Booking conditions If booking online or by phone the booking dates are only reserved on receipt of the booking deposit of £150. The booking deposit reserves the hirer's dates until 8 weeks before the rental date. Full payment is required at this time and the booking deposit is no longer refundable. Cancellation of your booking: A cancellation within 1 week or less of the start of the rental agreement you are liable for the full rental price. If cancelled 0-4 weeks before the start of the rental period you are liable for 100% of the rental price. If cancelled 4 - 8 weeks before the start of the rental period you are liable for the booking deposit. If the booking is cancelled more than 8 weeks before the start of the rental period a full refund is given. amended by R simpson 31/07/12 Security deposit: A security deposit of £750 is required on collection of the vehicle. This is payable by cash or guaranteed credit card voucher. The security deposit covers insurance excess in the event of an own fault accident and any damage the hirer cause to the vehicles, and its contents, which is not covered by the insurance policy and is caused by the hirers negligence. On return of the vehicle and its contents, the security deposit will be refunded within 5 days after a satisfactory inspection carried out by Bay Campers. The security deposit will also be used to cover late return charges; fill the vehicle with petrol if required; any specialist cleaning required. Where any charges are taken out of the hirer's security deposit a full itemised bill will be provided. If the hirer's security deposit does not cover any of the costs incurred by Bay Campers due to any damage caused by the hirer then the hirer will be required to pay the outstanding balance. Extra charges: Bay Campers will supply the vehicle with a full tank of petrol. If the vehicle is not returned with a full tank we charge the cost of the petrol plus a £20 service charge. The hirer will be charged a late return charge of £40 per hour and will be eligible for any costs incurred by Bay Campers if the late return impacts on the next person's rental period Any fines arising from parking or traffic offences during the hirer's rental period are payable by the hirer. Insurance: Sometimes Bay Campers will incur additional costs for insurance. This may be due to the hirer's traffic convictions, drivers on foreign licenses, people younger than 25 or older than 70. (Please see our insurance documentation for further details of exclusions). If the insurance is invalidated through any falsification of details the hirer will be liable for any costs incurred including third party claims. The vehicles have comprehensive insurance for the named drivers. The insurance is limited to 75% of cover if destroyed by fire due to cooking. In this instance the hirer will be liable for the outstanding 25%. Our insurance only covers the vehicles and its contents. The hirer's personal effects are not covered by our insurance and we suggest the hirer take out separate travel insurance. Bay Campers are not responsible for any damage in connection with any accident or breakdown, nor are we responsible for any loss from the vehicle. Our insurance policy protects us and any authorised driver against legal claims from any other person or death or personal injury or damage to any other person's property caused by use of the vehicle on the road, on condition the hirer reports all such incidents to us during the hire period or on return of the vehicle (and the hirer is using the vehicle within the terms and conditions and those of our insurance company). In the event that any third party suffers death, personal injury or damage to property caused by use of the vehicle which involves a breach by the hirer or any authorised driver of any of the terms and conditions of this agreement, and that of our insurance policy the hirer agrees to reimburse us if we are obliged to compensate (a) the insurers for any payment they make to a third party on the hirer's behalf and/or (b) any third party. We will need to see the hirer's original driving license to insure the hirer. If the hirer does not present both parts of their driving license we will not be able to let the hirer drive the vehicles. We also require a second piece of identification with the hirer's current address on it. This can be a passport or current utility bill. In the event of invalid driving licenses we will not allow the hirer to drive the vehicles and the hirer is liable for the full cost of the rental period. What we provide: We will provide the vehicle in a good state of repair complete with all the items on the inventory. The hirer agrees to return the vehicle and all the items on the inventory in the same condition as the hirer received them. We will also rent the vehicle with a full tank of fuel, the oil at the correct level and the washer fluid full. The hirer must return the vehicle with a full tank of fuel and the oil at the correct level. Before taking the vehicle Bay Campers will check the vehicle with the hirer for any damage. This will be recorded for future reference. Bay Campers will also give the hirer full instructions on the workings of the vehicle including driving, roof mechanism, and any warning lights. This information will also be in the welcome pack found in each vehicle. Vehicle contents: Welcome pack, Torch, warning triangle, high visibility jacket, cooker, set of vehicle levellers, set of 4 plates and bowls, cutlery set, cooking implements, 4 cups, 4 glasses, awning, mallet, 2 single inflatable mattresses, electric pump, waste water container, camping table, 2 camping chairs, two camping stools. 2 x Camping gas cylinders. Collection and return: Collection will take one hour and will involve completing all the paperwork, taking security deposit and showing the hirer round the vehicle including a short driving demonstration. Weekly rental: collection after 1500 on Saturday and return before 1100 the following Saturday. Weekend rental: collection after 1700 on the Friday and return by 1000 on Monday (off peak only) Midweek rental: collection after 1300 on Monday and return Friday 1000 (off peak only) The hirer will be charged a late return charge of £40 per hour and will be eligible for any costs incurred by Bay Campers if the late return impacts on the next person's rental period. During off peak rentals collection and return outside of the times above can be arranged by negotiation. Vehicle occupants: The hirer must supply the details of all the people who are staying in the vehicle for the duration of the rental period. The hirer must not drive with more than 4 people in the vehicle. If the hirer is driving with children the hirer must obey the law with regard to child seats and booster seats. The hirer is responsible for using a child or baby seat. If in doubt please check out the guidance at www.childcarseats.gov.uk. Good Driving Suggestions for an enjoyable ride: Keep the speed down - your vehicle's top speed is 55 mph - these vehicles were built in the 1960s and 70s when vehicles were very different! You will find the gears and brakes very different to modern cars and it is advisable to leave lots of space and allow lots of time for braking and gear changing. Don't let your vehicle struggle up hills - better to change down and keep the revs up. The hirer must not tow or push a vehicle or be towed or pushed. Never try to bump start the vehicle. Only drive on surfaced roads unless you are in a campsite. Any damage caused off road will invalidate the hirer's insurance and the hirer will be fully liable for any costs. Engine Care If there is damage or breakdown caused by the hirer's own actions, the hirer will be liable for the cost of repair/replacement. This could be such things as working the engine too hard, or putting diesel in a petrol engine or putting petrol in a diesel engine, or burning out the clutch. This list is not exhaustive. You must check the oil, water and other gauges beyond 500 km, refilling as necessary. If the hirer causes damage to the engine through driving too fast (over 55 mph) over too long a period of time, and ignoring the warning lights, the hirer will be liable for any repairs required or even the cost of a replacement engine. We ask that the hirer allows plenty of time to return to the Bay Campers on your last morning, to avoid overheating the engine. In the event of a breakdown: If you have any problems with your vehicle report it immediately to Bay Campers. RAC breakdown cover is provided. If the vehicle cannot be repaired the hirer must have the vehicle recovered via RAC to Bay Campers. Bay Campers will not be liable for any costs resulting from the breakdown including accommodation and travel costs. We will endeavour to replace your vehicle with a similar if we have one available. If we have no replacement we will refund the hirer the complete days the hirer has not been able to use the vehicle. The hirer must not abandon the vehicle and if you do not wish to accompany the vehicle back to Bay Campers you must hand the keys to the RAC Recovery vehicle driver. Accidents, theft and vandalism: The hirer must report any accidents, thefts and vandalism involving our vehicles to the police and to Bay Campers immediately. The hirer must not release anyone from liability or settle any claim. The hirer must get all details from the parties involved. The hirer must cooperate with us and our insurers in the event of any investigations or legal proceedings. In the event of the vehicle being unusable please see conditions above in 'In the event of a breakdown'. Our Liability to the hirer We will not be liable for any loss or damage suffered by the hirer unless it is caused by our negligence. In the event that the vehicle the hirer hired is unavailable due to accident, breakdown or any other situation beyond our control the hirer will receive a full refund and will have no further claim against Bay campers. It is your responsibility to ensure all doors, windows and hatches are locked. In the event of your vehicle being unavailable We reserve the right to provide a replacement of similar specification and type. We have an emergency replacement VW T25 van which is available in the event of a break down. On acceptance of this vehicle no refund is available. We will endeavour to return your original vehicle to the hirer as soon as possible. Extent of hire: The hirer is required to stay within Cornwall and Devon. However if the hirer wishes to travel further afield please ask and we can discuss your requirements. Smoking: Smoking is prohibited in our vehicles and tents. The hirer will be responsible for any damage caused including any cleaning costs. Pets: Pets are allowed but any additional cleaning costs occurred due to your pets will be paid by the hirer. We ask that you discourage pets from climbing on the seats. Personal Data: When you book the your campervan, we collect personal information such as the hirer's name, email address, home address, telephone number, credit or debit card number, security code and the card's expiry date. This allows us to book the campervan and insurance for the hirer. We will also collect non-transactional data should the hirer enter a competition, request a brochure or take part in a survey, for example. We may use the information that we collect to occasionally notify the hirer about news and information we think the hirer may find valuable. For example, we may send the hirer our latest brochure, supplements, newsletters and special offers. If at any stage you decide that you would rather not receive such information, please contact us by telephone, email or post. We will pass your identity information to our insurance company. Information not required after the vehicle rental period will be deleted or destroyed. All information is stored as per the guidance in the Data Protection Act 1998. We will not sell or pass your information to any other company. If the hirer breaks these terms and conditions we reserve the right to terminate your booking with no recompense to yourselves. Definitions: Bay Campers - Bay Campers of Cornwall. 'the vehicle' - campervans owned by Bay Campers of Cornwall. 'hirer' - the persons agreeing to these terms and conditions. This agreement is between Bay Campers of Cornwall (Bay Campers), 27 Dobbs lane, Truro, Cornwall, TR1 3NB and any persons using Bay Campers' website and/or entering into a hiring agreement with Bay Campers. By signing these terms and conditions the hirer is agreeing to comply with them in full.
