days you lose the total use of the vehicle. You will need to return to the workshop, preferably with the Recovery service returning your original campervan/Motorhome, to collect a replacement vehicle, if one is available. If you have caused the breakdown through your own actions you will be liable for all costs incurred and we will not refund you any unused days of hire. If you have broken down you must remain at a safe distance from the Campervan/Motorhome until the Roadside assist arrives. You may not abandon the Campervan/Motorhome at the roadside. You must hand over the keys to the authorised Repair/Recovery Vehicle Driver. If you abandon the vehicle, we will deduct any transport and labour costs incurred in returning the van to our workshop and any costs arising from loss or damage to the van whilst it is unattended from your Security Deposit. Prohibited use of van: You are authorised to drive the Campervan/Motorhome on the conditions of this Agreement including, at all times, to use the Campervan/Motorhome in a responsible manner. If you do not comply with these conditions, you will be liable to Breakaway Campervan Hire Ltd for any liability or loss incurred by Breakaway campervan Hire Ltd or any damages or reasonable expenses we suffer or incur as a result of your breach of the Agreement. You may additionally lose the benefit of any waivers or insurance selected by you. We reserve the right to take back the van at any time, and at your expense, if you are in breach of this Agreement. You must look after the vehicle, make sure it is locked, secure and parked in a safe place when not in use. You must use seat belts, child seats and other child restraints as appropriate and required by law. Accidents, Theft or Vandalism: You must, where possible, report any traffic accident involving the Campervan/Motorhome to the police and us (Breakaway Campervan Hire Ltd) immediately and report loss, damage or theft involving the Campervan/Motorhome to the police and us (breakaway Campervan hire Limited) within 24 hours of the incident or discovery of the incident. Our insurance requires that you must not admit to any liability, release any party from liability, settle any claim or accept any disclaimer in the event of the accident, but should, if possible, take the names and addresses of everyone involved, including witnesses, car registration numbers, together with all the details of the accident, time, place, how it came about, damage to vehicles etc. If you have a camera or smart phone, take photos of the scene. Please do not move the vehicles before the police arrive, as long as keeping them in situ is a safe thing to do. An accident or theft report form must always be completed and submitted to Breakaway campervan Hire Limited when you return the Campervan/Motorhome or within 3 days of return of the vehicle, containing all the above information, plus diagrams if possible. In the event of theft, you must return the keys to us where possible. You agree to cooperate with Breakaway campervan Hire Ltd and our insurers in any investigation or subsequent legal proceedings, providing evidence and attending court if necessary, arising out of any loss of or damage to the vehicle. Return of items left in the campervan/Motorhome We will be happy to return your belongings left in the campervan/Motorhome at an administration charge of £10 plus postage for each item. This will be deducted from your security deposit or invoiced as necessary. Your Liabilities You are personally liable for all road tolls, fines and legal penalties (e.g., parking tickets, speeding) which are incurred during your period of hire. Any charges subsequently notified to Breakaway campervan Hire Ltd, will be immediately communicated to you for payment within their terms. By signing (or confirming online) this Agreement, you accept this. You are liable for any losses or damage caused by you and/or your group and we cannot accept liability for any losses or damage or liability caused by you to yourselves or third parties, or their property. You are liable for any damage above cab height – you are fully responsible for damage caused by failure to assess the height of the van and striking overhead or overhanging objects. You will indemnify Breakaway campervan Hire Ltd against any liability, caused by damage to overhead or overhanging objects and subsequent damage to third parties and their property. You will also be responsible for any damage to third parties and their property that arises through your negligence; for example, and without limitation: damage caused through loaded luggage and cycles. You must use the van and its contents responsibly and comply with our instructions. Where no instructions or advice or guidelines are given you must assume that ‘normal’ and ‘common sense’ rules apply. Loss or Damage: You will be liable to Breakaway campervan hire Ltd for all losses and costs incurred by Breakaway campervan Hire Ltd in the event of loss, damage to or theft of the vehicle, its parts or accessories, while on rental, if this damage, loss or theft involves the deception of or by you or another party, or as a result of the keys remaining in the van whilst it is unoccupied, or was caused intentionally or negligently by you or your party. Your liability may include the cost of repairs, loss in value of the vehicle, loss of rental income, towing and storage charges and an administration charge, which recovers our costs for handling any claim arising from damage caused to the van unless responsibility for the damage lies with Breakaway Campervan Hire Ltd or has been determined by a third party or their insurers to lie with the third party. You will not be liable to Breakaway Campervan hire Ltd for any charge or excess if the loss or damage is directly due to our negligence or our breach of this Rental Agreement. You will be liable for the loss or damage to any in- car entertainment equipment – cover for these items is not provided by our insurers. Your Liabilities You are personally liable for all road tolls, fines and legal penalties (e.g., parking tickets, speeding) which are incurred during your period of hire. Any charges subsequently notified to Breakaway Campervan hire Ltd, will be immediately communicated to you for payment within their terms. By signing (or confirming online) this Agreement, you accept this. You are liable for any losses or damage caused by you and/or your group and we cannot accept liability for any losses or damage or liability caused by you to yourselves or third parties, or their property. You are liable for any damage above cab height – you are fully responsible for damage caused by failure to assess the height of the van and striking overhead or overhanging objects. You will indemnify us against any liability, caused by damage to overhead or overhanging objects and subsequent damage to third parties and their property. You will also be responsible for any damage to third parties and their property that arises through your negligence; for example and without limitation: damage caused through loaded luggage and cycles. You must use the van and its contents responsibly and comply with our instructions. Where no instructions or advice or guidelines are given you must assume that ‘normal’ and ‘common sense’ rules apply. Breaches of these Terms and Conditions If you commit a breach of these Terms and Conditions or our Health and Safety Guidelines, we will have the right to terminate your booking without notification, and if you are already in the van, we may require you to return or vacate it immediately. In the event of you committing a breach of these Terms and Conditions no refund of the fees you have paid will be returnable to you. You will also be liable for any costs incurred in returning the van to our home base. Breaches in our Terms & Conditions or Health and Safety Guidelines may invalidate your insurance and you will be liable for all losses howsoever sustained including claims by third parties. Our Liability to You We will only be liable for any loss or damage suffered by you or any member of your party or to your or their property, where such loss or damage is due to our negligence. Where you are a customer acting in the course of a business, this paragraph shall apply instead of the one above. (You will have obtained our permission and that of our insurance company to use the van for business purposes.) We do not accept liability to customers acting in the course of a business for losses of profits, business, contracts, goodwill, anticipated savings, expenses, or other similar losses, for any reason whatsoever. To the extent permitted by law and except in the case of personal injury or death resulting from our negligence, the maximum limit of our liability to business customers, whether in contract, tort, negligence, breach of statutory duty or otherwise shall be the price agreed to be paid by you for the right to use the van for the period agreed. Whole Agreement These Terms and Conditions override and supersede all previous versions and any previous course of dealing between the parties and incorporate the whole Agreement together with any insurance conditions notified to you at the time of hire or collection (and which are available to view at our home base). In the event of any inconsistency between these Terms and Conditions and any other of our literature, whether found in our brochure or on our website or otherwise, the provisions of these Terms and Conditions will prevail. If any provision of these Terms and Conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from this Agreement and rendered ineffective as far as possible without modifying the remaining provisions of this Agreement, and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions. Personal Data When you book your campervan, we collect personal information such as your name, email address, home address, telephone number, credit or debit card number, security code and the card’s expiry date. This allows us to book the campervan and insurance for you. We will also collect non-transactional data should you enter a competition, request a brochure or take part in a survey, for example. We may use the information that we collect to occasionally notify you about news and information we think you may find valuable. For example, we may send you our latest brochure, supplements, newsletters and special offers. If at any stage you decide that you would rather not receive such information, please contact us by telephone, email or post. We reveal your identity information to our insurance company. We will not sell your information to another company. Governing law and jurisdiction We and you agree that the Agreement and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of England and Wales. We and you irrevocably agree that the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Agreement or its subject matter.
