Terms and conditions of hire This Agreement is made between North Devon Camper Hire Limited of North Barn, Hook Farm, Sheepwash, Devon EX215PN and the person(s) signed below. Except where otherwise stated the following words have the following meanings in this Agreement: “The Campervan” – This means the campervan hired to you under this agreement and as specified to you by us including all tyres, tools, accessories and equipment. ”You” – The person or persons signing this agreement “We / us” – North Devon Camper Hire Limited “The Agreement”, “The Rental Agreement” and “Terms and Conditions” – This agreement and any document expressly referred to in this agreement including an insurance document and motor rental agreement. “Security Deposit” – The sum as detailed below paid by, bank transfer or debit card. “Booking deposit” – sum paid at the time of booking to secure the rental period. 1. Booking and Payment The campervan hire booking is completed and reservation binding once we have received a £175 non-refundable booking deposit and all booking and insurance forms.. The balance of the hire charge (full charge less deposit) is due 42 days (6 weeks) before the start of the rental period. For late bookings (less than six weeks before departure) the full rental price is payable on booking. The Campervan will not be released without full payment being made. A security deposit of £750 (£1000 for festivals) is payable by debit card or bank transfer prior to collection of the campervan. On collection of the campervan you must provide your full driving licence (photo card and paper counterpart) of which we will retain copies for our insurance. Please ensure you are able to produce this in advance of your booking. You must also provide further photographic ID and proof of your address in the form of two utility bills, recent bank statement or council tax statement per driver. Each document but be no more than three month old. 2. Our Obligations We will supply the campervan to you in excellent overall and operating condition, complete with all necessary documents and accessories. You agree to return the campervan to us in the same condition as you rented it, subject to fair wear and tear, with the same documents and accessories, at the location and on the date and time designated in this Rental Agreement or sooner upon demand by us. Failure to do so may result in further charges becoming due and payable by you. 3. Your Obligations You warrant that all information supplied by you to North Devon Camper Hire Limited in connection with this agreement is true. 4. Cancellation In the event of a cancellation the following applies: Cancellations between 42 and 7 days of start of the rental period – a fee of 50% of the total hire charge will be incurred. Cancellations less than 7 days before the rental period commences – a fee of 100% of the total hire charge will be incurred. 5. Hire rates Hire rate quoted include: Unlimited mileage within the United Kingdom and 200 miles per day in Europe, if this exceeded there is a charge of 19p per mile UK comprehensive vehicle insurance*; Full UK and European breakdown cover. * In some cases, we will incur additional charges if any driver to be insured has traffic convictions, is using a foreign driving licence, works in what our insurers consider to be a high risk occupation, has criminal convictions, has any physical or mental conditions which may inhibit driving, or has had an accident in the previous 3 years. These charges will be passed on to you and you will be notified in advance. 6. Payment of Charges All charges and expenses payable by you under this Agreement are due on demand by us. If you do not pay all charges due, a late charge of 4% per calendar month on the outstanding balance and any collection costs incurred by North Devon Camper Hire Limited, including reasonable legal fees, will be added. When you comprise more than one person, each person is jointly and severally liable for all obligations of you pursuant to this Agreement. 7. Insurance The Campervan is to be hired with our comprehensive insurance for the first and any other named drivers. Insurance is only for our campervan. The interior equipment and other items as specified in the campervan are not covered by the insurance and any damage will incur costs in addition to the excess. Failing to provide information may invalidate your insurance and render you liable for all losses howsoever sustained including claims by third parties. We are not responsible for any damage in connection with any accident or breakdown caused by you, nor are we responsible for any loss from the campervan. Our insurance policy protects us and any authorised driver against legal claims from any other person or for death or personal injury or damage to any other person’s property caused by use of the campervan on the road, on condition you report all such incidents to us during the rental period or on return of the campervan (and you are using the campervan within the terms and conditions and those of our insurance company). The terms and conditions of our insurance company are available on request. In the event that any third party suffers death, personal injury or damage to property caused by use of the campervan which involves a breach by you or any authorised driver of any of the terms and conditions of this Agreement, and that of our insurance policy, or our Health and Safety Guidelines, you agree to reimburse us if we are obliged to compensate (a) the insurers for any payment they make to a third party on your behalf and/or (b) any third party. Our Insurance Company terms and conditions are available on request in hard copy, or can be viewed at our offices. 8. Travel Insurance You are advised to take out your own travel insurance to cover your personal effects while stored in the campervan and to cover items not part of the Campervan insurance, for example, last minute cancellations or illness. 9. European and Ireland travel There is an additional charge which can be arranged in advance to cover EU Insurance and EU breakdown cover. You must inform North Devon Camper Hire Limited of the countries you intend to travel to in advance of your hire to ensure that the country to which you intend to travel is covered by our insurers. Travel outside of the prearranged countries will result in a penalty of £1000, not including any costs incurred by travelling to that country, including breakdowns, losses, recovery, etc. For European travel we have a maximum mileage limit of 200 miles per day, if this is exceeded you will be charged 0.19p per mile. North Devon Camper Hire Limited reserves the right to refuse travel into any country deemed as high risk or not covered by our insurers. 10. Extra Driver Insurance Additional driver £5.00 per day (UK full clean driving licence) Non-UK driving license holder: £5.00 per day + £35 admin fee 11. Drivers Drivers must be over 25 years of age and under 70, in good health and hold a full clean UK or EU driving licence for at least 2 years. (“Good Health” means that you have no mental or physical disabilities which would interfere with your ability to drive, for example stroke/deafness/heart condition/diabetes/loss of limb/loss of sight in an eye/epilepsy. In addition you must not be taking drugs likely to affect your driving or drugs prescribed by a registered medical practitioner for treatment of drug addiction.) We will require the driving licence numbers and other identification information for all those who intend to drive, when you make your booking. We will need to see the driving licences for all named drivers, plus another form of photographic identification such as passport and proof of address such as a recent utility bill (for each driver) on collection of the campervan. You cannot drive away our campervan without us having taken copies of your licences and ID documents. Drivers are personally liable for all legal penalties (eg: parking tickets, London congestion charges, speeding) which may be incurred during the period of hire. The campervan must only be driven by you or any other person who has first been authorised by us, for whom you have provided the insurance, driving licence and personal identification information. Failure to provide accurate information may invalidate the insurance and render you liable for all losses howsoever sustained including claims by third parties. 12. Rental and other charges You will pay North Devon Camper Hire Limited: All rental charges; The Security deposit; The nominated cancellation fee in the event of cancellation of this agreement prior to the hire; The cost of any damage to the campervan or the property of any third party, subject to the insurance cover; All Government fees and duties, etc; All parking fines, other fines or penalties, and/or accidents including third party property damage not reported on return of the camper, and associated administration costs incurred in relation to the Campervan during the rental period; Any other fees or charges payable by you pursuant to this agreement. This includes any costs incurred by North Devon Camper Hire Limited as a result of any breach by you of the terms of this Agreement; The daily rental rate for the period the Campervan is off fleet for accident repairs (demurrage); and The cost to recover a vehicle which has become bogged. 13. Collection Collection is from our address specified on the invoice. When you arrive to collect the campervan, please ensure you allow at least an hour for us to show you around the campervan, how to drive the campervan, and how to operate the cooker, sink, fridge, roof, camping gas, heater, fresh and waste water storage and other accessories, and to brief you on our health and safety guidelines. We will also need to complete the paperwork in that time. You will also need time to load your luggage into the campervan. If on arrival to collect your vehicle your licence or paperwork is unacceptable due to endorsements, defacements or being out of date you will be unable to hire the vehicle and no monies will be refunded to you. 14. Condition You and we will check the condition of the campervan at the start of the rental term and on return of the Campervan. You acknowledge receipt of the campervan which appears, upon visual inspection, to be in good, clean condition and sound working order on collection. It is your responsibility to check the campervan for any existing damage upon collection of the Campervan and to inform us of such before you depart. 15. Return Weekly hires normally commence on a Friday, collections are at 15.00 and returns must be by 10.30 am on the following Friday. Unless agreement is made in writing for alternative times as per the booking invoice. Long Weekends commence at 15.00 on the Friday and return is by 10.30 am the following Monday. You must return the campervan by the agreed time. Please allow sufficient time to get back to our premises. A check will be undertaken to identify any potential malfunctioning of the Campervan or its equipment, fuel level or any other relevant matter requiring attention at the point of return. If at any time we have agreed that you may return the campervan to a place other than our premises, or if we have agreed to collect it, you will remain fully responsible for the campervan until it is collected by us or the RAC. You are responsible for any costs incurred in returning the campervan to our premises should you abandon the Campervan. We will not refund any portion of the hire charge if the campervan is returned early. The campervan must be returned with a clean interior and exterior. 16. Late Return If a van is returned to our premises later than the agreed time without our prior agreement, an additional charge of £50 per hour will be payable. Should the late return of the campervan make us liable for extra costs, we reserve the right to pass on these costs to you. Charges and costs for late return will be deducted from your security deposit. By signing this Agreement you agree to our making such deductions. Should the late return be due to accident that is your fault, you will be liable for any revenue lost due to the campervan being unavailable for hire. 17. Vehicle Damage – Insurance Cover and Charges You are aware that: a. The campervan is comprehensively insured including cover for damage to the property of a third party; b. The insurance excess is £500.00 (£750 for festivals) c. You will be liable for all vehicle repair costs that are not covered by insurance up to £1500 for example: awning, kitchen equipment, roof bellows, accessories (this list is not exhaustive) d. All replacement parts and accessories will be original VW commercial vehicle approved. e. All labour will be exclusively provided by VW commercial vehicle approved centres. f. You will not have any insurance cover and you will be responsible for the total cost of any damage if you breach any of the terms of this agreement. 18. Road Restrictions a. All Vehicles may only be driven on sealed / bitumen roads; b. You acknowledge that North Devon Camper Hire Limited reserves the right at any time, at its sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause. 19. Security Deposit a. Prior to taking delivery of the campervan, you agree to pay the Security Deposit of £750 (£1000 for festivals) b. You irrevocably authorise North Devon Camper Hire Limited to deduct from the Security Deposit any amounts due by you to North Devon Camper Hire Limited arising out of this Agreement; c. The security deposit will be refunded within 7 working days of the campervan and accessories being returned to the correct location, undamaged, with a clean interior with a full fuel tank. We reserve the right to retain a £100.00 soiling fee if the campervan is not returned with the interior and exterior in a clean condition. 20. Use of the Campervan You agree that during the rental period, you will not allow the Campervan to be: a. driven otherwise than in a cautious, prudent and normal manner; b. used in a manner which could cause damage; c. driven in a prohibited area or in an area other than the areas indicated by me to North Devon Camper Hire Limited ; d. driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law; e. left with the ignition key in the Campervan while it is unoccupied; f. washed with a rotary car wash. The campervan should only be washed by hand, using a bucket and sponge. g. You must look after the vehicle and make sure it is locked secure and parked in a safe place when not in use. h.. driven by any person i. Under the age of 25 years or over the age of 70 year; or ii. Who is not authorised by law to drive the Campervan. Particulars of a proposed licensed driver of the Campervan are set out under the heading ‘Driver Details’ in the Rental Agreement. iii. Not referred to in the rental agreement h. damaged by: i. submersion in water; ii. contact with salt water. i. used for any illegal purpose, for any race, rally or contest; j. used to tow any vehicle or trailer, other than that provided by North Devon Camper Hire Limited k. used to carry passengers or property for hire or reward; l. used to carry more persons than is allowed due to the seat belt capacity of the campervan. m. used to carry volatile liquids, gases, explosives or other corrosive or inflammable material; n. used ‘airside’ or in close proximity of any aircraft; o. driven outside of the UK (unless agreed by us) p. otherwise used in breach of my obligations under this Agreement. 21. Engine Care If there is damage or breakdown caused by your own actions, you will be liable for the cost of repair/replacement. This could be such things as pushing the engine too hard, or putting petrol in a diesel engine or vice versa, or burning out the clutch. This list is not exhaustive. You must take all reasonable and practicable steps to properly and safely maintain the camper including regular checks on; batteries, engine oil and other gauges, bulbs and tyre pressures and condition when driven more than 500 miles, refilling or replacing as necessary. If you cause damage to the engine through driving too fast (over 70 mph) over too long a period of time, and ignoring the warning lights, you will be liable for any transport costs, repairs required or even the cost of a replacement engine. 22. Alterations to the Campervan You shall not make any alterations or additions to the Campervan. 23. Fuel The fuel tank will be full on collection and must be returned to us full Failure to return the vehicle with a full tank will result in an administration charge of £25, plus the cost of the missing fuel, this will be deducted from your security deposit. The campervan uses diesel fuel only, if the incorrect fuel is put into the vehicle you will be liable for all vehicle repair costs. 24. Smoking Smoking is not permitted inside our campervan or awning. You will be liable for any damage or smoke contamination caused to the campervan or contents. 25. Drinking Water We cannot be held responsible for the cleanliness of drinking water obtained from various campsites and you are advised to check this with the site owners on arrival. The water stored in the campervan is not drinking water. We do advise that you drink bottled water. 26. Camping gas Camping gas is provided for the cooker. We will meet the cost of one additional cylinder of gas on production of a valid VAT receipt. We will not pay for an incorrect size or make of gas cylinder and will charge you £70 for replacing the incorrect size or make of gas cylinder. 27. Pets Pets are not permitted unless authorised by North Devon Camper Hire. If you decide to ignore this policy valeting charges will be incurred. This also means that you will lose your Security Deposit and also any cost of replacing any items damaged by or from the smell of animals. If we have authorised a pet to travel, any damage caused by the animal will be charged to you. Pets never be left alone or unsupervised in the campervan. 28. Passengers North Devon Camper Hire Limited authorises the use of these vehicles up to the stated number of passengers. Each person to use the safety restraints provided at all times whilst vehicle is in motion. You must carry only as many passengers as there are seat belts in the campervan. You are legally responsible for obtaining and using an appropriate child or baby seat. For each child under 135cms (4’5” inches approx) or under 12 years of age you must use a booster seat or baby seat as appropriate. Keys In the event that keys are lost or damaged, the campervan will be recovered by vehicle recovery services to an authorised garage. You will be liable for the reasonable costs of obtaining replacement keys, and any costs associated with providing the keys to you during the hire period. You must lock the campervan and retain the keys on your person when not in use to comply with the terms of our campervan insurance. 30. Your Car During the period of the hire you may park your car at our premises but do so at your own risk. We cannot accept responsibility for the loss of, or damage to your car or its contents unless caused by us. 31. Maintenance You shall take all reasonable steps to properly maintain the Campervan, including oil checks, water and batteries. You acknowledge that North Devon Camper Hire Limited will reimburse you for expenditure up to £ 50.00 reasonably incurred in rectifying any mechanical failure to the Campervan (not including the water system, refrigerator, heating, or audio) provided that: You produce relevant receipts; You have received the prior consent of North Devon Camper Hire Limited; and the damage is not due to your fault or your breach of this Agreement. Subject to the terms of this agreement, you will pay for the cost of repairing or replacing tyres damaged during the Rental Period provided that North Devon Camper Hire Limited will reimburse you for expenditure reasonably incurred if: You produce relevant receipts; The tyre is defective and is returned by you to North Devon Camper Hire Limited for inspection; The manufacturer accepts liability under his warranty; and you will be liable for any costs associated with the incorrect use of fuel. All damage and accident repairs will be carried out by VW commercial vehicle approved agents using VW commercial vehicle parts. All repair costs must be authorised by us PRIOR to the work being undertaken. 32. Breakdown If you have any difficulties report these immediately to us. In the event of breakdown, recovery or repair services will be provided via a breakdown service. We cannot accept liability for any costs arising from accident, breakdown or any other cause, e.g., replacement van costs, travel, accommodation, telephone calls, etc. Our liability extends to refunding your hire charge for any days you lose the total use of the Campervan. You will be responsible for returning to North Devon Camper Hire Limited, at your own cost, but preferably with the breakdown recovery service returning our campervan. If you have caused the breakdown through your own actions you will be liable for all costs incurred and we will not refund you any unused days of hire. If you have broken down you must remain at a safe distance from the campervan until the Breakdown Recovery Vehicle arrives. You may not abandon the campervan at the roadside. You must hand over the keys to the authorised Recovery Vehicle Driver. If you abandon the Campervan, we will deduct any transport and labour costs incurred in returning our campervan to North Devon Camper Hire Limited and any costs arising from loss or damage to the campervan whilst it is unattended from your Security Deposit. 33. Accidents, theft and vandalism You must, where possible, report any traffic accident involving the campervan to the police (and us) as soon as practicable and report loss, damage or theft involving the campervan to the police (and us) immediately on discovery of the incident. Our insurance requires that you must not admit to any liability, release any party from liability, settle any claim or accept any disclaimer in the event of the accident, but should, if possible, take the names and addresses of everyone involved, including witnesses, car registration numbers, together with all the details of the accident, time, place, how it came about, damage to vehicles etc. If you have a camera, take photos of the scene. Please do not move the Campervans before the police arrive, as long as keeping them in situ is a safe thing to do. An accident or theft report form must always be completed and submitted to us when you return the campervan or within 3 days of return of the Campervan, containing all the above information, plus diagrams if possible. In the event of theft, you must return the keys to us. You agree to co-operate with us and our insurers in any investigation or subsequent legal proceedings, providing evidence and attending court if necessary, arising out of any loss of or damage to the Campervan. 34. Terminating the Agreement You acknowledge that North Devon Camper Hire Limited may terminate this Agreement and repossess the Campervan at any time and that you will pay the reasonable costs of repossessing the Campervan, including towing charges if: a. You are in breach of any term of this Agreement; b. You have obtained the Campervan through fraud or misrepresentation; c. The Campervan appears to be abandoned; d. The Campervan is not returned on the agreed return date or North Devon Camper Hire Limited reasonably believes that the Campervan will not be returned on the agreed return date; e. North Devon Camper Hire Limited considers on reasonable grounds, that the safety of passengers or the condition of the Campervan is endangered. You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges or the Security Deposit. 35. Release and Indemnity of North Devon Camper Hire Limited Subject to its obligation to deliver the Campervan you release North Devon Camper Hire Limited, its employees and agents, from any liability to you (regardless of who is at fault) for any loss or damage incurred by you by reason of this Agreement, including but not limited to: Any loss or damage caused by breakdown, mechanical defect, accident or the Campervan being unsuitable for my purpose; Any loss or damage to any property left in or on the Campervan, in any service vehicle or on any North Devon Camper Hire Limited premises or recovered or handled by North Devon Camper Hire Limited. Subject to any insurance arrangements agreed with North Devon Camper Hire Limited, you hereby indemnify and shall keep indemnified North Devon Camper Hire Limited , its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Campervan. 36. Title to Vehicle You acknowledge that North Devon Camper Hire Limited retains title to the Campervan and that you possess the goods as a mere bailee only. You do not have any right to pledge North Devon Camper Hire Limited credit in connection with the Campervan and agree not to do so. You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Campervan. 37. Changes Any changes to this agreement must be in writing and must be signed on behalf North Devon Camper Hire Limited and by the person(s) signing this form. 38. Personal Data When you book your campervan, we collect personal information such as your name, email address, home address, telephone number, credit or debit card number, security code and the card’s expiry date. This allows us to book the campervan and insurance for you. We reveal your identity information to our insurance company. We will not sell your information to another company. 39. Proper Law This agreement shall be governed by the law of Great Britain in which this agreement was signed. 40. Entire Agreement These Terms and Conditions override and supersede all previous versions and any previous course of dealing between the parties and incorporate the whole Agreement together with any insurance conditions notified to you at the time of hire or collection (and which are available to view at our premises). In the event of any inconsistency between these Terms and Conditions and any other of our literature, whether found in our brochure or on our website or otherwise, the provisions of these Terms and Conditions will prevail. If any provision of these Terms and Conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from this Agreement and rendered ineffective as far as possible without modifying the remaining provisions of this Agreement, and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions.
