COHEN'S CAMPERS LTD - TERMS & CONDITIONS COHEN’S CAMPERS LTD — TERMS & CONDITIONS (2026 EDITION) Governing Law: Applicable across Scotland, England & Wales These Terms & Conditions form the legally binding agreement between Cohen’s Campers Ltd (“the Company”, “we”, “us”, “our”) and the Hirer/Driver/Customer (“you”, “your”). By booking, paying for, collecting, or operating a vehicle from Cohen’s Campers Ltd, you agree to all terms below. These Terms supersede all previous versions. 1. DEFINITIONS Vehicle: The campervan or motorhome hired under this agreement, including all accessories, fixtures, fittings, equipment, and inventory. Hirer/Driver/Customer: The person(s) named on the Rental Agreement. Rental Agreement: The document signed at collection and return, including vehicle details, hire dates, inventory, and condition reports. Security Deposit: The refundable deposit held against damage, loss, cleaning, late return, negligence, or breach of contract. Negligence: Any action or inaction that a reasonable person would consider careless, unsafe, or avoidable, including but not limited to misfuelling, roof strikes, reversing damage, interior staining, improper waste disposal, and ignoring warnings or instructions. 2. DOCUMENTATION & ELIGIBILITY 2.1 Required Documentation (UK Drivers) You must provide: Photocard driving licence (address must match proof of address) Online licence check code Two proofs of address dated within 90 days Primary: Utility bill (gas, electric, water, broadband, council tax) Secondary: Bank/credit card/mortgage statement, TV/landline/internet bill Signed Rental Agreement Cleared Security Deposit Insurance documents are not accepted as proof of address. 2.2 Non‑UK Drivers You must provide: Full driving licence from country of residence International Driving Permit (if licence not in English) Passport Proof of address matching licence (if applicable) Signed declaration of points/endorsements 2.3 Age & Licence Requirements Minimum age: 21 Maximum age: 79 Minimum driving experience: 2 years Maximum points: 6 minor points (any more is subject to insurer approval) 2.4 Right to Refuse Hire We may refuse hire or cancel a booking if: Documentation is missing, invalid, or inconsistent Payment or deposit is not received Identity verification fails We suspect fraud or misuse The hirer behaves abusively or unreasonably The vehicle becomes unavailable due to mechanical issues We are not required to provide a reason. 3. RESERVATIONS & PAYMENT All prices are in GBP. Payment accepted by bank transfer, PayPal, or cash (if agreed). Vehicle will not be released without full payment and valid ID. A non‑refundable £250 reservation fee applies to all bookings. This is to cover loss of revenue if cancellation occurs 4. SECURITY DEPOSIT 4.1 Deposit Amounts Age 21–22: £2000 Age 23–24: £2000 Age 25–75: £1500 Age 76–79: £2000 4.2 Deposit Use The deposit covers (but is not limited to): Insurance excess Damage (interior, exterior, undercarriage, roof, tyres, wheels, glass) Misfuelling Waste system contamination Lost keys Lost hire days due to damage Cleaning fees Pet hair removal Odour removal Missing inventory Administrative fees Late return charges 4.3 Deposit Return Returned within 14 days (usually 72 hours) if: No damage Vehicle returned clean Toilet cassette emptied and rinsed Waste tank emptied Fuel tank full All inventory present and undamaged 5. INSURANCE 5.1 Cover Provided Fully comprehensive insurance for one named driver Additional drivers: £10/day (must be insured for full hire period) European cover available for an additional fee 5.2 Insurance Does NOT Cover You are fully liable for: Windscreen damage, chips, cracks (unless protection package taken pre-hire) Tyre damage, punctures, blowouts (unless protection package taken pre-hire) Misfuelling Damage to roof, awning, skylights, or high‑level components Undercarriage damage Interior damage, stains, burns, odours Theft when keys are left in/on the vehicle Personal belongings Damage caused by negligence or misuse 5.3 Insurance Invalidated If An unauthorised driver operates the vehicle You fail to report an accident You drive under the influence of alcohol/drugs You exceed legal limits (zero alcohol in Scotland) You leave keys in/on the vehicle 6. HIRER RESPONSIBILITIES You agree to: Drive safely and legally Check vehicle height and avoid low bridges/trees Use only sealed/bitumen roads Never off‑road Never tow Never carry more passengers than seatbelts Never use the vehicle for hire/reward Never carry hazardous materials Never cook strong‑smelling or staining foods without ventilation Never put oil, food, wipes, or foreign objects down sinks or toilets Never operate water heaters without water Report damage immediately Report any warning lights or messages on the vehicle 7. PROHIBITED USE The vehicle must NOT be: Driven recklessly or dangerously Driven in prohibited areas Driven during severe weather warnings Driven through floodwater or saltwater Used for racing, rallies, or competitions Used for illegal purposes Used by anyone under 21 Used by anyone not named on the Rental Agreement 8. BREAKDOWN & RECOVERY Full breakdown cover is provided only if purchased. You may authorise repairs up to £50. Repairs above £50 require our approval. If breakdown is caused by negligence, you are liable for recovery costs. 9. CLEANING & WASTE DISPOSAL FEES Standard cleaning fee (if required): £40 Pet cleaning fee: £50 Toilet cassette not emptied & rinsed: £100 Odour removal (smoke, strong food smells): charged at cost Deep cleaning for stains: charged at cost 10. LATE RETURN FEES £25 per hour after 11am Full daily rate charged after 3pm Unauthorised late returns may incur additional lost‑hire charges 11. TRAFFIC VIOLATIONS You are fully liable for: Parking fines Speeding fines Toll charges Congestion charges Bus lane fines We may charge an administration fee for processing fines. 12. DAMAGE, LOSS & LIABILITY 12.1 Hirer Liability You are liable for: All damage caused by negligence All damage not covered by insurance All costs exceeding the deposit if terms are breached Lost hire days due to damage or negligence Recovery/towing caused by misuse Misfuelling (diesel in water tank or vice versa) Roof strikes Undercarriage damage Interior damage 12.2 Company Liability (Limited) To the fullest extent permitted by UK law, we are not liable for: Loss of personal belongings Loss of enjoyment Missed ferries, flights, or accommodation Costs arising from breakdowns Weather‑related disruption Third‑party services (campsites, ferries, attractions) Indirect or consequential losses 12.3 Indemnity Clause You agree to indemnify and hold Cohen’s Campers Ltd harmless against: Claims arising from your use of the vehicle Damage caused by your negligence Fines, penalties, or legal costs Third‑party claims Damage & Liability Customer Responsibility for Damage The Customer is liable for any damage caused to the Goods, Equipment, or Property belonging to the Company, whether through misuse, negligence, improper handling, or failure to follow instructions provided by the Company. Replacement Parts & Materials Where damage results in the need for replacement parts, components, or materials, the Customer is responsible for the full cost of such items. Pricing will be based on the Company’s standard rates or the cost of sourcing equivalent replacements. Labour & Associated Costs In addition to the cost of replacement parts, the Customer is liable for all labour charges associated with diagnosing, repairing, and fitting the replacement items. Labour will be charged at the Company’s prevailing hourly rate unless otherwise agreed in writing. Additional Costs Arising From Damage The Customer is also responsible for any reasonable additional costs incurred by the Company as a direct result of the damage, including but not limited to: Call-out fees Travel expenses Specialist subcontractor fees (where required) Administrative or inspection charges Delays Caused by Damage Any delays to the Company’s work schedule resulting from damage caused by the Customer may incur additional charges. The Company reserves the right to recover costs associated with lost time, rescheduling, or disruption to planned works. Refusal of Service The Company reserves the right to refuse or suspend services where damage caused by the Customer creates unsafe working conditions or where the Customer fails to accept responsibility for the costs associated with repair or replacement. Payment Terms All costs arising under this Damage & Liability section must be paid by the Customer in accordance with the Company’s standard payment terms. Failure to do so may result in suspension of services or legal recovery of outstanding amounts. 13. CANCELLATION 13.1 By Hirer More than 30 days before hire: booking fee forfeited 30–14 days before hire: 50% of remaining hire cost 14 days or less: 75% of remaining hire cost £250 reservation fee is always non‑refundable 13.2 By Company We may cancel due to: Invalid documentation Non‑payment Fraud concerns Vehicle unavailability Safety concerns Refund limited to hire fees paid (excluding reservation fee). We are not liable for consequential losses. 14. FORCE MAJEURE We are not liable for delays, cancellations, or failure to perform due to events beyond our control, including: Severe weather Natural disasters Strikes War or terrorism Government restrictions Mechanical failure 15. DATA PROTECTION We retain your details for: Insurance compliance Traffic violation processing Fraud prevention Data is stored securely and deleted when no longer required. 16. GOVERNING LAW This agreement is governed by the laws of Scotland, England & Wales, depending on where the dispute arises. Any disputes shall be resolved in the appropriate UK jurisdiction. 17. ACCEPTANCE By booking, paying for, collecting, or driving the vehicle, you confirm that you: Have read and understood these Terms & Conditions Agree to be bound by them Accept full responsibility for the vehicle during the hire period
